  1. Didnt see a Houston-Specific thread til today, so sorry for the late reply.  Got excited when I got the update from USCIS last week, but then realized "in line to be interviewed" does NOT equal "interview booked, the letter is in the mail". WOMP WOMP/

     

    At first I thought this was all due to post-Harvey SNAFUs but holy heck this moves at snail's pace. I got the GC 72 days after filing AOS, and the ROC came pretty quickly too, but man this N400 takes awhile. So much for being able to vote in the midterms!

     

    To all N-400 applicants in Houston and who filed with Houston FO, Kindly build our own time line only specific to Houston FO.

  2. Finally got the "we started the interview scheduling process" notification. Houston field office so still likely EoY until any further notice. No idea how it took THIS long, but maybe my paper filing skills weren't as good this year (we AOS'd in 72 days from start to finish to get the GC!)

  3. Has anyone traveled overseas on that "extension letter" they sent after receiving your removal of conditions package?

    Yes. Went back to Canada in March after GC had expired with 1-year extension letter due to being in ROC process. The only pain was that all airport checkins are basically manual (i.e. with an agent) bc your actual GC is expired (or at least mine was). We even have electronic passport checks at US customs and immigration (we clear customs and immigration in Canada) and even in that step I had to speak to a CBP officer directly. It all went smoothly, but YMMV I suppose???

  5. So are you saying that I SHOULD re-submit the older evidence? Should I make clear which evidence is a repeat and which is new?

    I think he's saying you should enter via the Syrian refugee program...he's also wrong with his garbage about lack of background checks, but I digress. Must be the delicious Wisconsin Leinenkuegels that got to him already.

    In short, the documents need to show a bonafide marriage. I'm not sure what previous documentation already submitted will help with that, unless it's a continuation i.e. joint bank accounts from years BEFORE you went through the CR1 process AND up to and including the ROC filing date.

    Bottom line is if the documentation will help build a case of commingled assets throughout the marriage, there's no reason that info prior to the green card issue date wont help, provided you back it up with a continuation of data.

  7. Hi everyone, I need some advice on the evidence to submit and here's the list I am going to submit:

    1. Joint tax returns 2013 -2014

    2. Birth Certificate of our daughter

    3. Joint health insurance ( I am on his work plan)

    4. Beneficiary to his life insurance

    5. Joint credit card account ( he is primary account holder and I am secondary)

    6. Joint Car insurance

    7. Joint phone bill account

    Questions:

    1. I am a stay-home mom so I don't pay for his mortgage for the houses and we don't have a joint savings account ( and we don't need cause he pays off everything anyway) . Is that going to be an issue?

    2. Are pictures and affidavit letter really necessary?

    3. Any advice on the evidence?

    My card is going to expire the end of January and hopefully i will have enough time to finish it up...nothing is guaranteed with a 1-year old haha

    A few comments to your list:

    1. Given you havent filed yet, dont just pull the tax returns. You can get actual receipts from the IRS to show "this is what was actually filed". I forget what they're called (transcripts?) but they take a week to arrive and would be worth your time in getting them. I presume you filed as "Married Filing Jointly"?
    2. It's worth to print off EVERY MONTH for the credit card statements throughout the entire marriage. a "one year summary" wont cut it, nor will scattered statements i.e. first and last. Worth adding all of them to show that you are buying groceries from HEB together, and that you're putting expenses on a joint card regularly.
    3. No, a beneficiary designation is not the same as a will, but for goodness sakes it's a start, particularly if the policy means you get some serious cheddah if he kicks it on the job.
    4. "Mortgage for the HOUSES"??? Y'all got a bunch of houses and you dont have your name on ANY of them?
    5. In Texas we added Property Tax statements each year given that both of our names are on the deed, but if you're not on the deed I'm guessing this doesnt help.
    6. My card expires early Feb and I got my application in a few weeks ago, so better get on that. It's just a hassle to get any sort of extension.
    7. Have you ever worked before with a 401k or RRSP? You can designate that to him so it doesnt look like it's a one-way street.
    8. Consider adding photocopies of drivers licenses to show the same shared address as well as the car insurance forms
    9. We also added photos throughout our marriage (annotated with location, date, and who was in them) as we travelled a lot up until recently.

    We've got a 2 month-old. Let me give you some unsolicited advice: Sooner than later, make wills and trusts. You have dependents now, so it's important to spell-out where you want your 1-year old to go in case the 2 of you kick it together.

  8. 1. There's an expiry date on her green card. You've actually seen it, right? You can even google I-751 filing date to find out the earliest you can file!

    2. You can file UP TO 90 days before it expires, along with a LOT of evidence to show that it is a bonafide marriage

    3. Filing fees total $590 (including biometrics)

    To be clear, with a green card she is already an LPR (Legal Permanent Resident). She is filing to Remove CONDITIONS on her residency aka "prove again that your marriage isnt a sham"

  9. I sort-of had to deal with this. I hadnt updated my drivers license since getting my green-card so it had "LIMITED TERM" written on it. Ditto SSN with "Not valid without DHS Authorization". All of a sudden it's Memorial weekend and we are buying a new car, and lo-n-behold their finance manager is baulking, quite rightly, at my potentially bailing during the period of the loan given that my DL expired in a month or so.

    Lesson Learned: Anything that changes when you get your GC with respect to "removing conditions"? GET IT DONE. ASAP. That means SSN, DL, etc.

    Also: Keep scanned copies of EVERYTHING so you can back it up.

  11. Hi all,

    I have my I-751 ready to file! My conditional green card expires 02/06/2016 and my 90 day window started November 8th. I can file it this week but am worried about missing the biometrics appointment as I am flying to the UK from December 22nd to January 2nd to see my parents.

    It seems that once the I-751 has been filed, the biometrics appointment is scheduled a month after, putting me in the UK danger zone. Should I wait until January 3rd to file just to be safe? I have up to 02/05/2016 right to mail it? Also my divers license runs out on 02/06/2016 (!), is it right they will issue a 1 year extension I can use while they process everything?

    The other option is that you go early for biometrics once you have your biometrics letter and plead your case that you're travelling to visit family over the holidays.

    Yes, I know, others will say that you cant get biometrics done early. I did an early walk-in for my adjustment of status without issues. Your mileage may vary. Some centers are nazis when it comes to biometrics, others take a more French laissez-faire approach.

    If I were you, bring your booked tickets, tell them you're going to visit family, quote "Jesus" a few times given you're in Nebraska, and cry if you have to in order to gain sympathy.

  12. Based on your post, it sounds as if you are working in the US under TN status. Is that correct? I am curious because that is my current situation, and I am wondering how filing an NR-73 would affect TN status because the TN is a non-immigrant visa and explicitly notes that you must have intentions to return to your home country once your visa period ends. My concern is that filing an NR-73 could jeopardize my TN status, and wanted to see if someone had prior experience with this.

    The argument I made is that I severed ties to move down here for work. I still had a house in Canada that I rent out, so for US DHS this was sufficient to show that "Hey, I might be down here, but I still have a house back home I can go back to". I argued my case with Revenue Canada that the house is there, but it's NOT my primary place of residence.

    Where the TN-issues come up is when someone has been on multiple TN "visas" for 10-15 years, and at that point the US DHS (justifiably) is going to want to know whether you actually expect to return to Canada or whether you're just going to milk your way through 25 years of TN status'...

    FWIW I'm now an LPR so the TN-status doesnt apply anymore.

The biggest pain was the 2-hole punching, ACCO fastening and bottom-tabbing the ever-living ####### out of it to make it easier for the USCIS folks to go through it.

    I'm glad everything is available electronically these days. Keeping hard copies is a huge pain in the butt when it comes to assembling, but with the glorious powers of Adobe Acrobat, a LOT of PDF files, and a printer, it was done over the course of a weekend.

    Yes, we know adding PoA and Wills are important, but we're just re-doing all that now in creating a Trust to avoid probate (Our kid will technically be a trust-fund baby if we kick it!), but I wasnt going to hold up an application for that!

  15. Clearly a lot of data, and not sure how you're going to submit it, but there's probably some prioritization in this that might be required:

    1. Stuff USCIS thinks is bonafide evidence that shows credibility (examples below)

    2. 2ndary evidence that shows a paper trail

    3. Tertiary evidence aka "Filler", "Other stuff you had lying around that MIGHT help" and "Why are they wasting our time submitting this" (examples below)

    There's some big "heavy hitting" stuff there, assuming you filed as "married filing jointly" on your taxes, or wills that show each other as primary beneficiary, etc. Please, for the love of all things holy, think about whether a facebook conversation printed off the internet is really necessary...or a copy of your Costco card bill when you're also submitting JOINT account statements for a checking account.

    Ultimately if it gives you peace of mind, by all means include it, but I'm not sure a copy of your passports is going to help at this stage.

    Provided that you've included documents that show a) you live together, b) you pay for stuff together, c) you cover each other for insurance and d) if one person dies, the other gets everything, then you've basically got it covered.

    Oh, and kids too, but that's really going to depend on timelines and circumstances (opening joint bank accounts is a lot easier than thinking having a kid when you're near retirement to show a bonafide marriage).

    I've just had to go through this, and we have 18 different sources of documents totalling over 175 pages. There's a lot that can be added. I'm not sure you need a separate letter explaining bank transfers, but hey if it makes you feel better,have at it.

    Hi everyone and good luck to all those in process. I'm so thankful for this forum and all the info you all have supplied. I'd have never known what a tax transcript was without y'all. I’m the US citizen in our marriage. We are about to submit our I-751 with supporting evidence and would like some opinions on our submission plan. Here is what we plan to submit:

    - I-751 app

    - Copy of front/back of green card, drivers’ licenses for us both, passport for us both, marriage license

    - 2 years of statements from our joint checking account with copies of all checks written

    - copies of 2013 and 2014 tax transcripts plus w-2's

    - 2 years worth of pay stubs for each of us (shows address)

    - 2 years worth of retirement statements for each of us (is this addressed to both of you?), plus 2 years of statements from my deferred compensation plan (like a 401k but for public employees) (shows address and beneficiary info)

    - one greeting card for marriage congrats and two each for Christmas 2013 and 2014 addressed to us both

    - copies of all electric bills for 2 years with both our names(shows address)

    - copy of wills for both of us including interment instructions notarized

    - copy of car registrations (shows address)

    - copies of Costco cards and bill with both names

    - copies of 2013 and 2014 homestead exemption mailings with both names

    - copies of each of our credit cards from a department store with same account number each with our name (no statement b/c we haven’t used it)

    - screen prints of my spouse's benefit selection from this year where we applied for life insurance effective Jan 2016

    - copy of a Facebook conversation I had with my spouse's mom about welcoming me to the family

    - copy of travel health insurance which covered us both

    - screen prints of our travel confirmations for 4 different trips since 2013 (shows both names)

    - screen prints and bill for our car insurance that covers both our cars

    - AT&T bill with both our names and cell phones

    - email from BBB and letter from Social Security with spouse's name and address noted

    - copy of document where I donated half the house to my spouse

    - various pictures since 2013 including travel photos and some with family

    Questions: How does this look so far?

    We each have our own separate checking accounts and then one joint account. Our mortgage and a couple of other bills are paid from our joint account. The other bills are paid using my personal account. My spouse transfers his portion of the bills to our joint account. I plan on explaining this in a separate letter I’ll send with the other evidence. Should I include statements from my spouse’s account showing his deposits to our joint account or should it be enough to include only one statement with his account number noted? The joint account only shows a portion of his account number on the lines where the transfer occurs. Thank you for any advice you can give me.

  16. My Noa1 for AOS was Nov 27th, I got my EAD/AP a few weeks ago, but have not heard anything about AOS. I know it takes longer, but my concern is that the USCIS website still says "Acceptance" nothing has changed. Should I be worried?

    I went from "acceptance" to "testing and interview" for the I-485 Case Status. In short, your situation isnt out of the ordinary.

    I assume you'd prefer "Acceptance" to "Request for Evidence"!?

  17. We also have our honeymoon booked, which we may not be able to go on at this rate even though our case is APPROVED. SO frustrating.

    Your honeymoon is "domestic", right? Please for the love of all things holy tell me you're not leaving the country with an EAD/AP card for the purpose of a "honeymoon"?

    I sincerely hope the address thing gets resolved. The USCIS folks did do a lot of "script-reading" on the phone when we changed our address mid-process, but it got done pretty quickly. In your case, if you havent even moved, I'm not sure WTH is going on...

  18. Interview today - Approved.

    Of the folks in the waiting room, there were a couple of lawyers scattered, but to be honest it was pretty empty.

    We got called in promptly at the time of our appointment. The IO went through our application, confirmed all the details (like I was on a TN prior to applying for AOS). The IO took our copy of the deed (we bought a house since we got married and submitted the application) as well as copies of the updated car insurance (with both our names on it, with the new address).

    The question that stuck with me was "Have you ever had arms training". Didnt expect that one...

    Given that we had included so much with the original application, we supplied a few more wedding photos, but that was it.

    In and out in 30 minutes, then a short wait for the final security check and I got my passport back, stamped with the temp I-551.

    On to another 2 years before we resubmit to get the conditions removed!

  19. Interview on Feb 27, so if all goes well, we'll probably only have the EAD for a month. Does anyone know: do you always absolutely have to hand in the EAD at the GC interview, or do they ever let you keep it?

    I got mine Yesterday, and our interview is on Tuesday. So that's 5 days of not using it. Good times.

    As I understand it, they'll use the same photo for the green card, so get used to it! Is it something you'd want to keep? I'd be concerned of bringing the wrong card with me whenever I traveled!

  20. I cant comment on your specific case, but I've been a non-resident for tax purposes with Revenue Canada for the past 2 years. It's an odd situation, as up til now I've been on a "non-resident" (immigration purposes) visa in the US, though paying taxes as a resident b/c of how much time I've spent down here. So just b/c you're here on a non-resident basis for immigration, my experience is that Revenue Canada (or the IRS) look at it differently.

    The NR73 form is what I filled out, but all that was for was with showing that I had severed ties to Canada (though I still own a house there).

    Recognize that there are bilateral agreements between the US and Canada, so my tax return in the US has me declaring all foreign accounts (I'm not stupidly wealthy, so these arent offshore accounts a la tax evasion, but old RRSP accounts and such).

    Granted, I did all of this with an accountant; most Canadians down here are keen on switching due to the lower tax rates, though need to prove that they have severed a lot of ties with Canada!

    All that being said, I'm only giving you my experience; I am not an accountant or expert in international tax law! I guess ultimately you want to put yourself in a situation that doesnt have you over-paying taxes, but is a legitimate situation to be in such that nobody is coming after you for tax evasion!
