Had my GC interview and the FBI namecheck hadn't been completed so they didn't take my EAD or AP nor give me a stamp. A few days later I left the country on AP and returned without a problem (not that there should have been a problem anyway).

If you get here on a tourist visa and consider AOS, as the OP is considering, then you simply say at your interview that you had no intention of staying when you first arrived (whether you married your partner on the spur of the moment or whether you'd been married for years). You maybe lying or you may be telling the truth but that's for you to know and for them to find out (which, unless you stick out like a sore thumb, they won't bother). And that's it. Your Green Card's in the mail and you didn't need to spend a day, a month or a year apart as you would if you took the K-1 visa route.

I entered on the VWP, adjusted status and within five months I was approved for a Green Card. Simple as that. Qucik process, no delays. At the interview I was asked was it my intention to remain in the US when I arrived at immigration and I simply said no, not at all, no siree bob. What the bloody hell did they think I was going to say? So in your case, go for it!!

My wife teaches at a University in the US and has organised a summer school programme in London in June. I have AP so am going with her. We didn't expect the interview date so soon (we filed in January) and it fits in nicely when she gets back....but not me. I wanted to stay a further two weeks to see family. I cannot change my flight ticket so intend to buy another one to get back for the interview, preferably on the same flight as my wife and her students. Will it be a problem at Port of Entry with a one way or outward bound ticket different to the one I intended to travel back on?

A friend of ours generously gave me a ride even though he had to get up at 5.30am. Both biometrics for EAD and AOS done at the same time. Home for lunch!!
Vet says dog's fine, nobody hurt in either car, everyone insured, and we've got a replacement car this afternoon. Always want to look at the glass as always half full, never half empty.

Thanks for the replies. The rental place is closed now and it was the first thing we tried. However a friend has let us use his truck. I don't drive and my wife only drives automatic but we'll be heading off in a huge stick shift battlewagon. Let's hope it makes it. Will call in tomorrow with the results!! You have to laugh sometimes or you'll go mad.

All of us have shared, empathised with or celebrated both the good and bad fortune people have had on this forum. Well here's another story. I've got my biometrics at 8am tomorrow in Kansas City and just 2 hours ago someone rammed into the back of our car. Both vehicles are now awaiting tow trucks in a ditch out in the middle of Missouri!! Good news is nobody was hurt, although we are worried about our dog who was in the back seat and appeared shocked but alright. Now frantically trying to get a lift off someone or a taxi. This is not a well known transport hub out here. Ah, well, I'm either going to be on time, a bit late, very late or not get there at all and have to cancel last minute. At least I'll have a police report to explain what happened if any one at the appointment needs to ask. Phew!!

Okay, the part on the letter regarding employment led me to believe it was purely to do with my EAD, now I realise it is concerning the whole AOS. Will it still be possible to go for an infopass interview for AP after 90 days or does the EAD delay push this back as well? There's plenty of work in London if I want it and bills need to be paid somehow or other. Advance Parole will let me get out there, work a month or two (interviews permitting) and bring some cash home.

Thanks for the replies. On closer inspection it looks like it was for the whole I-485 package and not just EAD, however we did supply a letter stating it wasn't possible to show evidence of a full years tax return. Guess they ignored it.
However there's plenty of summer work available for me back in the U.K. so if AP arrives first my wife and I may head over there as long as it doesn't clash with any interview dates. If EAD arrives first then I'll look for work over in the US. Basically, I'm hoping for no further delays so I can bring in an income.

It was income related. Last years tax returns only covered 3 months as my wife's job only started midway through the year so it didn't meet poverty levels so the request was for a co-sponsor or evidence of increased earnings. I've sent off this past tax years W2's which shows the correct income levels. Silly oversight on my part but corrected immediately.

After all the endless form filling I was expecting a RFE as perhaps not all I's were dotted or T's crossed so they need a little bit extra info for my EAD. I received NOA for everything else 10 days after I mailed it all to Chicago and all cheques were cashed a few days after that.
My question is, does the RFE hold everything up including AP or will it just cause a delay for EAD. The requested evidence was mailed back straight away but it was a total of 25 days since my initial filing. I'm hoping just the EAD will be delayed and not AP. Thanks in advance.

From reading through some of the more harsh replies to the idea of AOS via a tourist visa, I can't help feeling that there is a somewhat subjective air about them. Instead of 'good for you, I wish I'd done it that way' it seems to be more 'As I have to be apart from my spouse/fiance therefore so should you, and if I cannot make you do that then I'll call you all liars, freeloaders, lazy, illegal, etc'.
