  1. In 2014 my fiancé was approved for a k1 visa.

    long story. But I did not marry her and she returned to Vietnam within the 90days. It was heart breaking. My mother was terminally ill and I was in Mexico caring for her. It was my fault I did not marry her.

    We have talked nearly every day since she returned to Vietnam.

    Now my father is terminally ill and I lost my job to care for him.

    my questions are...

    what are our chances if we re apply? Also my bank account has been drained from losing my job and caring for my father. Can her U.S. cousin sponsor our financial obligations?

     I have a joint account with my father that exceeds $50,000 but this is a joint account.

     I feel so guilty and lost because I failed to complete our original visa.

  2. What is the confusion? Is 89 days less than 90?

    Stop overthinking things.

    I read somewhere that if the paperwork is not received by the 90 day deadline, then we would have to start this process all over again.

    Now thanks to all the replies, I understand that I have the full 90 days and that as long as the wedding takes place within the 90 days we are ok.

  3. We finally have our Visa in Hand. It has been a long, lonely year.

    My fiancé will arrive in California March 7th. We want to start all the paperwork we can ASAP, but we also want to spend 2-3 months living together before we marry. We want to make sure the culture shock and the major life changes are best for both of us.

    So as the procedure reads, we have 90 days to marry or she must return to Saigon. How long do we actually have? Some tell me you have to marry soon so that all the paper work is received before the 90 days. What does this mean. How long can we wait before marriage if she enters US on March 7th.

    I will get the marriage license ASAP, and we will start the SS paperwork.

  4. We started our K-1 application in mid June. We got through the first stage without any RFE's (Thank you all at visa journey).

    For step 2 we gathered all info for the packet and Thuy had her Medical and interview in Saigon. During the medical they spotted a black spot on her lung and told her she would need further testing (added 2 or more months to the process).

    They kept the original interview date in October. Her interview was fast. Only 5 or 6 questions and they told her all depends on TB test results. 2 months later. Test was negative. We found out At the beginning of January. Thuy returned to embassy with test results and they took her passport. 1 week later Visa arrives at her front door!

  5. Well things seem to be going faster than expected. We started the application mid June and had our interview October 15th. The interview was easy, 5 questions. We had a complete packet as well.

    The health exam is where our problem begins. During the chest x-ray they noticed a black spot on her lung. They told her she would need to submit 3 sputum samples and then depending on the results she would be granted a visa or 6+ months of medications before re testing.

    Has any one else gone through this? How long do these test usually take? How long after the results will it take to receive visa?

  6. To all of you that have had interviews in HCMC. Did they require the Birth Certificate of the Petitioner?

    I had asked this question earlier but I didn't ask in the Vietnam specific forum.

    I have copies of my Passport, Passport Card, Sentri Pass, and Social Security Card.

    No Birth Record. Im having a delay getting another one because of adoption and name change. I will resubmit the application for a birth record but I do not think it will arrive in time. Her interview is the 27th of October!

  7. update.... just returned from the interview, I was not allowed at the window during the interview. I was asked to take a seat and was never called during the interview. Approved...

    Happy to hear you were approved. Did they require a birth certificate from you?

  8. Hello, we are now gathering all the info for the interview. I had all my papers prepared and I read this.

    " Birth Certificates: Copy and original birth certificates of the petitioner and each person listed on the

    application are required. In case you do not have the petitioner’s birth certificate, the officer will review
    the case and provide guidance at the interview. If you or any children were adopted, you must submit an
    official adoption decree."
    It is under step 3 on this page.
    I lost my birth certificate. When I applied for the 129-f I used a copy of my passport, and all was ok.
    I did not realize I would need to mail an original of my Birth certificate? This was not on the list on the visajourney page. Am i reading this correct?

    We are appling for the K-1 fiance visa. Which is the right category.

    Business, Tourism, and All Others (including B) is my guess?

  10. Hello, we are applying for a k-1 fiance visa. My fiance lives in Vietnam and we recently had our I-129f approved and forwarded to HCMC consulate

    We were asked to fill out form DS-160. We submitted the form online. Now I realize this is a form for a non immigrant visa. Was this the proper form to use? She is coming to the US to marry me and stay, why would they request us to fill out the non immigrant visa form?.

  11. I got an E-mail and a letter from USCIS with the same statement! It took a couple of days after the e-mail to receive the letter. Both Notices dated August 12th

    Then I received a letter from the NVC dated August 25th.

    The letter had our Case #, and USCIS reciept #, as well as our names and location of interview. The NVC letter stated that they are forwarding our I-129 to the embassy in the country of interview. This letter states the consulate will contact her when they are ready to process. It also recommends to go online to ceac.state.gov and complete DS-160 to apply for K visa.

    Here is what the Visa Status reads at ceac.state.gov

  13. I recieved a letter from NVC saying they received our approved I-129. So happy to get this now she is instructed to go to the website ceac.state.gov an complete form DS-160 to apply for a K visa.

    I have a question regarding one of the forms question. It in in the security and background page.

    Security and Background Information

    "Do you have documentation to establish that you have received vaccinations in accordance with the US law?"

    Her answer was No.

    I AM CURRENTLY OBTAINING ALL VACCINATIONS REQUIRED IN ACCORDANCE WITH US LAW. I WILL HAVE PROPER DOCUMENTATION PREPARED FOR MY INTERVIEW.

    Is this answer acceptable. I thought she would do this during her Medical. We want to keep things moving so we need to understand this and continue.

    ​Should we get the vaccination before submitting this form? Or is this something that we do later. She wants to sign and send electronically ASAP.

    Of course we are eager to complete this process and be together. We want to do it right.

  14. We got our NOA 2, and we were approved!

    So excited, now I am getting everything ready for the next stage.

    I had a question, has anybody done their interview in HCMC Vietnam?

    I am considering flying out for the interview to be with my fiancé. But i have heard that i will not be allowed to attend the interview, I was told that I would wait outside while she was interviewed?

    The plane ticket and time off are difficult. I have made three visits this year and it is costly. Let me know if anyone has any experience or suggestions. Thank you.

  15. Hello, I am planning a trip to see my fiancé, while we wait for our K-1 to be approved. We are at the NOA1 phase waiting for the NOA2.

    She lives in Vietnam and I live in the US. We are planning to meet in Indonesia and vacation together for 2 weeks. We have already met before in Vietnam and are simply meeting to spend more time together while we wait this process out.

    She is a little concerned about entering Indonesia, she is not required to have a Visa, but she has heard that due to the history of people from Vietnam going to Indonesia to work that they may question her and stop her at customs.

    My questions are, should she tell customs that she is meeting her fiancé for vacation? Would it help to bring a letter from her employer stating that she is employed full time in Vietnam? Any ideas or experience with this. I will arrive 1 week early so we will not be at the airport together. She does have a round trip ticket.
