  1. Thank you so much. We do keep all communication open with her. He speaks to here very often, we send pictures and inform her of everything. I appreciate all of the feed backs. As far as how she is getting here that's still a mystery but only God knows.

    Boiler that's what I have been thinking because her mom is on TPS and the other only way would be through marriage. Which they probably found someone yo marry her and apply for a spousal visa

  2. Thank you that was my concern. Not the custody because my husband is ready to address that; my concern was the "what if" if she gains custody and get welfare or anything for the child or owes hospital bill for the child, being that I signed form I-864 will I be held responsible for paying back any government assistance she receive for the child?

  3. Thank moderator for moving thread...... Thanks for response Ontakie. In Haiti there are no legal papers that needs to be done. She has always been unemployed so she wasn't able to provide for the child, and my husband because of him having a very good job in Haiti has raise his son from 6 months of age up to now. He has school records which shows he had paid for private schooling for his son and people that knew him personally that knows his son always resided with him in Haiti. She is not yet in the State but has threaten that she will be coming soon and she wants her son. It's so funny that in Haiti she never wanted him, but she does when she comes here, because of money. They are very well educated in Haiti about income tax check and child support because she keeps mentioning that; however, I filed for my stepson and am committed to take care of him. And I know deep in my heart that if given her son knowing the family background they will apply for government assistance and I cannot have that because of the affidavit of support I signed to get him here. She doesn't have her sons best interest at heart. He is here in private school, he has already mastered the English language and he loves being with us. I

  4. Hello everyone my stepson arrived in the US on October 2015 from Haiti. I filed the I130 and everything went smooth. Now that he is here his biological mom in Haiti is now having issues that she haven't had before. She lives in Haiti and has her mom that is here in the US that is here on a TPS status. She wants her son to live with her mom and my husband refuses; however she is claiming that she is applying for a visa and when she arrives will fight my husband for custody even though he never even lived with her in Haiti. My husband was always the primary parent until he arrived couple months before his son his mother watched his son until the son followed after. My question is that If she gets her to the US I know she is in tilted to file for full custody, but being that my husband son entered entered with an approve I130 and me signing an affidavit of support to take care of this little boy where do my rights stand. The only thing the biological mom talks about is money. If it is not income tax money it's child support and am just afraid if she is awarded custody and they were to file for any type of Givernment assistance I will be held accountable for that. Also would it be easy to see what he intension where to let the stepmom bring her son in and then she tries to take him from my husband and I? And if she takes him can I revoke the affividat of support?

    Just wanted to let you know I had my interview in Stockholm today and it got approved right away and went very well :)

    Cant believe we all started this together over 1 year ago and now we are all almost done with it.

  6. I hate these moving targets!!!! It's so freaking frustrating when they keep on changing things. The CEAC website still says it will take 30 days to review docs, but we all know it takes 60, and now apparently 66. I know it's probably secondary to the snow days and off days that they've had lots of in the past month or so, but it just frustrates the heck out of me. If we were this lackadaisical in my business I would be out of a job in about 30 minutes.

    Maybe if they are a little more careful and stop losing everyones documents they would probably be able to go back to 30 days as per CEAC website for reviewing documents. The more checklists they send out it becomes more of an overload for them, because now they have new petitions coming from USCIS combined with all of the checklist documents receiving all at the same time.
  7. Hello everyone, please help me out. I am having trouble with the I-864 form, this is the second time they send me the checklist. I have tried to call the NVC and I dialed like 50 times and it have been always BUSY, and my husband emailed them before and it takes us two month to get a reply and it was not help.

    My husband is the petitioner, we are applying both of his parents to US. We also have one kid.

    Here is the information on the I-864 Checklist of my mother in law's case:

    In Part 3, Information on the Immigrant You are sponsoring, Please correct the following:

    [X] Items 2 through 6.f. this case's visa category does not allow accompanying family members; therefore, you cannot list family members in this section.

    [X] Item 7. The total number of immigrants listed in Item 7 must equal the number of immigrants listed in Part 3, Items 1 through 6.f. In addition, you must also verify that the total number of immigrants listed in Item 7 matches the number you entered in Part 5 Item 1.

    In Part 5, Sponsor's Household Size, please correct the following:

    [X] Item 1. The number of Sponsored persons must match the number listed in Part 3, Item 7.

    Here is the information on the I-864 Checklist of my father in law's case:

    In Part 3, Information on the Immigrant You are sponsoring, Please correct the following:

    [X] Items 2.a. through 6.f. You must list any spouse or children the principal applicant said would accompany him or her to the US on the IV application.

    [X] Item 7. The total mumber of immigrants listed in Item 7 must equal the number of immigrants listed in Part 3, Items 1 through 6.f. In addition, you must also verify that the total number of immigrants listed in Item 7 matches the number you entered in Part 5 Item 1.

    In Part 5. Sponsor's Household Size, Please correct the following:

    [X] Item 1. The number of sponsored persons must match the number listed in Part 3, Item 7.

    On both of their I-864 Form,

    In Part 3, Item 1. I check " Yes"

    Item 2. I Check " I am sponsoring the following family members immigrating at the same time or within 6 months of the principal immigrant named in Part 2. Do not include any relative listed on a separate visa petition."

    Item 2.a. through 2.f. I list my mother in law's information on my father in law's I-864 form.

    and

    I list my father in law's information on my mother in law's I-864 form.

    Item 7 The total number of immigrants you are sponsoring on this form from Item 1 through 6 is " 2"

    In Part 5, Item 1. I entered "2 "

    So my Questions are :

    1. Should I list the information of the spouse in each other's I-864 in Part 3. Item 2.a. through 2.f,

    2. Item 7 should I put "2" or "1" ?

    3. Is it wrong that our Household Size should be :

    2 immigrant + my husband + me + one child = 5

    I know this post is kind of long, thanks very much for your patience to read the whole post. Please help me. :crying:

    treat each immigrant separately, meaning you will not mention your father in law info on your mother in law I-864 and vice versa. Part 3 #1 is correct you checked yes; however do not check #2, and remove other family member name, leave blank. Part 3 item 7 should be 1. Part 5 item 1 you must enter 1. Your total house hold size will be 4. On your father inlaw i-864 will be your husband, you, your child and your father inlaw. And same for your mother inlaw 4 also, your husband, you, child and mother inlaw. They will know how much people you are sponsoring on their end. Hope this help
  8. Case was sent on 09 December to NVC. But still did not hear back from NVC.

    How many days they will receive the case and assign number ?

    my case was sent to NVC on Oct 31 they received it on Nov 18 ( I called to get that information, but they will tell you to wait 42 days for case#) called on Monday Dec 15 and was given our case#, invoice#, and Benf#. Was able to signed in and did choice of agent and finally today Dec 18th recvd email from NVC. Good Luck on your journey!!!!
