  1. If your brother enters with Be and change to F 1 here. It's called "change of status." When he leaves the U.S. to visit anyone outside the U.S. He will need to go to a local embassy to obtain a new F1 visa with his existing I 20. And there is no guarantee that they will gain his visa due to his intention to change his status for the first time. If he doesn't plan to travel or visit families/friends at all during his academic year under AOS to student, then he would be ok. But again there is no guarantee that USCIS will approve it either.

    I have friends who adjust from J1 to F1 visiting her family back home because of the death in her family. She got denied a visa and couldn't finish the last 4 months of her study. It was totally a shame. Another friends adjusted in the U.S., they got denied as well. Do not know why. I guess the length of time between AOS and the beginning of the semester was a big gap. Anuway, I highly recommend your brother to get a student visa from home. He can come to the U.S as a tourist first. Go talk to the prospective college he want to attend. And then return home to obtain F1 visa.

    I hope it works for you. USCIS does not read their own info on the website. My wife called in and he told her that it is 75 days tomorrow, but my wife emphasized it is 76 days today because she counted it.

    Note that G-1145 is only sending a text or email for NOA-1(receipt) and you will never receive any text/email after that. You need to sign up an account in USCIS to receive text/mail after NOA-1. Also, you have to keep in the mind that USCIS does not update status often. The status for EAD just went straight to card/production with a message " We mailed your card today" without approval notice.

    Yes, I got the confirmation no. Hopefully, it will alert someone to look at my case agaon. I used an online day counting thing. And it said 76 days today. The guy in the phone tried to count April 9th to June 9th is 2 months. So I interrupted him and said it was 76 days. So can I submit an inquiry? So he said yes.

    I also registered on USCIS alert for my case. It kept me worry every time when I saw no movement when I checked. Hopefully, this inquiry works.

    For those who want to call, don't stop if the first person refuse to help. Keep calling until you get help you deserve.

  3. If your I-765 is pending more than 75 days, then you can call USCIS to submit inquiry. My wife called in and got approved the next day. The only thing is that you have to make sure your application pending more than 75 days and you need to tell them that you can submit inquiry based on USCIS's website info at the bottom page of Processing Times (you can read at https://egov.uscis.gov/cris/processTimesDisplayInit.do;jsessionid=bacwfEYaIfEWQhcqMrpBu ). Otherwise, they will reject your inquiry because it is within 90 days timeframe.

    My wife's I-485 is still at Initial Review more than 90 days.

    I decided to call again after first try early this morning and fail (whoever answered my first called was so ignorant. And sighed many times saying that "it is still in normal processing time,")

    So I just hang up with USCIS making an inquiry for my EAD case. I made sure I know how long since I filed and told him that I can make an inquiry after 75 days. I spoke to him very nicely. Thanks for the tip.

  4. I got my F 1 with about $50,000 bank statement of my parents and some annual income that showed they would support me through my whole study program. I tried to get a scholarship but wit me having a master's degree. All of the scholarship denied because of my huger education (I think it applies only community college.) my friends did in 4 year institutes (most of the got partial of the tuition). Education is very expensive. My books are more expensive than tuition (so do my purses ;) ) I guess they have limited how many foreign students they can accept annually. If everyone is accepted into U.S college, and just come and work instead of go to school full times (12 credit hours are required in fall and winter). Some people will definitely comment on how aliens steal their job!

  5. We've talked about it and it looks like we're going with paying it off (or at least, most of it off) in cash. We've just gotten our first credit card so hopefully we'll establish some history there, and at least be able to rent an apartment. On Monday I'm calling credit unions around. I'm not keen on the idea of borrowing money but it seems like it's the only way to get a credit history.

    New twist though: car dealer says he can't sell us the car without a license from that specific state. Anyone dealt with this?

    Where are you going to buy a car and your driver license is matter. Different state has different state laws. Like in MI, there is no fault accident. Therefore, you have to be aware of the state law.

    When I first bought my car, I had established about 6 months credit history with all credit cards and charges. I got a loan with higher 9% direct loan from toyota. My second car cost me $26000+ taxes + dealer fee and etc with 6% interest from Ally.

    My suggestion is to wait a bit. Or talk to other loan company/bank. You might get a highest rate but you will need that to build up your credit. It doesn't matter how much you earn monthly/yearly. It is the combination of income, length of credit history, on time/late payment, total of credit lines and etc.

    I would recommend you look on online job search like indeed.com monster.com to see what have offered.

    I have friend who is an engineer USC, he has been unemployed forever. I was offered a job as IT help desk at a top automotive company paying $16/hour. I took the job even though it was lower than education I have gained.

    You can get a job anywhere in the states. You have to figure it out what kind of weather you like to live in first. I live in MI and I love it here but if we have a chance. We will move to a warmer state for sure. Good luck.

    Not necessary true. Good cash receivers can claim taxes as well such as tip earn, etc.

    After 10 years in the U.S., you are the second person who told me "welcome to American."

    Corruption and cheating have been occurring daily everywhere in the world for so many years.

  8. VNese love cash-paid jobs is because they WANT to dodge paying taxes (cheating is in their blood).

    I don't think it applies to everyone. You can't be stereotype or discriminate people like that. Americans, Vietnameses, Laotians, Thais, Mexicans and more... I've seen it all. It depends on individuals. Cash is instant. That is why some prefer it over a paid check.

  9. As a good citizen, you have to follow/respect the laws. Pay your fine. It definitely will show on your license and you can't get away with it. The police officer that pulled you over have your ID in record. Unless you gave him nothing when he pulled you over. My friend's friend refused to pay fee for entering the state park at night. He paid big time when he wanted to naturalize himself. USCIS denied his application and said he failed to obey the state laws.

    Pay for it. Speeding ticket in your record but not for that long unless it's repeatedly done.

  10. my status hasn't changed on the website, haven't received any notifications since my rfe but my attorney called today to let me know my interview has been arranged for July 15th yesssssss, huge relief!

    Did you lawyer talk to tier 1 or 2? My husband called for me. They didn't want to talk to him. I called. They talked to me, telling that to wait for about a months since it is still in the time frame.

    Did you set USCIS case status online to send you an update when status is changed?

  11. Yes I have been living in MI since 2005. Warren is not far from where I live. I used to date someone who live in Warren for a couple of year. So I know Warren quite well.

    I am still in RN program. I attend OCC (one of the largest community colleges in MI and best well known for nursing program.) I can say that it is one of the top hardest nursing schools-- lots of skills trainning, lots of hours required for externship and a lot of skills to deal with faculty! (Nurses eat their youngs! LoL) well, it is hard but it is doable. Healthcare job seems to be high in job market but you have to have a passion to do it. Otherwise, it won't work for anyone.

  12. Well, speaking that my language is not English. So I had to take ESL classes for 2 semesters. Prerequisite classes for nursing about another 2 years (6 full semesters). And I had to maintain 3.8 GPA to be able to get in a nursing school here in MI. I finished my PN classes in a year and sat for my board exam and passed on the first try. So it was about 4 years from start to finish.

  13. A) as long as your husband filed tax return forms last 3 years. I think it should be fine. Because you guys will need that 3 years to show them. Then your current situation where he just got a job. He will need to show an employment letter, pay stubs and possibly your own word explanation letter. I don't think it would hurt. I am just not sure as I have never read throughly about income above poverty guide line which should be certain of months or years.

    B) as I said your income is not needed. You are not a US citizen. You can't sponsor yourself. And there is no where in the form to put your incomes. They just want to know the sponsor's income.

    I doubt someone would do it unless they are good friends. There are so many rules, regulations and restrictions to bring a dog/cat here. It can be done. It is just too complicated. My friends actually brought a cat with them. You are talking about at least $1000 expenses.
