Hi,
I was wondering if it was possible after getting my K-3 non immigrant visa that I could fly back to Vancouver, Canada after applying for EAD and AOS. This way I could keep my job in Canada until my EAD gets approved. Is this legal?

Tony,AP does not allow a person to travel outside the US while their AOS is pending - it allows them to ask to be paroled back into the USA, and keeps their AOS application alive, having left the USA.
A K3 does not need AP as long as their visa remains valid - it's a multi-entry visa so they can re-enter (better than being paroled in), and their AOS application is not considered abandoned by the act of having left.

I was wondering if I needed to apply for an AP to travel outside the US while my AOS & EAD are pending if I get a K3 non immigrant visa or not(through the K-1 process)? I am a canadian citizen and right now I don't need a visa to come into the US.

Tony,I-134 may be used for non-immigrant visas, and usually is used for the K non-immigrant visas.
I-864 is required for immigrant visas. According to the policies laid out in the FAM, it is not to be used for the K visas.

I am a little confused. Is the i-134 for all K-1/K-3 visas and I-864 for Cr visa's?..Which one is needed for what visa?

thanks, but what i am really asking is if the long form is a certified copy of my birth certificate(wallet sized) or the large version of my birth certificate(wallet sized)??

Hi ,
I was wondering when I apply for AOS, if I can send them my medical report (the one you get before you do your interview in getting the k-3 non immigrant visa). I read that I will need to do a medical exam in the US as well when applying for AOS. But is there any difference in that one and the one done before the k-3 interview?
