  1. confused, DS-3053 is used for u.s. citizens not present for the interview, on this form I can get u.s. notary to seal my oath, but on DS-5507, I cannot sign this but only present before a consul agent or officer, and the ds-2029 states to use this form if you are not present, he/she can fill out this form, but on the form itself specifically states to sign it before a consul officer/ consul/etc. so how then can I sign this???

  2. I am filing CRBA for my son (1yr old). I am here in the States. I am confused on what forms to fill out for his CRBA. I am aware that I need DS-2029, but DS-5507?. Do I also need DS-11 to be filled out and given at the time of interview for my Wife and infant son? what other forms are also needed?

     

    DS-5507. on Page 4 of 5, Part iii. It states to sign it before a consul agent etc. How can I sign this document as I will not be present at the interview? It is saying to sign this form before a consul officer or consul agent. How can I sign this form, when I won't be there on the day of his interview??

To Hank, hi. yeah, I read this section of listing your beneficiaries spouse as saying I should list the spouse, daughter and son, all relatives of the beneficiary and the spouse to the beneficiary. as seen in the attachment. So I am the beneficiaries spouse, and the relationship is HUSBAND or SPOUSE, I interpreted this as myself, the petitioner (spouse).

  4. To RO_AH, hi, I don't know how long you plan to stay in Manila, we waited almost weeks or more for her passport to be mailed ( Tacloban city, Leyte). Not sure how long the process will be for you, we even expedited it :( The passport of your Wife will be a good ID for the CRBA appointment, or you can use other IDs. accepted by the U.S. Embassy in Manila. 

     

    My concern is if I mail out the docs needed will I need to pay for SASE to return my docs back to me in the States. I will need them for when the NVC asks on them after I file. But yeah I am going to file i130 after I get the CRBA done for my Son, I am pretty sure the NVC will be looking into his citizenship and relationship to me, seeing I added him as a relative on the beneficiaries list of family on the i130.

    Reply to AKteacher, ah yes I am currently married to my Filipina Spouse :) She is in Manila, waiting for me to file her and my Step daughter's I130. So I am here in the U.S. preparing their forms to be sent to the USCIS. I was wondering maybe file the CRBA and get his u.s passport first before mailing out the I130 due to reading something about the USCIS or NVC may ask for the child's documentation, since I wrote his name on the relatives of Beneficiary on form I130. 

     

    Reply to BobChq, Great! I will be messaging you very soon once I gather the docs needed and when my Wife and son travel to the U.S. Embassy in Manila. FedeX, ok I will use them to mail my docs to the Embassy. Typically how long does mailing out to and from U.S. to Manila for the embassy to receive the docs? Can I send copies or do I need to send original documentation? 

  6. Hi everyone, Almost finished with filling out I130 forms for my StepDaughter and Spouse. I have few questions on sections of which make no sense to me or I don't have the mental capacity to understand on.:wacko: Below I listed my questions regarding filling out these sections and lastly addition docs needed to accompany the I130 forms for both Petitions ( my stepdaughter & Spouse). MOst of these questions are lengthy and I need concise answers, please, even though how dumb the questions may be lol.

     

    1. Confused about (10a-10i). "Mailing Address" and "Address History". The address i inserted at (10a) is the same as my Physical address, SO do I add last address lived on next address section? or write the same address from (10a) onto (12a)?  

    2. I have two other addresses lived within 5 years in addition to my present physical address, where and how do I add these addresses to the "additional information page" ?

     

    3."Place of your current Marriage" (19a);(20a). Ok I know this is a no-brainer but I want to be safe than sorry. I assume this is asking where we are married at the moment? or where is the location of our marriage? yeah, huh confused. lol.

     

    4. Ok, this question is about PARTS or SECTIONS that DO NOT APPLY to me or my spouse and stepdaughter. OR PARTS and SECTIONS which don't even need filing out due to the question answered needs no further writing in boxes. 

    So my question is... If you have no REASON to fill out any PART or SECTION, do I leave them "BLANK"? or do I write "N/A" on every darn SECTION and/or PART? ( USCIS, states I am to completely fill out the I130 forms, SO..what in the world do you write if you're not necessarily needing to write anything in the boxes under a PART or SECTION??

     

    5. PART 4. about: "if your beneficiaries physical address isn't in Latin, write in native language" Do I add the current address of beneficiary (since the address anyway is in "ENGLISH"?

     

    6.  PART 4.  (61a);(62b). I am assuming "adjustment of status" means when the beneficiary will apply for a U.S. GREEN CARD? I don't understand what I am being asked here, explain to me, please.

     

    Now questions concerning adding of documents to the I130. 

     

    1. Do I add the i864 form when I send the I130 application to the USCIS? or the NVC will ask for it after my petition is accepted and moved onto the NVC?

    2. Do I add to evidence of relationship to the child, ie: pictures, plane tickets, etc. to the I130 form? or do I send these after the NVC requests them?

    3. Do I add plane tickets, financial transactions, etc to my spouse's I130 form filed to the USCIS? or wait until the NVC requests them?

    I ( the USC petitioner) am almost finished on filling out I130 forms for my Filipino stepdaughter and Spouse. Under the section where it states listing your beneficiaries spouse and relatives, I added myself, my stepdaughter, and my son.

     

    my Stepdaughter is born in Philippines ( 4yrs old)

    my Son is born to a U.S. Citizen in the Philippines (1 year 5 months)

     

    This question is about my son. He is my biological son, born to me (u.s. citizen). I listed him as a relative on both I130 forms of my Spouse and stepdaughter. I am wondering if I should go ahead and file his CRBA ( u.s. citizen report of birth abroad) to the U.S embassy in Manila before I even send the I130 forms to USCIS for processing. OR is ok to just wait until the NVC asks about my Son birth?

     

    Also, whats the easiest or convenient way to file the CRBA for my Son, being so I am not in the Philippines? Is it wise to send my documents to the U.S. embassy in Manila, and make an appointment for my Son and Wife to visit the U.S Consul? 

     

    What is a reliable and secure way to send u.s. gov docs to the Philippines from the United States?

  8. Hi there, I am the petitioner ( u.s. citizen) residing in the USA. I am filing two Petitions (I130) IR-1/IR-2

    1. For my Filipina Wife.

    2. For my Filipina stepdaughter (4yrs old) non-biological. ( birth cert NSO shows no father and only maiden name on it)

     

    My questions:

    1.From reading the USCIS page on bringing children to the united states and the I130 instructions pdf (updated ed. until 2018). I am not seeing any requirement that I am to add a 2x2 visa Photo of myself and a photo of my stepchild. Adding a visa 2x2 photo for my spouse IS a requirement on her I130 but nothing that I have read seems to say about adding a visa photo for my daughter and another visa 2x2 photo if myself ( petitioner). COuld someone shed some light on this info, please?

     

    2. For both beneficiaries I file an I130, for my spouse, I also add I130a. Am I supposed to add another I130a onto my stepdaughter's I130 also?

     

    3. What additional documents if any do I need to add to my stepdaughters I130 to provide proof of a relationship with her? Do I add these document copies to each I130 being filed?

     

     I ( petitioner) have the following:

    • Pictures of us together as a family 
    •  Xoom financial transactions being sent to mother (spouse)
    • Facebook chatlogs between myself and mother (spouse)
    • Passport pages stamp of visitation to the Philippines
    • Plane ticket itinerary and plane ticket stubs
    • marriage NSO cert
    • birth certificate of our second child (son, age 1yr 5mths) *currently we are in the process of getting his CRBA done at the U.S. embassy in Manila.

     

    These questions are quite concise sorry lol, but I need to know and talk with someone who currently or recently immigrated their children to the U.S. and knows these answers.   9. Mmmm yeah. lol sorry, I am not understanding how I can add my 4yr old stepdaughter to my Filipino Wife's I130 petition. The way I am reading this is, my stepdaughter is under 21 years old. At (4). if the  beneficiary qualifies under Items 1.C., 1.D., or 1.E above.. ( to me it is saying, if the married or unmarried sons or daughters 21 yrs or older, married sons or daughters at any age, and lastly brothers and sisters at 21yrs or older) I, the petitioner wont be required to file a separate I130 petition for my spouse and children under 21yrs of age. But my stepdaughter is under 21years old and unmarried, she qualifies at 1B. She isn't under 1C, 1D, or 1E. understand now how I am interpreting the context of this?

     

    Ok, so could you please explain what you are interpreting in this context so that I can understand why you believe I, ( the petitioner) can add my child (4yrs old) as a beneficiary on my Wife's I130.

  10. Hi there, lol sorry if I am asking silly questions, I am truly grateful for you all helping me out here answering my questions. But before I file this Petition, I need to know for sure I am filing the correct petition. 

     

    Hank, you mentioned to me I can file One petition for my Wife and add my stepdaughter ( 4yrs old) as a  derivative beneficiary, Correct?

    So the way I am reading this is, my stepdaughter qualifies only under 1B. As you read further down the I130 instructions PDF, it states:

    At (4) it states if the beneficiary qualifies under items 1C. 1D or 1D. But my stepdaughter is a child (4yrs). So does this mean I need to file a separate petition for her or not? explain plz. (This I130inst. PDF is the latest edition)

  11. Ok, so let me get this clear. I don't need to send financial statements of co-mingling of finances attached to my Wife's I130 and daughter's I130? And I don't need to file a second I130 for my stepdaughter? just add her on (I130.  Part 4 .. starting on page 6 (25a) ?? 

     

    I am confused because the USCIS page states to file a separate I130 form for EACH relative. It goes on to say...

     

    "You must file a separate Form I-130 for each eligible relative unless he or she can be considered a derivative beneficiary. See the form instructions for more information."

     

    So my stepdaughter is a derivative beneficiary??

  12. Ok. great. thank you all for answering all this in detail. What other evidence I can use to send for the petitions of my stepdaughter, proof of relationship and marital union with my Wife? I have only Xoom transactions, photos of us together and FB chat logs, plane ticket stubs, can I send these as proof attached to both my Wife's I130 and daughter's I130?

     

    For the I864. this is great news, so I then qualify if my current year gross income meets the guidelines. When and how do I turn in this financial information, and what do I need to present to them for income? ie: employment letter? I have pay stubs for this 2017 which is the current year I intend to file the petition.

  13. Come on man, I am aware the NBI isn't needed until the interview, u didn't even answer my question, I stated WHAT NBI is needed and WHAT must it say on the document? There are threads saying the doc must be GREEN FORM, also NO CRIMINAL RECORD isn't acceptable for the NVC interview, so what should the document say on it??

     

    Please do not send financial records? don't you have to prove you are co-mingling finances?? come on man, explain a little thoroughly on what you meant by that, cause I know they want proof of our finances together. 

     

    Yes on what with the I864?? elaborate more, please.

     

  14. Hello, I am petitioning for my Filipina Wife and Stepchild daugther (4yrs old). I have few questions concerning the assembliage and the correct documents needed to file IR-1/IR-2 visas.

     

    1. Assembling the I-130 Package checklist provided in the guide, is this up to date and in the order of how I am to assemble my document copies to be mailed and filed?

     

    2. My Wife's NBI. What NBI document is acceptable, I have read the document must be "green" bearing the title on it: NO CRIMINAL RECORD. if not, what must it read on this document to be accepted by U.S. NVC?

     

    3. My Wife registered her firstborn daughter's birth certificate kinda late and no Biological Father or marriage on the document, my Wife has her Baptismal certificate also with no parent of the Father, due to the child being born illegitimate. I am her Stepfather. Our daughter has her mothers maiden name on the birth certificate. Will this affect the evidence of proof in the relationship on me the Petitioner and stepfather to this child or the child's mother? If so, what must we obtain to further prove the child-parent relationship of Stepfather to daughter and/or mother to daughter? Perhaps show proof of shot records or baptismal cert, pictures of the mother with child and Stepfather?

     

    4. I have viewed and read the HHS Poverty Guideline for I864 Affidavit of Support. My income from my w-2 shows three years of a gross income of 24,000 - 28,000usd. the guide pdf for 2017 says the petitioner (sponsor)  must meet the requirement of support for three beneficiaries at 25,000 (above the poverty rate of 125%). My question is, Are they saying that the 125% must be higher than 25,000? ( I've attached the 2017 poverty guideline.jpeg.,) meaning 1.25 X (25,525)= 31,906.25, this is the 125% above the poverty line for my gross income or not? Confused. For the last three years, I've made 24,000-28,000 showing on my w-2 (gross income).

     

    5. Could someone present to me what an I130 cover letter sample should be written like? and a contents table?

     

    6 My wife and I have over four years of Facebook chat logs, does somebody know of a more convenient way to print and show these chat logs as proof of our bonified marriage?

     

    7. I (the Petitioner) use XOOM as a way to send income to my Wife in the Philippines, we have transactions spanning back to 2013. Would these transactions if printed be a good evidence of our co-mingling of spousal support? Other than these transactions, we have only ATM receipts. What other proof could we provide of our relationship ?

     

    8. Lastly, could someone give me good assembly instructions for mailing this I130 to the USCIS? (organization, fasteners, folders needed etc)

  15. We have two wonderful children, a 4-year-old daughter, whom was born out of wedlock and not from me, I am her step-father. We have also a 1-year-old boy, I am his biological father. We have the following docs gathered: nso birth cert for both children, nbi, passports, CFO seminar cert, nso birth cert for Wife, nso marriage cert, and misc copies of my plane itenaries, money transfers,  Facebook conversations and lastly pictures of both children with me in their life. I have the following questions to move forward without any unknowns. 1. My daughter, I am not related nor her biological father, just her stepfather, the biological father isn't involved nor actively in her life. her nso birth cert shows the last name of her mother's maiden name, not mine, will this be a problem during visa processing? NSO docs, I've heard from the grapevine the docs must be "long form". How do you determine if your NSO docs are as such? 2. CFO seminar completed in Cebu, we have the certificate, can we obtain the sticker at Manila, where and how?  Are there any other seminars needed to be attended for my Wife to immigrate to the U.S? 3. Visa immigration application form. I printed the I-130 and its showing at the top right-hand corner " expires 12-31-2015" is this nonconclusive or do I need to get an updated form, if so where and how? I printed this form from this site.
