Hello everyone! I filed my adjustment of status for K1 and got an RFE and one of them says “Submit photocopies of your completed tax returns (Form 1040 and all W2s) for tax years 2016.” I just came to the US last November 7, 2016 and haven’t worked ever since I came here. What should I do. :(

I doesn't matter f you worked or not.. they most likely want to see a filing status and an income for 2016.

W2 and bank statement (shows that he gets salary every 2 weeks).

    Is it not enough?

The most important to show income for 2016, right? W2 shows his income.

    1. EVIDENCE OF SUPPORT: Any evidence from your American spouse/fiancé(e) which will show the consular officer that you and members of your family who will accompany you will not become public charges while in the United States. Documentation regarding financial support can be in any form – preferably one year of tax returns, W-2s, bank statements, earning statements, letters from employers. PRESENTING ONLY THE AFFIDAVIT OF SUPPORT I-134 FORM IS NOT SUFFICIENT. The I-864 form is not required for a fiancé(e) visa.

You should be ready to explain why a Tax return for tax year 2016 is not presented  - you may be asked for that... And i would say the truth.

I would also try to get a letter from Employer..

    Good luck!!!

    Ok.  Thanks.

    Could embassy check it?

I mean see his tax return?

If I am not going to show his tax return.

What are going to show as a proof of his income for 2016?

P.S. Keep in mind he needs to amend the tax return for Tax year 2016 NO MATTER if the Embassy knows or not... Filing status was wrong, most likely his tax liability got reduced because of  that.

  4. Your Fiance needed to get his vaccination record from the physician at the place of his residency BEFORE the medical examination. And during the exam the record would been simply transferred to your Fiance DS-3025.

So, yes, he should definitely get the record before he leaves Ukraine. Just make sure his physician uses "Latin", not just Ukrainian - that the US civil surgeon could identify the vaccinations your Fiancee got.

  5. sorry Canadian Wife, I read your statement incorrectly. The visa will probably take at least a few months so she won't need to go to the US until that takes place. She is now in Manila with her mom and they are awaiting the first call, medical exam, interview, etc. They have no intention of coming to the US until they get their visas. Hope that clears things up a bit

OP, I'm so sorry , but looks like the girl won't be able to come as a K2 visa holder.

Yes, your I-129 F is approved, and she is mentioned in the petition. But it's not about when petition got approved or visa was issued.

In case with K2's it's about time of entry. K2 must enter the US BEFORE K2 turns 21. And according the info you gave us, there is no way your girl can make it.... I'm sorry...

  6. Hey.. I am Victoria, Todd's wife ;)

He sent me a letter, from his then current employment, which stated that Todd works for the company since ________ and his annual income is______________.

Of course, the letter was on the company's official blank and so on. That's it So, just get a letter from your current job.

Kiev, usually, is not picky, and to be honest, I wasn't asked for any other evidence of support, but I-134. But i would suggest to have everything the Embassy instruction says anyway, just in case..

  7. I have read it, and did not see anywhere where I would need an employment letter. Does anyone see anything I don't see there?

    Thanks!

Greenbaum gave you a link - just take a look,
Here is another one, also from the website of US Embassy in Kiev.
Read careful p.6 "EVIDENCE OF SUPPORT": ".... Documentation regarding financial support can be in any form - preferably one year of tax returns, w-2, bank statements, earning statements, letters from employers ..."
For my K1 interview I had the last Tax Return, along with W-2s, bank statement and letter from employer.
    Good luck!
  8. Ok. About those 4 digit numbers: they are the code of territorial agency or unit of Ministry of Internal Affairs, which issued the passport for travel abroad. I was hoping to find something like "list of codes of those units" or so, using 4 numbers in my passport.. But, no luck, sorry..

So, in your case, I would write the city your Fiance had to go to pick up his issued passport. If it was Bilyavka, I would write Bilyavka, Odessa region, Authority XXXX..

  9. looking at my DS-160.. Yes, for some reason i printed it out and keep it... Don't know why ;)

    I wrote:

1 Country / Authority that issued - Ukraine

    2. City where Issued - Kiev

    3. Country/Region Wher Issued - Ukraine.

Could you write those 4 digit number?... I'll try to figure out was it Odessa or Bilyavka?... Usually those numbers it's a code of area..

  10. Are you sure that I'm suppose to register after I get my GC ? Can anyone else confirm this ? From what I've read as soon as you enter on k1 you are no longer a non immigrant and are required to register.

I tried to do it online, but it wouldn't take my SSN, so I will do it by mail, if they deny it ok if not even better.

My son (K2) visa was warned about Selective Service during his K2 interview. As soon as he got his Social security number, he registered with Selective Service.
He had the same problem - the system "didn't recognize" his SS#, so son did it via regular mail.
Within a month or so he received a letter (confirmation about his registration) and card from them. Since then he can see his registration on line also. And no more problem with reading his SS#.
So do it right now. Good luck!!! :)
  11. Thanks for your replies.

Well, we only had few days to file for the AOS. We were advised not to file the AOS by the USCIS local office since they want to get more information on what is the best way for adjusting my son's status. I understand that the AOS should be filed before the K2 turns 21 so his age will be "frozen". After that, we cant file I-485 for my son anymore.

Aaand, after 2 long weeks of no response from USCIS mainland, we were advised to file for my AOS first then I should do concurrent filing for my son after I recieve my green card.

This is stressing me out big time.

Your understanding is incorrect here. There is no any other "the best way " for adjusting your son's status. He entered the country as a K2 visa holder, so this is the only way for him to file AOS.

Your son's age has already been "frozen", at the moment of his admission in the United States. 20 years. You should've filed son's AOS along with K1's AOS. So just do it now, ASAP.

  12. She most likely will need only passport to leave the US, but on her return flight she MUST keep her AP (EAD) along with Ukrainian passport and copy of Marriage License as a proof of her new last name . I also would suggest to have the copy of NOA1 of her I-485. She will be asked for AP (EAD) at every airport, even during check-in in Ukraine. Also, if after arriving to the US she has a domestic flight, layover between flights should be about 3 hours because she will be "invited" for the second interview. Nothing to worry about, just some airports too slow processing the AP or can be busy at that moment and you never know how long it will take to go through custom.

It took for me 40 min in Minneapolis and almost 3 hours, coming back trough Detroit..

    Good luck!!!! :) :)

  13. Hi.

I'm not sure the request to expedite I-765 really works at the moment you filed your I-765...

If you already have your I-765 receipt number, make a phone call to Customer Service with inquiry to expedite your Employment Authorization. They will ask you a reason to expedite. Pick financial loss (pending job offer). They will give an inquiry number.

You will have a confirmation of your service request the next morning via email, or within 5 days (some times it takes longer) - if it's going to be a regular mail. Also in this email/regular mail they will tell you the STATUS of your service request - denied or under review.

If it's under review, you will be asked to fax proof of your Financial loss, such as proof of a pending job offer. All documents should be submitted with an official letterhead AND - be ready to fax it quick, at the same day you received an email or letter. After this your I-765 status should be changed within 72 hours (card in production).

My son and i (K1/K2 AOSs) have done this recently and had no problems. Our I-485 are still pending :( and we had to renew our EADs. We are both full time employees and we requested to expedite our I-765s to keep working without any "pauses".

I received an email, son - regular letter. We have sent cover letter and letterhead facsimile along with proof of current job.

    Good luck :)

  14. Schedule your medical first. Once you know that date then you can schedule interview. More than likely you won't wait long for a open date to take your medical, but it wouldn't be unreasonable to expect 3 weeks, a month, maybe more before there is a available interview date. So you see your medical will be done (assuming there is no problems) long before your interview date.

Sorry, I was going to tell you to further answer your question....the medical must be done first as you will receive a brown envelope that you will present to the officer at the time of interview.

Be sure at some point soon complete the online form DS160. Call clinic to make medical appointment. Interview can be scheduled online or by phone. Sometimes a sooner date MAY be available when speaking with someone versus online scheduling. Pay associated fees....

Good luck. Any question...feel free to ask.

  15. Tell please. Did u schedule first interview and then medical exam? how to do better? will it be a problem to schedule first an interview and then in suitable date a medical exam or do better scheduling medical exam and just then interview?
