Thank you, thats very helpful! I only wish that info had been included in the step by step and timeline instead of hidden in threads on the forum. Is there a list somewhere of what exact forms the embassy will require for the interview? And can some of them be filled out and sent in online? He filled out the ds-160 at least a month ago when we got notice the I-129f was being sent to the embassy yet they asked in the email I recieved from them today that he fill it out.
Also, I can just simply call the embassy tomorrow and reschedule the interview? How far out can I schedule it? Is 2 months too long?
I will private message you and give you the forms for packet 3 that I received from someone who just went through the Tunis Embassy.

Awwwww! Now I'm glad that I choose to write them a awesome love story! So the lesson here is to show your love and let the words flow from your heart, plus have lots of evidence!

oh my gosh! that's hilarious! 3 pages long?! I ended it with something like, he's my source of "happiness" and the other half of me and that is why I'm petitioning for a K1 Visa! I know, I had to toss in all that I had to plead with their hearts. I'm just thinking positive, somewhere in the great pile of documents on someone's desk, there's a person reading and seeing all of my evidence and they're like yes it's a love story and I'm going to approve of them!

I have received my fiance signed paper, and he wrote another letter in more details on our wedding plans. Both signed. I received it and put it in envelope with the letter that I received from USCIS and send it express today. So hopefully everything will be good and we will have our approval soon.
My fiancé said that they approved of our case cause I wrote such a "Hallmark" card about how we met, that they were afraid that I'd write another sappy love story if they don't approve of it! LOL!!! It was one page long,very detailed with references to pictures and receipts with the correlating dates that we had met and did things together while I was there in his country. No doubt about that we had met when I said we did.
I think I heard grand sweeping music in the background as I was writing it! Reading romance novels did paid off! Our case was approved in a week!

Thanks guys, with your help and advices- my fiance just got his Absolute Divorce Decree by email and going to send them back to to USCIS tomorrow! Hope our NOA2 will come soon after that!

I'm a little stuck on one question on the I-134, #2. I don't know exactly what date, month I arrived to America. I know the year but I don't know the date and the month. My dad who would know for sure is dead and so are my uncles who would also know. My mom and my aunts probably wouldn't know the exact dates...maybe the month but not the date. I've asked around and all they can tell me was who was born close to the time when we immigrated over as refugees. I was a little girl and I know we came during fall of 1976.
Will I have to give the whole complete date of when I reside in the US? I know just the year. Who would have these records?

"Embassy personnel was very helpful and professional during the entire processing of the K1 petition and Fiance Visa. The Interview was conducted in French and lasted 15 mns. Questions asked were the kind one expects for this type of Interview and one can read on this Board. All phone inquiries - 3 total - were either answered right during the call or followed by an email. Visa approval didn't occur the day of the Interview but four weeks later due to an Administrative Processing period. Embassy personnel took our call and reassured us at this stage. After AP, visa was granted without having to provide further information. One small observation: Packet 3 sent by Consulate indicates Visa applicants to provide proof of financial support but it turns out that no Affidavit of Support is needed for K1 Visas. All in all, we would rate the Consulate services of the American Embassy in Tunisia with the highest score."

Yes I saw that review too. But I'd rather be more prepare than not just in case my case is the case that they decided that they need to see the financial of support! That is why I'm getting stuff ready in anticipation for anything that comes our way. I swear my fiancé is so relax about the whole thing...funny thing is there was another woman here with a Tunisian fiancé and she said he was the same relax way about the whole process too!
Thank goodness the Embassy in Tunis seems really nice and professional. And thank goodness my fiancé is fluent in English, French and Arabic that I feel that he'll do well at the interview since language is not a barrier!

You would have to ask the embassy if the taxes from a co sponsor can be mailed or faxed, it is really embassy specific.
You can wait until you have the job and then submit a letter from your employer stating that the job will be permanently
and go to plan B with a co sponsor if they will not accept your income and new job.
Have you read the reviews from your embassy, maybe someone had a similar situation.
I do have time get it figured out but I just wanted to think ahead and be ready and have a back up co-sponsor just in case. I do meet the 125% poverty guidelines so not too concern about not meeting it. The concern is that I will be changing jobs probably the end of June, or very early July.I will still make over the poverty guidelines but I read somewhere that they will not only look at supporting financial evidence but will look at stable employment too. I should know for sure about the new full time job in two weeks(but I still have a part time job too). I will submit all supporting documents to them when it gets closer. From what I'm reading from people who's gone through the Tunis Embassy they either do it themselves or have their parents be their co-sponsors. Some are students, unemployed but mostly they have co-sponsors who are willing to give their tax records to be their co-sponsor.
I totally get where my friend is coming from, that is very sensitive information especially about someone's financial. I'm going to try to do it myself on my own income when the time comes. Great advice about calling the Embassy about sending them via email or faxing them my co-sponsors tax records! If we get a request for more evidence of financial support then I will call the Embassy and ask to see if my friend can send them his I-134, W2( which he is more than willing to do) directly so we don't have access to his financial records, which I personally don't care to see. I also got my tax transcript from the IRS website and one page on there is called ACCOUNT SUMMARY, that one just has my wages from that year showing how much I made without going into a lot of details. I'm wondering if my co-sponsor can use that one instead of using the longer version tax refund which has all of the line by line of what you are filing on...if the Embassy can accept that one I think my co-sponsor be more comfortable. Yes, all of these questions will need to be asked at the Embassy when we get there!

I need to run this by some of you. I'm starting to fill out my I-134 form and I need help on how to proceed. I got my tax transcripts for all 3 years 2011,2012 and 2013. The last two years(2012 and 2013) I meet the 125% poverty guidelines to be the sole sponsor for my fiancé. I am going to fill out the I-134 and be the only sponsor since I met the guidelines but because I'm in the middle of transition into a new job which I hope I'll get next month I'm wondering if the embassy will not look favorable at my I-134?. So since I can't show that I'm financially stable until I get into my next job, next month I am asking a friend to be a possible co-sponsor.
My friend who said he'd help me and be a co-sponsor would help me but when I told him that the embassy will need tax records from him to prove his income he hesitated and didn't want to share his tax record. He said he was ok with giving me his W2 and possibly a letter from his employment but wasn't comfortable with giving me his tax records. He makes way over the 125% poverty guidelines.
Should I just chance it myself and send only my I-134? or should I look around for another co-sponsor who is more willing to help me by giving me their tax record as a back up. My fiancée just had her interview in manila, long story short she got a real ####### consular. Started asking her if I have ever been convicted of a crime and have I ever filed bankruptcy. The answer she gave was no, because she didn't truly know. When in fact 15 years ago I have a theft felony for taking to many unemployment checks after I started working again. Ive filed bankruptcy twice over the years, I sold a bag of pot 35 years ago, and I have a burglary charge for taking a knife out of a showcase where I worked. I also have 3 duis over the last 25 years......I have not been in any trouble in over 14 years!!!!!! and it was a dui. Before that its was in 1994 for the unemployment checks. Iam a good man with children who did stupid things when I was younger. They put her in review at the embassy .........what will likely happen? and if they deny us what do I need to do? please help iam crying my eyes out right now....I love my fiancé so much and cant believe I was the one on trial here, I have never heard of anyone being asked all these questions about the petitioner.....please tell me what I can do......I never lied....the only questions asked anywhere on any paperwork was if I was ever charged with violent crimes........please help us we are so sad and lost right now......this just happened 30 minutes ago.....
I am so sorry... just take a deep breath...She didn't know so she didn't lie at all, didn't perjure herself. So they put her on Admin Processing? I think they are just checking out some things but not about you. I heard that sometimes cases are just put on AP so they can process the visa. If she has a clean police record she should be fine. You already live here so they aren't going to deny her based on your past criminal history. USCIS would have done a full background check on you already but I haven't heard from any Petitioner if their petition was denied based on not clearing a background check. Remember we live here already and our Beneficiaries are the ones who are intending to come here to live so they are careful about who they are letting into our country for immigration purposes. Embassy's will denied visa's to the beneficiary IF they are the ones with a past criminal history and cannot pass the background checks there.
Remember that the embassy's are just trying to determine if its a real bone-fide relationship or not base on information you've given them about your relationship. I hope other more experience VJ members will help shed some more light on this too. Just keep the faith!

Can someone who went through the US Embassy in Tunisia for a K1 let me know what forms are in the packet 3 and 4? We got approved and our case is on its way to NVC! While waiting to get my case number from NVC I wanted to look ahead to see what we can do so we don't have to wait so long to get the packets.
I'm working on my paperwork now for the I-134 and gathering my financial info. Just needing to know what my fiancé should be preparing for. I've looked at the K1 flow chart and the guides but its more like for me to know and my paperwork( petitioner). From the Embassy we are to wait to get directions from them...but I would like to know if someone has that info, especially if you just got approved from the Embassy there. Thanks!

I personally would call them to inquire if they have received the packet 3, cause he/she is still needing packet 4 to do their medical BEFORE they can have an interview date. I think 4 week is long enough of waiting. Its not unreasonable for you to call/email or contact them since its been long enough. I probably would be calling after a week to get packet 4. But that's just what I would do, maybe someone who has more experiences in the Embassy in China can tell you what you should do to move forward.
I also heard that you can fill the DS-160 online for them too, that is what some petitioners are doing for their fiancé(e). When you do it online, make sure that you print out the DS-160 bar code page when you're done. Speaking of which, I have a little waiting snag that I need to vent about.
I'm not sure if it is the same in other countries, but in China, after the NVC sends out everything to the embassy, your other half will get a packet (packet 3) for them to fill out DS160 and some other things that he has to send back to the embassay and (as far as I understand) he will have to wait to receive an email (packet 4) that they have approved everything before he can do his medical, etc and schedule an interview.
Well... its been four weeks since he mailed in packet 3 and we are waiting to hear back from them!!
I believe we can't move forward (schedule medical, pay fee and schedule interview) until he hears back from them but I'm not sure. Either way, I just want to hear back so then we can schedule everything and get an idea of when he can get here!!!
I know that four weeks isn't too long in the grand scheme of things, but we are so close I can taste it! And I think that is making me a little impatient....
If anyone has any idea of the timeline between packet 3 to 4, please share! It would be greatly appreciated!

Just like to ask on what paper does the USCIS required for the fiance application...
Some said, I should use the A4 size (8.27 inches x 11.69 inches)
and others said use the Legal size (8.5 inches x 14.0 inches)
I'm confused where to follow...Hope you can give some ideas...

I just used 8.5 inx11 inch paper to download my forms and fill them out. I only use legal sizes if I have to download legal size forms or need to copy forms into legal size documents. Don't sweat the small stuff. If you want you can just download the forms right from the USICS.gov site and that should give you the idea of what size paper to use.
Important thing is that everything fits on it and you have the complete print out of the forms so you can correctly fill out the necessary and required forms for them to approve of your petition. Good luck!

I've read the link which you sent,yes it seems it's not final.But my fiance had divorce in 2003 and since that time used this Divorce Certificate which he has all the time he needed! So now I don't know where he needs to get this final copy of it? Where does he need to go,to the court? But he lives in another State now? I don't really know what to do,just waiting till he woke up and we can discuss it!
I'm sure that all he needs to do is call the state city hall(where he used to live) vital statistic office where he filed his divorce and they can send him a certified copy of his final divorce. He can get it even if he doesn't live in that state anymore. Its like people requesting birth certificates from all over when they moved. What state did he used to live in?
I think there are two copies, a long version one and a short version one. Have him get the long version one. I got both versions of mine, a short one to quickly prove that I'm divorced and the long one just in case I get someone requesting more proofs, like agreeing on dividing assets etc...

He divorced 13 years ago and I hope it will not take long to get this Absolute copy now!
As I understand he can go to the court and apply for it? If he be able to get them at the same day,I'm wondering? Don't wanna wait for a long time really!!
I think all he needs to do is go to his city court/hall and request for a certified one copy of one of the final divorce decree. It shouldn't take long to get it(even same day), if it was never contested and it has been finalized by the court.

Just try to relax, you'll find out what they want and will send it to them. One of the things that I have learned in this process is to not get frustrated or freak out each time I get something from them. I just send them what they want and they pass me onto the next stage. Just breathe....
I'm not a lawyer but my understanding after more reading on Nisi decree, it seems that a nisi decree is not the final and absolute final divorce decree. So it seems USCIS wants the final divorce decree.

I don't really know either what this "NISI" means! That's how my fiance explained me what they say in that notice,he is sleeping now,so hopefully he knows what this means and we will decide what to do) Maybe you're right, maybe he needs just to send longest copy of it! I'm confused and upset,hope we will solve this problem!

Sorry I've been MIA for a while! But... despite all the challenges that we have to go through, knowing that we have people we can go to when we need to vent, cry or celebrate helps a lot!
And of course the end result is the most rewarding.
I love that when I'm feeling down, I can come here and know that I'm not the only one, or see people's success stories and remain hopeful!

patientlymostly impatiently for mine. lolI know...I come here often to see other's success stories too because waiting for mine is hard but I'm cheering for everyone and seeing their happiness and excitement that their loved ones are about to come over makes me feel like my day will be sooner than I think! We all give each other hope, that's what I love about the people on here...and another thing...everyone here has an amazing love story and sometimes I just think about how they met and what's their love story? That makes me happy! There should be a "LIKE" button or a "HUG" button because sometimes you are so appreciative of the support that you get....

I have had both letters of intent, but my fiance send me his by email and I just scanned it. And I read here that it has to be original signature. So I am thinking thats why. But I am thinking what else should we send along ? To show more proof. Because this RFE: Intent to marry: they need evidence from the beneficiary that he plans to marry the petitioner. May be someone have ideas on what else I can send.

I would have him resign the Intent to Marry Letter in ink, press hard on the paper and resend that letter to you. I heard some cases USCIS have accepted a high quality scanned in letter of intent to marry and others have said just an original signed, ink copy is the best way. I didn't want to delay the process any longer and just had him resign the letter and sent it to me. I sent the original signed letter along with the rest of my RFE evidence but made a copy and kept it for my own file.
If they didn't accept my Intent to Marry Me letter or his I was going to send it my wedding details, any place I was going to reserve, people who are coming to the wedding, a wedding invitation with BOTH of our names listed on it...proves that others are going to be witnessing us getting married. Maybe a letter from a Judge who is going to marry us...stating services fees and when they can do it. In my city we can get married at city hall or some of the judges can perform wedding outside of the court house so look up who can perform weddings and see if you can get a letter stating that they will be the one performing your wedding for you. Oh and of course I picture of my wedding dress with a receipt if they needed it! those are just some of my ideas...maybe others have some ideas too and how to prove more evidence?

We received finally our RFE notification. So what they need, is my fiance's Divorce Certificate,but he sent it for the first time with the petition!
What they explained exactly,that they need another example of his divorce certificate not " NISI" which he sent! But we have no idea which one they need,all the time my fiance used that example and it was ok!!! Why it's not enough now? Where he need to get this certificate now, which USCIS needs?
Any ideas guys???

Hi there! What is the "NISI?". I mean for my fiancé and I went sent both of our divorce papers( the long version, his was translated) along with our petition. I didn't get a RFE for that but we got an RFE for the Intent to Marry Letter that somehow USCIS overlooked it or it was never sent in with the packet from our lawyer. It was just my fiancé's that they didn't have, so I sent him a typed up letter that the lawyer did for us and he printed it off and signed it in black ink and mailed it to me via FEDEX and within 4 days I received it. We didn't have to give further proof of the details of the wedding.
I think I read somewhere in VJ to send in the long version divorce decree, that is the one that I sent. So maybe he needs to send that one in. or resubmit it in like its a new person needing it. I mean I already sent in everything that they could possibly need to process it without any mishaps in the first place but I got RFE for the stuff that was already sent, so I just sent it to them again!
Once they received everything that they needed( again) it was processed and approved within a week. I hope that helps. Good luck!

Use blue ink, sometimes they confuse black ink with a copy.

I received our NOA2 approved hard copy letter today! YEY!!! Now I can officially call NVC and bug someone!!! So excited!
