  3. As of December 9,2014, my wife got approved from her interview!! I just woke up from a nap after not going to sleep from my graveyard shift and waiting till my wife get to her interview until she gets done (almost 24hours). After all the waiting, mailing this, paying this and that, making this and that, sending this, sending that, our prayers, sacrifices and patience gave fruit! We're so blessed and thankful for all the help I got and guidance from this website! I'm not that active in this forum but surely my prayers are with y'all everyday. Surely, a lot of relief is off from our relationship with this long distance is about to come to an end. Thank you s much guys! I know that God made all thing possible! Even a few minutes of you time every single day is enough for Him. God bless y'all! Thank you! I will try my best to help our co-VJ members if anybody has questions regarding our visa journey.

  4. Hello guys. Just to update our case. Been working a lot lately just to save up for my wife's arrival. My wife just got done with her medical 11/17-18/14. She passed the medical but boy! it was so nerve racking with all these stories my wife is telling me about sputum test delay of some of our friends here(if anybody here, I'm sorry) but glad we got that step done! 2 more step away! Salute to my wife going through that long wait process and having not enough sleep due to traveling and thinking about what will be the results. Just waiting for her interview day! Thank you for all the prayers and we are always praying for others too! Congrats to the people who passed their interviews and have their visas approved and in hand! Y'all deserve it for your patience!

I do not have every bit of knowledge to help you guys on each cases but me and my wife's prayers are with you guys for every step of your journey with this process to be with your loved ones! I'll be around here and y'all can message me if you have a question (if any and will try to answer if i can). Prayers and patience go a long way. Hoping to be with my wife soon! Now to the embassy(medical, interview stage)! Thank you so much guys!!!

  6. I don't think you have to worry about that...And, as far as what USCIS sees, I'm sure that they'll understand. You can, if you like, provide a copy of the W4 showing the instruction to check the single box. Frankly, I ignored it and checked married. At any rate...your income is for 2014. I'm really not sure how you'll proceed with this...somehow, you have to explain why you didn't file taxes for 2013. I recall that you mentioned that your parents claimed you on their taxes - something to that effect...that you were a student. Hopefully, USCIS/NVC won't ask for a co-sponsor based on your present income. You might want to talk to an immigration attorney - though, I would rarely suggest that - but, in this matter, you might to get better info...also, there are forums for filling out the I-864 here on VJ...check it out.

    Good Luck!!

By the way, we just got an interview appointment today for 7/25!!!

Yeah I just got worried about it but it's the how you filed your taxes is what can be red flagged. So I'll push through all the stuff I have right now and demonstrate to them by the letter I'll be writing. Hopefully, they will just see what my employer letter has and prove it by way of current pay stubs.

    Wow! That's awesome! Congrats!!!! Goodluck!

  7. I wish you the very best of luck! Feel free to be in touch in the future. There are many ways to make things work. From what you mentioned, it seemed as though you're being put in a bind. Things like that I don't get along with. I do understand that there are differences in culture. Yet, I get the sense that those who are supposed to be close to you and, those who should be supportive of you and yours, are not as supportive as you would like them to be. That could be their problem. Not sure. Regardless, you have to do whatever it takes to be with your loved one...as long as you truly love her. All else will fall to the wayside. As long as you have pay stubs showing that you earn above the so-called poverty line...then, you should be fine. Best of luck to you!!!

Thank you so much! I know. It's really hard that it goes like that to some people. even with your own family.

Quick question. In pay stubs, when I filled out my w4 forms there is one box there about my personal info that if you're married but your spouse is a non-resident alien, please check single. So i did that and now that appears to my pay stubs that my marital status is single and i'm claiming nobody currently. Will that be a conflict?

  8. Dude...you have to do what you have to do. If you don't trust anyone who could be a co-sponsor...or think that they will make you beholding...then don't both with them --- even if they're family members. If it's just an imagined sense of things on your behalf...get over it. Anything can be overcome...it's a matter of how you deal with it. If you think that your family will hold you to some ridiculous standard...then, as you said, go with those with whom you can trust. Otherwise...use your current assets...talk to an immigration attorney...make sure that he/she knows what they're talking about...then figure out how to proceed. No need to put yourself at the mercy of others. If that's how it is...tell them to kiss your ###!!!! Who needs them.

You sir have the right kind of mind. Thank you for those words! I will do my research. A lot of research to make sure everything will be alright! God have mercy and He knows all my enduring. Thanks a bunch Ed and Gina! I'll proceed to stuff i have and do what it takes to demonstrate to them that I can support my intending immigrant. My beautiful wife!

  9. I did and i.m still reading into it more every single day. And searching for people who posted here how they did it when they had a similar situation as mine.

Ok. No income. Student. And, parents claimed you as dependent. Currently, you're earning an income. Most certainly, you will send in current pay stubs with your I-864 along with a letter of employment from your employer. Hopefully, your present income meets the guidelines for minumum income. Roughly, over $18K/yr. I think that there are others here who might be able to better address the tax filing while a student issue better than I can. You might want to consult with an immigration attorney (I usually don't make that recommendation) - just make sure that they understand that you are simply asking for a consultion regarding your affidavit of support. Most attorney's want to handle your complete case. Don't waste your time or money on that!!! Keep calling around and, eventually, you'll find one who will agree to that kind of consultation...for about $75 - $125.

Thank you! I'll try to do these and do more and more research.

If you had no income at all last year, just show 2010-2012 tax returns. Because we are not required to file tax returns for 2013 until April 15th 2014. In some cases, people get an extension to file even later. And tax transcripts are not available immediately upon filing and take 8 to 10 weeks to obtain.

Also, you may want to look at any assets you can demonstrate to make up for the last year's income. Worst case scenario, just get your parents to do the co-sponsorship.

I have all the tax papers and copy of the year when I got claimed. I'll do research on that assets idea. I'm trying to avoid as much as that to do a co-sponsorship to avoid debt of gratitude from other people. Cuz it's hard when worse case comes and they bring that up as reason for bad stuff. But I do know some people that I can trust for that thing.

  10. Did you file 2013 tax returns? You have to submit either 1 year tax return or 3 years tax returns(you can include 2011 and 2013 to show good income history). If you have not already filed 2013 tax return, make sure you include all income and not just income from job.All of the income together should be over the poverty level and not just income through a job so try that angle.

Also, you can include current pay stubs to show you are earning well above the poverty level.

No, I did not. I filed 2011 and 2012 with my parents that time. I got claimed the year of 2013. Yeah, I will provide all current pay stubs to show that and a letter from my employer showing figures how much is/will be my current annual income.

  11. If you earned any income last year, you must file taxes. Even if you didn't - you could be entitled to a refund!!! You do need to show proof of income. Any income. Letters from an employer and a bank are required docs unless you work for yourself. Even so, you must file taxes and provide evidence of your income and ability to support.

Unless you're independently wealthy...and there are forms for that...you must provide proof of income and meet the minimum level. Otherwise, you will need a co-sponsor...and they will have to provide proof of income.

If you have no income, it is unlikely that, even with a co-sponsor, that your affidavit of support will be approved. You need to do a little more research on the subject.

A little more info as to how you can prove that you can provide support might be helpful to answer your question more concisely.

I did not earn any income for 2013. I was a full time student and also graduated last year. I got claimed by my parents for tax credit purposes. I can use that as a document why I did not file tax for 2013? I can also ask my school to write a letter about me enrolling and graduating from that school and the timeline of it. Currently, I have income and I'm just so blessed from the company I worked at and gave me a spot even for a new grad. Thank you for your reply.

  12. Probably a lot have asked this kind of question already before but I want to know what you guys did. The situation is, I didn't have income last year due to school but currently working now and I'm well above the minimum poverty requirement for a petitioner to support an intending immigrant if you ask the my current annual income. I did file taxes for 2011 and 2012. Did any of you guys used letters, documents or affidavits to prove you can support the intending immigrant? reasons why you did not file taxes the previous year. Just need insights from you guys and if you were in this kind of situation and luckily got approved by NVC and consular offices of each his/her own country. Thank you. Want to communicate with you guys here in the forum cuz it's really such a nice community and I know we share all the same journey. Thank you! Help is really much appreciated!

  13. 1. I put Single for mine because it does say spouse in a nonresident alien and NVC processed my case with no problem.

    2. I just asked my insurance here at work about that. Each insurance carrier will have different rules, but they told me that once he is physically here in the states all I have to do is send a copy of his Visa to show he just got here so they can cover him. And this shouldn't have a negative impact because NVC shouldn't expect you to be paying extra for a person who doesn't even live with you yet.

    3. Get return transcripts for 2013, 2012, and 2011. There should be no conflict.

Thank you for the reply. So, it's okay for me to put single in marital status for the health insurance application for now? Yes, I will be doing that but I will be using my current income to prove I'm in a good standing @ work and that I can support her because the past few years do not meet the requirements due to schooling situation. The tax info in my pay stubs stating I'm claiming as single will not make any issues?

  14. Hello guys! I made a thread about this but i think it's better to post it here in the NVC thread.

    Here is the issue:

I'm having some trouble understanding and really want to go over the documents and information I have before NVC processing.

I was married back in December 2013 and went back here in the US. Applied for a job and got hired January 2014. When I applied there was this form W4 and about claim and taxes. One question in there about your civil status in line 3 of first page, there is a note stating "If married, but legally separated, or spouse is a nonresident alien, check the “Single” box." and so I did check that. Will that be a conflict to the NVC processing? I was claimed in tax of 2013.

2nd: I'm applying for a health insurance through coveredCA health insurance. The civil status question. I don't want any conflict between this visa application for my wife in connection with AOS. When I talked to an operator. He's asking me if my marriage is already recognized by the state of California? when I told him that my wife is still a nonresident alien but a petition filed for her so I may file for a joint tax if she comes here before 2014 tax season or if not (file married but separate tax file for 2014) If the state of California does not recognized the marriage yet then i should put "single". He is talking about current situation.

3rd:I'll be using my current income for the AOS. Employment letter, Pay stubs, etc. And in my pay stubs it is written there that in my tax info is claiming single due to that line I checked. Will that be a conflict?

    Thanks you so much!
