  1. Subject: Action Request from U.S. Embassy , Consular Section -

EMBASSY OF THE UNITED STATES OF AMERICA

    Dear Sir/Madam,

A consular officer has reviewed this immigrant visa case and has determined the following documents are required:

    • Form I-864A, Contract Between Sponsor and Household Member

Please upload the requested documents at https://ceac.state.gov/IV/Login.aspxYou are not required to email these documents to our office.

That is the email that we received.

What does the email say exactly? It wouldn’t just say upload i864A.

If you yourself think you don’t meet the poverty guidelines, then that could be the reason. You need a joint sponsor or a household member. If you got nothing, then they can’t issue the visa. What was the annual income you claimed in 864EZ?

That is my three years tax

May be upload i864. “A” could have been a typo unless you are using joint sponsor who filed joint tax return.

I already uploaded I-864EZ for myself, and I guess I do not meet the poverty line and that is why they want me to fill-out I864A by a house member and I don't have any house member.

  4. I am assuming that my income was not enough to meet the poverty line.  That is why the counselor  asked me to fill-out I-864A.  But I have nobody to fill out I-864A for me.  I have minor kid from previous marriage and she doe not work and shew is only 14 years old.  So I don't know what to do.  And the counselor does not have any contact information to explain to them that I have nobody to fill out I-864A for me and the counselor keep saying just upload I-864A.  I am stuck and don't know what do to and I have no friend who can help me.   Anybody been in this situation or does anybody know any other way to deal with this issue?  Please help.

  5. Hello All,

I have  question concerning I-864A.   My wife had an interview and the counselor took her passport, but after the interview a week later.  I have received an email and asked to upload I-864A.  Before the interview, I have uploaded I-864EZ and other documents.   But now they are asking me to fill out and upload I-864A.  But the problem is I have no relative or house member to fill out I-854A for me.   I am by myself and like I said, I have no relative or friend to help me.  Has anyone else been in my situation or is there any other way to resolve this issue?   Plus, there is no email address is given so I can  tell them that I have no relative or household member to fill out I-864A for me.   Please let know and thanks for helping.

  6. Sorry guys one more question

on part 5.  question 1, should I answer yes.... or no.   I have sponsored my mother on 2010 as well.  So when it says that have I previously filed a petition for this or beneficiary or any other alien?  I am thinking I should say yes.... because I have sponsored my mom on 2010.  is that correct?

    Please let me know.

  7. Hello All,

I am filling form I-130 for my wife who is abroad.  I am stuck on Part 4 starting question 25a.  Beneficiary will be my wife who is outside of the US.  So I am filling the form and on Part 4.  when it says "Information About Beneficiary's family."   under it says, "Provide information about the beneficiary's spouse and children.

I believe the beneficiary spouse would be me ( is that correct on person 1?)  and I am divorced and have 4 kids.  Would I list my kids for starting on person 2 up to person 5. and fill son or daughter or my new wife (beneficiary) should say step son or daughter.   image.thumb.png.5eada378a6ea51e95e7a220e4bc33740.png

    Please help.

  8. Hello All,

I have a couple of questions that kind of delaying my in-law case.

My father-in-law has filed (I-130) for his wife and his children ( his wife & plus 5 children). under one case number (NVC) has his wife plus 3 of the children.... and the two remaining children have their own cases ( NVC messed up because they all should have been under one case number).

Anyway, father-in-law filed Affidavit of support i-864 Part 2 - listed the principle immigrant (wife) and Part 3 have listed 3 of his children (which are under the same case number as his wife). A total of 4 person including his wife and his 3 children.

    1- Now kind of confused about PART 5 - i-864 - "Sponsor's Household Size."

Does he need to put a "1" on PART 5 question 3 - which says, "if you are currently married enter, "1" for your spouse. Albeit he already listed his wife in Part 2 as principle immigrant.

2- Question 2 - for his other two children which they have their own cases... does he need to list his 3 kids plus his wife as dependent family member also in PART 5 added them up in PART5?

  9. As the petitioner, your FIL needs to file his own I-864 no matter what.

You as the Joint Sponsor would file your own I-864.

I did not file for anything... My father-in-law did himself. But I know for fact that his income won't be sufficient to cover his kids and his wife. So I was thinking to file Affidavit of support. My questions was, do I need to do it myself only or include him as well.

    Thanks.

  10. i called Nvc, they received the case, but they coudnt tell when they can contact me.

should i contact them everyday!! how much longer do i have to wait untill they will assign a case#.

    thank you

Don't call or do anything. They will let you know that. After NVC received our case, it took 20 to a month to let us know. We provided email and they let us know via email which is very fast. NVC is fast and so far the process for us been very fast. from the time that NVC received our case till filling affidavit of support, it took about 2 months and a couple of days in total. So be patient.

  11. Hello All,

My father-in-law has applied for his wife and children by using i-130 for each (his wife and each of his children). Now the NVC has asked him to send affidavit of support and I believe is i-864, but his income is like $15,000 which is way below poverty line for six individual (his wife and his kids).

Now, i am thinking to help and fie the affidavit of support by using my wage and asset which is a little above the poverty line. Now my questions is can I file affidavit of support instead of my father-in-law or do we both need to file a joint affidavit of support?

    Please let me know.

again my father-in-law incomes not sufficient to .... as son-in-law do i need to file the affidavit of support and would NVC accept that if I file the affidavit of support?

By the way, father-in-law is a green-card holder, not citizen.

    appreciate the help.

  12. The reason that we made the mistake was that the calendar that Middle Eastern countries use is different what we use in the state. For example, Iran, Afghansitan, Tajkistan....etc, Current year is 1390, but here we have 2011. So when the guy who convert the date of birth for my date, didn't do right and we filled out all the necessary form by using his translation. :( But now I found a site which convert middle east calender to here and I noticed that we made a mistake. So that is why.

Anyway, I am going to use whatever we I used for G-325A for the I-129F and keep it hashhhhhhhhhhhhhhhh and hope everything will be okay. So now, what do I need to fill out i-130 for my dad to come here?

    Must have:

Dad birht Certificate (which will show original date)

    Marriage Certificate (mom and dad)

    Anything else?

  13. Hello All,

I have a questions about i-130 form that I will submit for my dad. My questions is when I came to the US (via 1-129 fiance visa) and later became a US citizen, I wrote my dad's date of birth wrong on all of my forms. for example, my dad's date of birth on my all my forms and USCIS forms that i have filled 5 years ago, is 1956, but his real date of birth is 1964.

but now I am applying for my dad and I noticed my mistake that when my husband filled out the 1-29 and other necessary paper work, he had my dad date of birth wrong. But now, I want to fix my dad date of birth before submiting i-130 for him. I am not sure how to proceed, can someone help and let me know how long would it take to change date of birth for my dad? Appreciate you guys help.

  14. YES - you must list their children on page 2 , section C. #17 on both forms

YES YOU CAN - but it is quicker and easier for your mother OR father to do this when they get here.

    Appreciate you guys help.

    Thanks,

    F

Can't sisters and brothers come with parents at the same time? If parents come in here first, no one will be there to take care of brothers and sisters for the simple fact that I have sisters and brothers who are like 4, 8, 11 and 16.

Another question. If one parent comes in here via I-130, how, when that one parent can apply for children? Immediately or wait till the that one parent is a US citizen?

    Thanks,

    F

  15. Hello,

I have similar questions. I am trying to bring my parents here in the US far east (central Asia).

1- Should I apply for my parents, my sisters and brothers who are under 21 years old and using the same form (I-130) for all of them (two forms one for each parent)?

2- Should I list my brothers and sisters on both, father and mother I-130 forms?

Another question. My brother is 16 years old, can I apply ONLY for him and bring him here in the US by filling form I-130?

    Appreciate you guys help.

    Thanks,

    F
