  1. Hi,

    I did a request on the CBP website to check out all of my entries and exits, but I find them to be very wrong at times.... Do they base your visa acceptance (making sure you didn't overstay) based on their entry and exit records? Here are some examples that came up on my file:

    (The chronological order goes from bottom to top)

    Departure 2013 November 22 SUM - SUMAS, WA

    Arrival 2013 May 12 VCV - VANCOUVER, B.C. CANADA

    How is that possible. first of all it says that twice I stayed for 6 months which is DEFINITELY NOT correct... I live across the border and did not stay 6 months in the US. I have a B2 visa that is good for 6 months, but never stayed that long. Most of the time they are a one day trip for shopping, sometimes they may be counted as 2 days because I go back right after midnight, but NEVER have I stayed a night, sleeping in the US during that period of time... and second of all, how can I enter multiple times into the US but leave on May 14th for every single arrival... makes no sense...

    here is another example where they have me go in the US but not leaving ever, but somehow I'm entering the US again...

    and it goes on like that for about 2 years where it shows my arrivals but never my departure....

    Am I gonna run into issues when it comes to getting a visa? Would they think I overstayed?

  2. Oh Ok, I thought I had to wait for my I-130 to be approved.

    I have been in the US for about a month. My visa is still valid. I came here to travel for the summer with my USC spouse, but we decided we wanted to stay and travel for a few years around the US.

    It is the I-130 NOA-1 you need to include. There is no reason to wait for the NOA-2 and this may make it more difficult as they will route it to NVC for overseas processing.

    Following the guide at http://www.visajourney.com/content/i130guide2 for filing the I-485. Include a copy of the NOA-1 from the I-130.

    How long have you been in the US, how did you come here, and when did your visa expire?

    I am putting together my AOS packet.

    I have already submitted I-130 (married to a US citizen) and I am waiting on NOA2.

    I know I have to add a copy of my I-130 NOA2 in the package, but what other forms do I need to submit?

    Do I need to send the g-325a again? I sent them with my I-130 so I don't know if I need to send them again with I-485.

    Do I need the affidavit of support when filing I-485?

    So here is what I know I need so far:
    - copy of I-130 NOA2
    - I-485
    - I-131 (in case i need to travel)

    - check for $1070

    - ?

    Anything else?

    I would love to get a lawyer to help me out but unfortunately I can't afford one frown.gif
