No where in the CFR does it state that once the GC is approved the AP is null and void. AP is useless to a GC holder once you have the GC in your hot little hands so which would you use?
Here is your Scenario:
You go to the airport and check in at the ticket counter. The ask to see your passport and visa to enter the US. You show them and unexpired AP and they issue you your boarding pass. The AP will most likely remain in your pocket--unless you are flying thru Frankfurt where they check your boarding pass, passport, and US entry documents about three separate times if you change terminals. You enter the US and come to a CBP person. They may or may not even see if you have a GC issued. If they ask, you just tell them the GC arrived while you were out of the country. You travelled on AP. Not an issue. They may send you to secondary for a few additional questions but that seems to happen to most that use AP to enter the US.
Dave
As I am already in Canada, I did a little more research, using many different wordings, and found out I can use AP to come back. I will call USCIS tomorrow and confirm it.
We had the notice on Friday and left at the crack of dawn this morning. My case Status never updated so It was a last minute surprise for me.
-
Hey all,
On August 29th, my AOS was approved. We have a trip planned to go see my family and we are leaving tomorrow, I will bring my approval notice just to be careful. When I come back, do I just show my combo card and my passport, or should I also show my approval notice? I try looking it up on google and VJ, but I haven't found anything yet.
Obviously, I will not have received the green card before I leave.
Any input would be appreciated!
-
I just received my approval for my Green Card!!! No notifications on USCIS website and I was Not expecting that!!!
-
If you married within the 90 days, you are okay for AOS.
Hubby and I married in September 2015 and filled in February 2016 due to some circumstances. As of right now, everything has been going smoothly ( except for some delays, but it has nothing to do with filling so late ).
I won't comment on if you married after the 90 days as I am not 100% sure.
-
Just traveled with AP last month. Passport was in maiden name, I just brought my marriage certificate and never had a problem.
-
Passport and Marriage certificate works. That's what I brought on both my biometrics appointements.
-
Thanks for the response. I have talked with three representitives and one supervisor, and all mentioned the same thing.... "every case is different and only to wait." They mentioned there was a major delay at the USCIS and a backlog of work and they are currently processing applications from March 13th. However I don't understand how tons of applications that I have seen here on VJ, that are sent in my same time frame as mine, after March 13, are being approved and mine is not.
Trust me, I understand 100% what you mean. I saw people from May get their EAD/AP approved and I filed in January. When I asked why I basically was yelled at on the phone that it doesn't matter and every case is different.
As mentionned, maybe try contacting your state senator and congressman. I think if I had not contacted them, I'd still be waiting.
Don't hesitate to PM if you have any questions
-
I was told there is actually NO processing times. Oh, and also, the 90 days is an "approximation". Have been told many many things and had t2 officers giving me different answers every time I called. One told me I would be approved withing the next 10 days ( I was on day 81, Guess what, never happened.) If you call USCIS, I would suggest to keep a log of all the officers' names (and/or ID) and what they told you. I wish I had done that right from the beginning.
If you are as unlucky as I was, they will never answer your service requests. Make sure you call and ask them to do it, do not do it online. Also, if you are over 90 days, I would suggest maybe getting your State senators and congressman involved.
My EAD/AP was approved in 156 days. We had to contact our Senator and congresswoman to get them to finally work on my case. Don't lose hope, you will have it eventually.
-
They didn't even look at my list, they just asked and estimate of how much my belonging were worths.
Also, I went overboard and labelled all my boxes with a number and brief description of what items they contained. I also am someone who tends to make scenarios in their head and freak out, so I decided to over do things.
-
I actually detailed everything. I don't think you have to Just say how many you have
-
OH MY GOD,
My EAD/AP Have finally have been approved!!!!!!!! I just received the text messages!!! I can start job hunting!!!!
-
5 months for EAD? That's crazy!!!
Yup, 5 months. Got a rfie jult 1st so I might wait even more.
-
Hi all,
my I-765 has been pending for 5 months now, and USCIS has not been answered the service requests. We contacted our State Senators and Congresswoman, but anything barely moved. Last night, I decided I would try to contact the USCIS ombudsman, can't hurt to try and get something finally working right...
Did anyone contacted the ombudsman recently? Did it went well? They say it can normally take 45 days, did anyone had to wait that long?
-
Out of Curiosity, is there any February filler besides me STILL waiting for the EAD?
Can't believe I just reached the 5 months mark and still nothing is moving. I contacted the ombudsman last night. Hopefully things will get moving.
-
My brother helped me move and had some of my belonging in his car. Did not have a problem at all.
I had a list of all my belongings, and made sure he was right behind us at the customs. We were sent to secondary inspection (no big deal, it might take a bit if the place is crowded, but once they work on your case it should be fairly easy), and he was sent to a Mcdonald's not to far from the border so he could wait for us. Officer said usually they try to let them follow you to secondary inspection, but if they are too busy they will tell them to go somewhere (restaurant/ Gas station..) and wait on you.
Just make sure you have the list, and try to have an estimate of how much your belonging are worth, they asked me that.
-
That's good news. Did you get your EAD card too?
No, but the lady at the NYC office said they are working on March cases and I should get it soon.
Let's say something happened and we got the section chief to help us and she saw I was nearing 5 months on everything.
-
Any luck with the emergency AP? Hope your dad is doing better now
Yup I was approved and they actually gave me the AP for 1 year.
And he is thanks. Waiting on a surgery, still weak as hell but he is out of the woods for now.
-
The note was okay, I was approved and we are leaving tonight!

Yes a scanned and emailed version of it or photo works. I didn't have time to wait for the letter in the mail all the way from Sweden so my brother scanned and emailed it and USCIS accepted it.
When you go back ( don't know if they told you, they didn't tell me until I was there...) you also need to bring 2 passport photos and your case number for your AOS. I am fairly certain you won't have to pay for the Emergency AP if you have proof that you've already applied for the regular AP. We had to pay $360 even though we had the case number for the regular AP but it wasn't in the system yet.
Good luck!
Thankfully my husband was there and was able to finish the discussion for me (anxiety sucks). He mentionned the photos, but I actually filled the form and added everything they ask for. Decided to consider it like a different application and take no chances, but the officer mentionned to make sure I have my receipt number for my regular AP to avoid paying the fees. I brought all my I-797 wednesday and will bring them tomorrow (Later today... oops).
If everything goes well and I am approved, we leave almost immediately after I have the AP in my hand.
Getting the note was a hassle. Plus, no one wanted to actually write it in English. Thankfully, my Brother in Law was able to see my father's doctor and explain the whole situation and he actually wrote it in English. ( I could translate it, but as I am not 100% Bilingual, I try not to translate official documents)
-
Ok, after multiple calls and my brother in law going to the hospital to talk to my father's doctor directly, we got a note. I do not have access to a fax right now, will a picture of the note (there is a date on it ) work?
-
So,
I went to the NYC office yesterday and the (really rude uninterested) officer told me I ABSOLUTELY need a letter from the doctors about my dad.
The hospital REFUSES to write the note. Administration Said if they do it for my dad they'll have to do it for everyone else. Is there ANY way to go around that or I just am stuck in this hell hole?
-
Already tried. Sadly every local offices nearby have no available appointment. Called USCIS and lady said try a walk in, not guaranteed to work but it's the only thing I can do right now according to her.
