. To the OP, as long as your marriage was real there is absolutely nothing to worry about. The two cents being thrown at you on here are all personal opinions that have zero influence on USCIS. The reason why interviews are conducted is to give a chance for the applicant with less to no evidence to prove him/her self with a direct face to face interview with the IO. If the IO is not convinced with the interview, they will review your case and if they are not satisfied they will send you another interview letter for a final decision. It doesn't stop there you can still prove your self in front of an IJ for a final decision. Anddddd while waiting you can also deal with BIA( Board of Immigration Appeals).
By the way, your case would be stronger if a competent lawyer is hired to help you with your case.

Guys on here are so wrong with their replies its just sad. There was a case were two students were living in different states and have absolutely no evidence to show for their ROC. When they filed for it they received a RFE but they still had no evidence to show for so their case was transferred for an interview in which they explained their situation to the IO and the IO was satisfied with their story and they were approved. I am so disappointed with one person who mentioned for the OP to return back to his country

My two cent: get letters/affidavit from family or friends attesting that your marriage was real and that they can show up in person to attest that. A detailed letter explaining your situation, photos, email or text messages exchanged between you and her or anything, I mean anything at your disposal.

Well I am for one am totally confused, it seems that the decision to apply for asylum was a plan all along, no reason for the OP to share with us the reason why.
Having gone through this process so recently, I think this is one of those cases where the possibility of heading to the US anytime soon is as close to zero as you could reasonably get.
I am intrigued as to what the actual situation was, but resigned to the fact that I will never know.

. He said he wanted to consult with a lawyer while he enjoys himself in the USofA for 6 days. That is not an immigrant intent, the CBP guy came up with that lie. Tell me in what immig law did it say you cant consult with a lawyer while visiting USA? He became mentally unfit because he was treated badly by the CBP person.

when the CBP officers were treating you like a criminal, you had never face or seen such an unfair treatment for that reason you were mentally incompetent to face the situation and that is exactly how you stated it to them. Nothing is your fault so dont beat yourself about it. We all have seen worst cases with the CBP, police and everything else going on around the world.

Its not like if she becomes a US citizen there will be a pot of gold waiting for her somewhere. INFACT it would be better if she becomes one to allow your responsibilities under the I864 to be terminated. If you are still married and staying with her she will be approved for her citizenship.

Solutions to your problem
1) Since you haven't seen the IJ yet, you can send a formal letter by mail saying that you want to withdraw your I751 on the basis of your situation.
2)Then re-file a new I751 including your old and new evidence.
3)Its advisable that a lawyer be hired if finance is not a concern.
4)You'll receive a new extension letter and your case will be treated as new with your new evidence.
5) You might be interviewed or get approved depending on your new evidence.
6) If you satisfy the IO s/he might recommend the IJ to approve the case or get your 10year in the mail.

The I864 is a support mechanism contract between you and the US govt. It has nothing to do with the valid or in-validness of a greencard. when its processed, accepted and approved then as long as that person remains in the US you are on the hook. The only way out of it is when that person becomes a US citizen. which can be obtained by 3yrs of marriage or the 5yr rule. The good news is I have never heard of any case of such, so I wont worry about it.
A late filling of I751 in lot of cases is accepted by USCIS. A divorce wont help much.
My two cent will be; work on your marriage if not get a divorce and move on with your life. Marriage in general involves work its not all kumbaya and happy unicorn all the time.

I honestly think you misunderstood immigration. Infidelity in a relationship doesn't mean immigration scam. He is just being a cheater. The solution to your problem is either you try counselling and save your marriage or simply move on with your life. Calling it a marriage scam is baseless.

File an appeal within 30days of the decision or file a new N400 . Make sure you gather all evidence of marriage from his previous marriage like photos or anything that helps in proving the previous marriage was real.

1) Unless USCIS process your application in less than two weeks, filing now is going to do absolutely nothing for you.
2) Complete speculation on your part. Will it add time to some processing times? Almost certainly. 2 - 7 years? 100% guesswork on your part.
People's forms are getting delayed now talk-less of a gazillion of forms that will be sent to them in few months.

If you are thinking of filling any form this will be the right time. If you wait till the new immigration law goes into effect 5 million people will file their form and yours will be delayed anywhere from 2yrs to 7yrs.

Only a judge can terminate his status and also an extension letter is not auto-generated. The guy is still in status, he successfully added one year to his status and by the way the i-864 will never be rolled back just give it up.

You my friend called for his "return." so its only fair to say what you've said is flat-out misleading, dangerous, obnoxious and reflects a fundamental lack of understanding of USCIS policies.
You need to give BACK your moderator licence
