I'm posting to let anyone who may travel outside the US know that we didn't have any real issues leaving and coming back on the ADIT stamp we got with an Infopass appointment just before our trip out of the country.     The only issue upon entry (LAX) was that since we no longer have a physical GC to scan at the immigration kiosk, a secondary review was necessary and took about an hour, during which we were separated (and both very nervous). The first agent looked at it and said, 'Oh, a renewal,' so at least he recognized it. He then (apparently mistakenly) stamped the passport with the normal 'Admitted' stamp. He said a secondary review was needed and called over another agent to walk my husband to the back area and I wasn't allowed to enter with him - I nervously waited in baggage claim. He waited about an hour and they didn't ask any questions, but called him up to the counter and said, 'You're all set,' and gave back his passport and other information. The only strange thing that I wasn't expecting was that next to the ADIT stamp, the 'Admitted' stamp was crossed out and a 'Paroled' stamp was placed. I did a very quick Google search panicking with my understanding of parole in a legal sense, but I guess it's very specific in terms of immigration. If anyone has other info, that'd be great as I haven't done more exhaustive research just yet. I guess this section kind of makes sense from the Wikipedia entry (although he doesn't really meet all of the requirements listed there...):

    Me and my wife(US citizen) are currently preparing the I-864 and I864-A forms for NVC to get our CR1 visa but we are not sure which of the forms I-864A and I-864 we should submit. 

     

    My wife's mom will be our sponsor. Her parents are filing their taxes jointly and they both have the same address as my wife (household members).

     

    We are about to submit the following forms:

    • I-864 for my wife 
    • I-864A for my wife's mom ( household member 1)
    • I-864A for my wife's dad ( household member 2)

     

     Do we also need to submit a I-864 for my wife's mom(and dad?) in addition to her I-864A  or is this correct?

    • Wife - I-864
    • Wife's mom (joint sponsor) - I-864
    • Wife's dad (spouse of joint sponsor / household member) - I-864A

    I was confused as well when I saw folks mentioning both sites...

     

    The DHS site is here: https://myaccount.uscis.dhs.gov/. You will probably need to create a new account (if you haven't already). Note that this is different from the USCIS case status site and associated log-in. A screenshot of that is below where it (confusingly) says 'Welcome to your USCIS account'. Each of the cases is expandable (by clicking the + sign) and shows the current and status and previous statuses.

     

    The USCIS site is here: https://egov.uscis.gov/casestatus/landing.do. You can check it by receipt number or by creating an account. A screenshot of that is below where it says 'My Cases'. Similar to above, each of the cases is expandable and shows the current status and former statuses.

    FYI - DHS is showing the correct status under I-751: "We approved your case..." indicating 5/16/18.

     

    It's the USCIS case status site that is still showing the old statuses...

    Anyway, you can see that right now they are processing the week of December 5th. Every week they process about 15% additional cases compared with the last week, so you have around 5-6% of chances of getting approved when your week starts. 

    My NOA is 12/26... I think these are good guideposts, but at the end of the day there doesn't seem to be much method to the madness that's obviously apparent. The good news is, our month wasn't completely lost and is being looked at! Best of luck to everyone.

    Exactly - and OP mentioned parents (plural), so each will need to file a separate I-864. Continue reading up!

    We're all with you! My timeline actually tracks pretty similarly... sadly, there's not a whole lot that we can do other than use these forums for support. At this point, trying to find patterns is meaningless and a waste of time. It seems like there are so many factors that could have the smallest change on how the applications are processed, and those changes lead down a whole different workflow for completion. 

     

    Keep your head up and be thankful that you're in the US legally, able to work, and able to be with your spouse. The current administration's stance on a variety of issues (including immigration) has only seemed to heighten all of our anxieties... breathe in, breathe out. :-)

    I don't think that's a requirement during any part of this process... have you seen that requested somewhere?

     

    I asked about the US Selective Service System because males arriving in the US before their 26th birthday need to register.

    You really need to go back and read the guides and instructions for I-864. It is a very important part of the application process... 

  11. Welcome to the forums! Firstly, take all of my advice and that of others carefully - none of us (or at least not many) are lawyers and all of our situations are unique and different. I'll take a stab at a few questions, but overall it looks a bit 'messy' from an outside perspective in that it's not clear cut in several places... I would definitely get as much input from here as possible. You said you've spoken to a lawyer - have you considered using one for this process? Many of us do the entire thing ourselves, but if I were in your situation I might reach out for additional help. Anyway...

    Yes, use your address in Japan for your current address but definitely do not put TBD for your intended address. You can change your actual address with USCIS after arriving with a simple online form. I would suggest going with your domiciled address. You can explain that you intend to settle at that location at least temporarily to get things set up and are thinking of moving to Colorado to pursue some opportunity, etc. In your journey to prove or reestablish domicile (which may be a little complicated given the sabbatical you mentioned and depending on how long you've been outside the US and what links you still have...), you'll want as much evidence that you are, well, domiciled in a particular place. In your case, it looks like it'd be the location where you credit card bills go to. There's definitely no issue with your POE corresponding or not to your intended address... USCIS wouldn't know if you were, for example, going to arrive in San Francisco and spend a few days with friends before making your way to your intended address by train, etc. Another idea is that either your parents or your aunt could even create a month-to-month lease (lots of generic versions online) that you could enter sign and which could be submitted as evidence of establishing permanent residence in the US.

    Don't know I can help here other than to say that it does seem 'weird'... Have you been filing taxes from abroad? The I-864 needs your current individual annual income and your total income from the three most recent tax years (note that those values may actually be $0 or $1 if you filed foreign income exclusion on your taxes). Self-employment income would be shown on your tax transcripts, too. It gets messier in that you contract your spouse... (how is it 'official', are you offering her an employment contract from the US following required labor laws, etc... I'm not actually asking, but I imagine these are kind of complicated questions and answers). Basically, USCIS will have access to all your income information and is really looking for transparency and proof that you're above the federal poverty guidelines for your household size and that you're in good standing with the IRS. If I were you, I would include the US assets to make your case - you may need to if your income doesn't meet the requirements. You could also include additional explanations on your domicile explanation letter (that I think you'll definitely need).

    This is going to be a tough one... the whole point of trying to prove domicile in the US and/or show good faith reestablishing of domicile is that you've maintained a legal and financial presence in the US and that you're making active efforts to continue reestablishing domicile there. The address information is so they know where you've been over the last five years. I would suggest an easy-to-read supplemental explanation and table of dates and locations, but others may say differently. I would explain that you and your spouse wanted to travel, but kept your parents address in the US as your permanent address (as you had always done) during that time and visited X country between date to date, then Y country between date to date, etc. I definitely wouldn't put N/A or NONE since it raises flags that you either didn't have an address during a period of time, or that the information they want doesn't apply... make things easier for USCIS to approve with an explanation than leave them to their own devices trying to figure out what N/A means for a list of addresses. Others may have better advice here.

     

    As you can see - it gets complicated quickly and can sadly be dependent on the individual person reviewing your file. Don't go overboard, but more information is better. Good luck!

    I hear you! I've only come back relatively recently since it looks like there has been some movement on I-751s with additional movement to hopefully come soon... I'm happy to carry the torch for the thread in terms of the list. Could you post the most recently updated list and I can start adding to it and modifying as needed? Best of luck in the real world and I'm sure someone will keep the lights on (and be here if you have future questions).

  15. Hey - I posted this on our December 2016 forum...

     

    Hey all - no case updates, sadly. Same old transfer notice and fees waived with both case numbers. I'm posting to let anyone who may travel outside the US know that we didn't have any real issues leaving and coming back on the ADIT stamp we got with an Infopass appointment just before our trip out of the country. The airline seemed to have no idea what they were doing or what the stamp was, but accepted it anyway.

     

    The only issue upon entry (LAX) was that since we no longer have a physical GC to scan at the immigration kiosk, a secondary review was necessary and took about an hour, during which we were separated (and both very nervous). At the kiosk, instead of the GC it asked for, we tried my husband's passport that was within 6 months of expiring - also not really an issue but probably not the best thing. In the end, everything was fine. I had all the necessary backup paperwork showing what we've submitted so far and also the carrier information guide from CBP that specifically shows an example of the ADIT stamp (page 39) just in case. The first agent looked at it and said, 'Oh, a renewal,' so at least he recognized it. He then (apparently mistakenly) stamped the passport with the normal 'Admitted' stamp. He said a secondary review was needed and called over another agent to walk my husband to the back area and I wasn't allowed to enter with him - I nervously waited in baggage claim. He waited about an hour and they didn't ask any questions, but called him up to the counter and said, 'You're all set,' and gave back his passport and other information. The only strange thing that I wasn't expecting was that next to the ADIT stamp, the 'Admitted' stamp was crossed out and a 'Paroled' stamp was placed. I did a very quick Google search panicking with my understanding of parole in a legal sense, but I guess it's very specific in terms of immigration. If anyone has other info, that'd be great as I haven't done more exhaustive research just yet. I guess this section kind of makes sense from the Wikipedia entry (although he doesn't really meet all of the requirements listed there...):

I'm in California so that seems pretty weird to me. Does anyone know if that's a mistake or are they sending overflowing cases to other states? I'm in San Diego, and I know that the backlog here is pretty significant...

     

    Exciting! Congrats... I think the Nebraska Service Center transfer is normal. My understanding is that USCIS is trying to speed things up by spreading some of the work to other service centers. Others may have better information. Does the letter indicate any other next steps? (Interview, request for more information, etc.)

     

    (We're up in LA - also likely with a big backlog - and here's hoping we all see movement soon!)
