You will be the main sponsor regardless of your income, even if you have no income at all you're still required to fill the form as the main sponsor. Since your mom claimed you and your son in her most recent year taxes then you're counted in her household even if you're paying rent, your bills and all your daily life costs. She can still be the joint sponsor if she makes 125% of the poverty guidelines for a household of 4 (your fiance, you, your son and herself) she can count assets such as property or savings if she doesn't make enough for a household of 4. If he files after 3 years, even if he is still legally married to you, the condition and what he is burdened to prove , is that the marriage is bona fide, as in real, not just legal - staying married for the purpose of obtaining immigration benefits would be considered fraud.
If you sponsored him and he is the one requesting the divorce, then the law is doing exactly what it is supposed to, which is protect US citizens from immigration fraud.
The opposite of real marriage is a fake one! Fake marriage won't be legal just FYI

I meant by legally married real and bona fide marriage, if you read the full message you'd see that i said it's her role to report any change of status to the USCIS in order to avoid any troubles with them.

I don't know if it's a must but my advice to you is to get it stamped by the ministry of foreign affairs, it will be much better, they're having several notarial service branches that will do that for you in Cairo and across the country and they charge you only 11 Egyptian pounds per document. i used to read your old posts back in 2014! I thought you were deeply in love, I'm really sorry you're going through this. The answer to your question depends on; 1st whether his residence is a conditional one or not. 2nd what exactly you wanna do.
if he obtained his permanent residency based on less than 2 years marriage to you then his residency is conditional and he has to apply with the USCIS to remove this condition after 2 years of marriage or if you're gonna file for legal divorce, then he can apply for lifting conditions right away but he has to come up with solid explanations for the reasons of divorce and proof that the marriage was entered in good faith and not for immigration benefits. He will either succeed in convincing the USCIS with his explanation or he will fail and they will start his removing procedures.
what do you wanna do ? If you believe he was trying to use you for immigration benefits then I'm recommending you to hire a good lawyer as he's under your sponsorship and he can sue you for that to share your income so be very careful! You're not off the hook until he's a US citizen which is why i'm telling you to be vigilant and hire or consult with a good lawyer. He can apply for citizenship after 3 years if he'll remain legally your husband but in case you got divorced he'll have to wait for 5 years from the date he obtained his legal permanent residency status, keep in mind that it's your legal responsibility to report any change in status to the USCIS, expect a home visit from them anytime and if they discovered you're separated they might charge you both for what they'll consider immigration fraud! Especially he's from a MENA country.

I don't understand what's the deadline you're talking about, you should be having 1 year to finish the required documents before your case is terminated, i'm really feeling for you guys as we're suffering from a lot of anxiety too, this whole process and the waiting is breaking my wife's nerves.
i'm willing to help your hubby! Let him call me and i will direct him through that process in order to finish what you need.

your hubby should be fine to process it from Abassiya, Cairo. if he doesn't live in Cairo (his address in the national ID) then he should go to the civil records authority where he lives, it doesn't matter where he was born but what really matters is where he's currently residing. Your hubby can still get it from Cairo, they're sending people away because they don't wanna work, it's not unusual to happen in an Egyptian gov office, you wanna get it asap ? From Cairo ? Then your hubby must have some skills to negotiate with the office clerk and tip him in order to process the required document and do his job.
As for your hubby's siblings documents that they requested, it's really not required, note that there are several types of this family registeration, the one you need could be done only with a computerized marriage certificate and your hubby national ID, also keep in mind before your hubby apply for this document he must go to another gov authority called the information center... Why ? Because he'll need to creat something for you called virtual national id, they need it to link your info with his on their system, i'm sorry I don't know where it's located in Cairo as i have done it in Alexandria, your hubby can ask there in Abbasiya where is the national information center ? they gonna need a computerized marriage certificate there before they hive him your virtual number and they will keep the original so it's better for your hubby to request 2 copies or more of this marriage certificate, they'll give him this virtual id number the same day, as i said your hubby must be active and negotiate with the authority clerks, Good luck, I'm crossing my fingers for you both.

Ok so here is how your hubby should start in detail, i've gone through that same process just yesterday:
your hubby needs to get to Abassiya square to an authority called (civil records authority) in arabic " Al segel Al Madany". Abassiya square is a famous place in Cairo just 2 km from Ramses square and 4 km from Tahrir square so he should has no problem in getting there. First he will need to obtain a computerized marriage certificate from the same building, they'll give to him the same day just with his national ID, Then he should take a photo copy of his national ID and a photo copy of that computerized Marriage certificate and preferably he should has the original marriage certificate in hand when applying. They will charge him 25 EGP and it will take from 10 to 15 days to be done but if your hubby has some skills he can bribe the clerk there so it would be processed faster. Good luck!

My interview is very soon within 3 weeks and i found that i must bring a confirmation page of Aramex registration, where should i get this from ? However i already have an appointment confirmation page and in it there is a field with the address i choosed to pick-up my passport from.
Please help

I'm fee sorry for you really bro! This administrative processing is a real black hole! If you decided to file writ of mandamus you wil need first to know where your case is stuck! Is it at the embassy or somewhere else, you need to hire a good lawyer in order to proceed correctly. I've heard some folks who were having their cases stuck for security checks and they were considering suing the fbi to make a decision! Keep in mind that if your case is stuck at another gov agency not the DOS the embassy will be more than happy to make a decision with refusal in case you filed for mandamus

Totally agree! It's mentioned in the official i864 instructions! Receiving means tested public benefits doesn't disqualify your petitioner. It's going to be better for him however to verify his petitioner mental capacity to get married! Note that consular officers are having absolute power to deny his case or put it on administrative processing indefinitely in case they got skeptical at the interview of his spouse mental health especially that he's FROM MENA COUNTRY

Receiving SSI doesn't disqualify your wife from petitioning for you, you'll get to read that in form i864 instructions when you fill it, she can't use her SSI income to sponsor you and it's good that you're having a joint sponsor just make sure her income meets the 125% guidelines. However, I'm strongly recommending you to contact an immigration attorney ASAP as the USCIS or most importantly the consular team at the embassy will be very harsh to you and they'll demand evidence that your wife is ln a good state of mind to get married. Contact the embassy, inform them you made this mistake with a screenshot of the question and the wrong answer as you can't change anything in that form after it's submitted.

We were told to mail a notarized letter from my petitioner in the states to the US embassy in Cairo before the interview. We want to this letter to reach the Immigrant visa unit in the embassy in Cairo ASAP.
What's the best way to mail that to them ? And what's their exact address ?

To those who are wondering if Egypt is gonna be on the ban list! There is no way it can happen like that! 1st Egypt-US relations are more solid than it was under Obama's administration especially in matters of national security and counter terrorism! 2nd Trump has a very good relation with the Egyptian president Al Sisi, the 1st call Trump received after elections wining was from him, Trump called Al Sisi in December to ask for Egypt's cooperation to postpone a decision at the international security council and so Al Sisi cooperated, Trump called again a few days earlier and arranged for a visit to Al Sisi to te white house this year. So both regimes are having a very good relation, the Egyptian nationals will not be banned totally especially there are tens of thousands of Egyptian chritians who travel to the US every year to visit their relatives there! There's no way they can be banned or having any exceptions if Trump is gonna include Egypt in the ban list as it's unconstitutional to ban some specific race or religion even by a presidential executive order, he's only allowed to ban people from certain nationalities, however the only stage you should worry about is the embassy stage as Trump is planning for what's called extreme vetting and it can be applied to selective applicants based on their religion without exposing this to the media, making it a semi official policy at all US consular missions abroad at MENA countries by giving instructions to the heads of visa section there to put Muslims under administrative processing (the famous black hole) and there's no timeframe for this, we hope that the tight relations between Egypt and te US will make the US embassy in Cairo take it easy on us as they'll have no hard time gathering all the information needed about the applicants from the Egyptian authorities especially in matters of security. Fingers crossed!!!!

Has anyone here scheduled a cr1 appointment online on ustraveldoc.com before ??
So to make the long story short
we received packet 4 for our cr1 visa on November 1st after almost a year and a hlaf of sending our package to the USCIS. Our appointment was scheduled by the NVC at the US embassy in Cairo on December 13. I was unable to attend due to family emergency, i have emailed the embassy later and they replied that my case is ready for interview and i should schedule an appointment online at the site ustraveldoc.com and so i did and got an appointment on April 4. My real concern is they have sent a MRV code for fee payment wich i know nothing about it, we already payed all the fees required and it shows paid on CEAC and my understanding is the only fees left is the USCIS 165 $ which should be paid on the day of interview after you get approved. And they're mentioning some form DS160 which I know nothing about it! After i googled it, i found it's a form for non immigrant visas and k1 visa! However the new appointment letter shows clearly it's a cr1 visa!! How is that possible ?? I'm really confused and unable to get any help from the live support

The real issue is the only people who will get affected by trump dump decisions are law abiding people who want nothing but to be with their families, bad guys will always find a way to what they want as they're having unlimited resources and support from their groups, foreign regimes and agencies or even local organizations inside the US. Now trump is punishing those who follow the law, banning entire countries and making it nearly impossible to get visas even from other MENA countries which are out of the ban list. Even non Muslims are subject to extreme vetting! Thanks America
