  1. Hi,

    I have just arrived in the US a few days ago on my K-3 non immigrant visa. Do I need to pay for my Biometrics fee along with my EAD application? I have planned to send my EAD application before my AOS application. I am going to send my AOS application next month after I get my medical done. I was wondering if I could pay my biometrics then?

  2. I think, the doctor would tell you, if there is any concern.

    They must tell you first before they send it to the Embassy but I have a question to you..Did you have any vaccinations??? because in my package they said " vaccinations are not required for those applying for this visa "K3" is this was there in yours too??

    Hi,

    They didn't tell me to bring my vaccination history in the packet 3 for the medical. When I called the doctor's office to set up my medical appointment that's when they told me that I need to have proof of a tetanus and a measles/mumps vaccination shot.

    I just had my medical exam done for my K3 non immigrant visa in Vancouver. I am wondering how do you know if you passed your medical exam or not? I mean if the exam found that you had HIV or TB would they tell you? Or do they tell you once you go to your K3 visa interview?

    I have my K-3 visa interview for my non immigrant visa in June. My wife has also received her I-864 letter for my k-3 immigrant visa(CR-1). Can I get the K-3 visa and then move to the US and then proceed with the paper work for the CR-1??. That seems too confusing because then we will have to pay for all the paper work for that visa. Has anyone done that on this website? How do I go about telling the NVC that I don't want to pursue the CR-1 visa?

    I was surprised to know that I don't need an affidavit of support form for my K 3 visa interview in Vancouver,BC. I noticed that I was missing the I-134 form in my packet 3 so I emailed the US consulate in Vancouver and they said I don't need that form. So I guess that means I need to wait until I do my AOS to do an affidavit form(I-864). Anyone else have the same thing happen to them?

    I have received my packet 3 and i had a few questions regarding it. On the check list it says to give a $100 US non refundable fee for my k3 visa application. Now do I need to mail that to the US consulate in Vancouver which sent me the packet or do I give that money once i go for my interview?

    Next question, I didn't receive any I-134 form with my packet 3 or any kind of instruction to fill out any support form in my packet. Does this mean I don't need to fill out an I-134 form anymore? Or will it come in packet 4?

    There is a question on the DS-230 part 1 question #25.It states to list dates of all previous visits to or residence in the United States.Give type of visa status. Do i need to list all the times I have been in the US? because I have been there lot's of times over the last 15 years. And I am a canadian citizen so what do i put under type of visa used to enter US?

    I was curious to see if the NVC had received my I-129F petition yet. So i just called them and they told me that they have already forwarded my petition to the embassy in Vancover on April 25th. That was sooooooo quick!! Now I am getting really excited about how fast my packet 3 might come.Maybe in the next 2 weeks and then hopefully i get my interview end of June.

    I just received some good news today. My I-130 petition was approved April 25th 2006!! The funny thing is my NOA2 for my I-129F was approved on April 13th. So the dilemma is now which one of these is going to get to the US consulate in Vancouver,BC first. And which one do I go with. The I-129F(non immigrant K-3 visa or the i-130 immigrant visa(CR-1)??

    Any thoughts??

    I was just approved a few days ago and I was wondering how I can check when the NVC gets my I-129F and when it leaves the NVC?. Do I need to call them or does my petition online get updated once they receive it and send it?

  11. I checked my case status today and I my 129F has been approved. They mailed out my approval on April 13th. I am SOOOOOO Happy!!!!!!!!!! My NOA1 came on February 8th 2006. So it has been about 2 months..The wait is over and now on to myPacket 3.

    I called the INS today and believe it or not After several months of attitudes. I called around 10 minutes before they stop taking calls and I finally got a decent Ins Agent on the phone this time. I informed him that I had gotten my I-130 approved before my I-129F. After giving him my receipt number (That is dated the 31st of Jan and by the way is till invisible) He went to another computer and to see what's really going on and he informed me that they have already processed mine but as you know they will not give any info on approval status (although it has to be because the I-130 was approved). But what he did tell me was that they are processing cases with the date of FEB 5th. I confirmed, re-confirmed and Three-confirmed of his assurance of Feb. 5th processing date, he was getting a bit irritated but he did confirm all three times.

    I asked why hadn't the processing date changed and he stated that they just hadn't gotten to it as of yet :ranting::ranting: But he did confirm the Feb 5th date so to all who has I-129F with that date or earlier you should see some sort of action this week (GOD willing)............... :innocent:

    thank god!!!I think i should have an answer by next week for sure because my application was received on Feb 6th at their office. That's good news.

  13. Just wondering what the average time to receive the NOA2 is. My receipt date is Feb.9/06. I've been touched 4 times and NO approval... Is this normal? Should I be worried? Starting to lose my cool !!!!!

    Also how long from the time your receive package three to the interview. Going through Montreal. thanks needs some reassurance

    Hi there,

    I am also waiting on my NOA2 for my 129F. My timeline is very similar to your if not identical. I am going through the California Service center. As of March 7th 2006 the National benefits center was processing 129F applications with received dates of January 30 2006. So that means they should be processing our 129F soon and should get our NOA2's by end of this week or next week sometime.

    I am a little confused about this police certificate thing. I am a canadian resident living in Vancouver BC. I have read that you need to send a RCMP police certificate with packet 3 once you receive it. My question is there are 2 types of police checks a finger printing one and a non finger printing one(name check). the finger printing one takes 60 days to complete and the non finger printing one takes 10 minutes to 24hrs. So which one do i need for my packet 3?. The finger printing one or non finger printing one?

If the beneficiary is in the US, NVC will wait 30 days for a letter from the petitioner regarding where the I-130 will be processed. If the beneficiary will be adjusting status, then the petitioner should write NVC as soon as the I-130 is approved telling NVC that the petitioner will be adjusting status and to hold the I-130 until USCIS asks for it.

    If after 30 days and NVC hasn't received word from the petitioner then NVC will begin processing the I-130 normally, which means DS-3020, etc...

    What if my 1-130 does not get approved once I get my non immigrant visa?. Do I then HAVE to wait until it is approved to apply for AOS? So it could be 2-3 months after I get my K-3 non immigrant visa? That sucks!!

    Welcome to my situation. My I-130 is on 6 months administrative review right now. But my wife received her K-3 two days ago. Your wife can file for AOS but they won't do anything until the I-130 is approved.

    One more question. Can I apply for my EAD once I move to the US w/o having my I-130 approved or do I have to wait for that as well?

    I was just wondering the way it looks like right now is that my K-3 non immigrant visa is going to be approved before my CR-1 immigrant visa.I just checked online and the california center is only processing 1-130 applications from September 2005. I mailed mine in january 2006. My question is once I get my K-3 non immigrant visa and move to the US and apply for AOS and my EAD do i have to let USCIS in California know that I am abandoning my 1-130 application or do they cancel it once I send them my AOS after getting my k-3 no immigrant visa?

    I have been reading on this website that it is up to the CBP officer if he lets you in the US while your petition is processing. I am waiting for my K-3 visa to be approved and I have travelled back and forth to the US from Canada multiple times. I live in Canada and the most they have asked me is where i am going and for what reason? I have always told them that I am going to see my wife and they ask me if she is american citizen and I say yes. Then they let me in the US.

    My question is how do they know if you are in the K3 visa process or not?Does it show up when they scan your foreign countries passport(in my case Canadian passport) in their computer?

  19. Hi,

    I have been reading on this forum that you need to send tax returns with your I-134. But in the K-3 visa guidelines there is no mention of it. It is only mentioned when you send the I-864 form. It's not even mentioned in the instruction sheet with the i-134 form(the one you get from the government website).

    So I am a little confused about this??!!
