Not at all. Just put something brief down like 'family visit'. You leave the US on AP to work, play, visit relatives, go on a cruise, whatever. You don't have to give them a 'chapter and verse' reason. Just remember to be back before the 12 month period of AP is up, or be back for your AOS interview or back because you want to, whichever comes first.

With my late running flight from the UK to Chicago (mentioned above) there was no hope of making my connection nor for the majority of people on my plane, most of whom were chirpy Northerners heading to Las Vegas (as chirpy Northerners often seem to do). Nor were several other plane loads of people able to make their connections. The result being - a huge line stretching from the re-booking desk, zig-zaging back to a corridor then all the way back to the customs desk and beyond to the baggage carousel and almost to the immigration desks. It also hardly moved so after an hour I upped sticks and carried my suitcases and made my own way from T5 to T3. I eventually rebooked on a flight four hours later than my original departure and wasn't charged any extra to do so.

I had a four hour connection at Chicago, but didn't make it. Not so much immigration (that was quickest of all) but the two hour delay on the runway prior to my initial flight taking off as they hadn't completed the security name check, plus 45 minutes circling O'Hare due to congestion. I always allow what I 'think' to be enough time, most of the time it is, some times however it's just not going to happen.

Of course they are not going to know why you need to leave but it doesn't matter even if they do. You are allowed to leave on AP for 'bona fide business reasons' as it says on the I-131 form which is what you are doing. You can be away for those 80 days as long as your 12 month AP hasn't run out in the meantime.

if you are able to pay the money I'd get AP now, just in case an emergency arises at home and you have to get back. Or consider filing AP around February just to be on the safe side. It normally takes three months to receive it which will bring you up to around May. Bear in mind that your AOS interview may not automatically grant you a Green Card, there could be delays, the FBI name check being the most common one. So if the interview goes well and you have been approved subject to a name check, you'll have to use AP to leave the US.

There's no guarentee you'll get an I-551 stamp at the interview nor if you file for AP is there a guarentee that it'll arrive before Christmas allowing you to travel whilst you are waiting the FBI namecheck. I'd wait to see what happens at the interview before buying any tickets to the UK. The alternative is to apply for AP now and wait until you receive it, but by then it could be very close to Christmas and flight prices will have increased somewhat.

AP is valid for a year so make sure the return date is within that time.
I've used AP and been away for much longer than 45 days, months in fact.

No limit. 45 days will be fine. The only problem will be if your interview comes up while you are out of the country, you'll have to come back or risk trying to convince them to postpone it.

It was a fairly simple process for my US wife and I when we lived in England. Contacted an immigration lawyer in London then we were asked to send off our passports and marriage certificate. My passport returned about a month later and my wife's returned about three months later with a 'indefinite leave to remain' visa stamped in it. No interview, no fees, no medical, fingerprints, RFE, etc. Medical assistance via the national health was granted to her as a matter of course as she was present in the UK. The whole process was fairly hassle free compared to the pantomime it is to get a visa in the US.

Well I hope you read it carefully and allow it to sink in. The arguements flare up here all the time and it goes round and round and the 'have' and 'have not' camps, the 'do's' and 'don't's' will keep on and on believing they are right. And I am aware this is a public forum, I sort of gathered that when I joined. Your point being?

I said spur of the moment because that is the circumstance where you can adjust status from a VWP.... you entered with no intent to remain and got married on the spur of the moment....
If as you say you were already married and you entered the US with the intent to remain then you have commited visa fraud....

Wrong. You can adjust on the VWP if you have been married for any number of years. You just have to prove you din't intend to remain when you entered the US.

How can you claim to have got married on the spur of the moment if you were already married to your wife before you entered on the VWP?and please dont quote that you have simmilar situation to me because you dont.... I was single when I entered the US and although I have known my now husband for many years as the son of a family friend we were not involved with eachother at my time of entry... nothing simmilar to your situation...

Like many people I was unsure of how things operated until I found this site. During one of my 90 days here on the VWP (and yes at POE I honestly intended to return) I found out it was possible to adjust so I did. Just 5 months after filing I was interviewed and approved for the GC.

I would recommend this route in certain cases but only when the full circumstances of an individual are known. I was already married when I came over on the VWP and I had no intention of being apart from my wife if there is any route that avoids separation. This route was it. Thankfully the stuff I had to do (which was similar to Kezzie) was done personally when I got AP. In my case minimal cost, no risk.
If you entered on VWP then you were representing that you would return, when in fact by your statement you had no intention of leaving - then you misrepresented at the POE and committed FRAUD! good for you circumventing the law ... /sarcasm
I didn't realise you were there at my POE? Hiding behind the immigration desks where you? Or hanging about the luggage carousel trying to hear what was being said? I'd been over plenty of times on the VWP and this time was no different. It became a different issue within the next 90 days but you seem to assume otherwise. You pillock.

As someone who had done the VWP to AOS after coming to stay with friends to recover from surgery and I now have my Greencard.... I would never recomend that route to anyone.... if you find yourself in the same situation then ok you maybe want to know if it is possible but to encourage other to do this is not good.... you do not know other peoples situations so how can you say its ok and you will have no problems....
My not returning to my country to sort everything out, put a large strain on my poor mom who had to go tell my boss, have appointments with a lawyer so she could do all the paperwork to act on my behalf to sell my house and my car had to be collected from Glasgow airport carpark and she had to deal with banks and creditcard companies.... she did it all and never as much as complained about it but with hindsight it should have been me that dealt with all my stuff....
Yes it can be done but at what cost??? and at what risk....

Yes, I'm experiencing crazy Missouri weather as well. The prediction is 95F/35C for today. It felt like the reptile house in the local zoo at home last night.
My Mrs is from California so she 'likes' this appalling heat. However when temperatures get below 65F/18C then the fun begins. We'll sit on the sofa watching TV with a fan blowing cold air for me at one end and the heater warming her up at the other.

Often if you are not on the outward portion of your flight the airline automatically cancels your reservation on the return. Make sure both of you travel on an outward ticket then ignore the return. I have found plenty of round trip tickets cheaper than one way (though not always, thanks to consolidators like kayak where certain bargain single fares have been found) but I make sure I'm on the initial flight in case I lose my seat for the next leg.

Are you talking about the Advance Parole document? A sheet of paper with a mugshot at the bottom? That's what I have. In fact I received two. That's the document I've been using to travel outside the US.

You'll be able to use it for multiple trips for a 12 month period and if you haven't been given your GC by then, you'll have to apply for Advance Parole a second time. The document allows you to travel, so you are not stranded or 'held' in the US whilst your application is processed.

My return through Newark was friendly and easy. At the last minute I decided to put away my AP and hand in a I94W I'd filled out on the plane instead to see if it would speed things up. It resulted in a 'quick stamp and off you go' so I'm glad I did it. I've used AP on other trips at different POE but just tried that at Newark as an experiment.

I continued to work for the same company as I did before I moved to the US. Just did my work online instead. Got paid into my old bank account in local currency (not dollars, obviously) so it was irrelevant whether I had my EAD or not.
