  1. Having some issues getting the whole post to copy correctly, but here is my info:

    No biometrics. According to USPS Informed Delivery I was supposed to get the approval letter in the mail on Saturday. It never came somehow, but I did get my new green card in a separate envelope today. 

     

    A nice surprise to end the year. Hope everyone else will get good news soon!

  2. I struggled with the same question, searched all the different topics I could find on this forum, and ended up buying the Patriot America plan through ***removed***. I never had to use it so I can't vouch for how they handle any claims.

  3. I received my EAD/AP in March last year. Hadn't heard anything about AOS interview by October so I planned a trip home to see my family. Of course, a week or two later I received a letter with about the AOS interview (date was while I'd be out of the country) Called USCIS, sent them copies of our tickets and a letter stating I would not be able to make that date. The website then said my AOS interview had been cancelled. Received a new letter a month and a half later with a new date, and went on the rescheduled date with no issues. Even talked to the USCIS officer about it during the interview and he said it was no big deal.

  4. Back in early November I had to reschedule my AOS interview because I was going to be out of the country on the day they had sent me a letter for. After I called them and mailed them proof, the 'Check your case status' on USCIS website showed my original date had been cancelled, but I did not receive a a letter in the mail until early December, with a new interview date for the last week of December. So yeah, I don't think you have anything to worry about, just give it some time for the letter with the new date to appear.

    I was also worried that I hadn't heard back by the interview date, but was told on the phone by a rep that I would hear back as soon as a new date was scheduled.

  5. Hi everyone,

    I have some questions regarding renewing my EAD.

    My situation: I filed for AOS/EAD/AP in early December 2014, and waited for almost a year to have an AOS interview scheduled (November 10th). Since I was out of the country that week (went home to see very ill grandparents one last time), I asked to reschedule my interview, which was granted. Early December I received a new date: December 23rd, 2015. I went to Denver for the interview and at the end of the interview, the officer said everything looked good, but that he was missing paperwork (routed to another USCIS office?), and could not approve my green card just yet. This came as a shock, since all timelines I had seen usually reported receiving approval the same or next day. I asked him how this would affect my EAD, since it expires February 11th. He said I would hear something within the next 2 to 3 weeks, so not to worry about the EAD.

    However, as I'm sure you'll understand, that's hard not to do. I've been employed since April and just got promoted in December. I enjoy my job. I had never considered having to renew the EAD since I received the interview date and did not expect any hiccups with the Green Card (stupid, I know..). Now my options are to trust the officer and wait another week and a half to see what happens, or to prepare a new I-765, sent it in, and try to get the application expedited based on the circumstances (job loss -> financial hardship?).

    Has anyone recently had success getting their EAD renewal expedited? Should I just call USCIS as soon as I receive a notice that they've received my package, or also get my local congressman involved (any tips on doing so)? Any suggestions about proof that I can sent to avoid an RFE (I was thinking about a letter from my boss as well as financial documents regarding the importance of my income)?

    Lastly, I haven't heard from the HR department yet about the looming expiration date. Should I contact them? Do I get in trouble if I work beyond the expiration date, or is it the employer who gets in trouble?

    Thanks in advance for any comments. This community has been great for getting through the K-1/AOS process. I thought most of the frustration was behind us, but not just yet :(

    Hi! Sorry for missing your earlier messages. I'm actually scheduled to interview December 23rd (had to postpone in November because I was out of the country). Totally forgot to add the date to my timeline. Will update it right away :)

    But yeah, considering my original date was in November, 11 months seems to be the window right now... hope you'll hear something soon!

  7. Hi everyone,

    I've been waiting on my GC since early December. I'm planning on traveling home to see my parents and grandparents early November, because my grandparents are not doing well. I have the EAD/AP combo card, but I am confused about how to use it. Icelandair wants me to fill out the APIS page before my flight (Advance Passenger Info), including my passport details and visa information. Obviously AP is not a visa, but I doubt they'll let me on the plane if I just show the the card when I get to the airport for my return flight home (I'm guessing most people are probably unfamiliar with AP cards).

    Someone suggested getting an ESTA so they let me on the plane, but then just use AP upon arrival in the U.S., but that seems like a bad idea? Should I just send an email to the airline to confirm how they handle AP Cards and print it out? Hope there are some people can share their experience how to use the AP card (considering APIS) and how airlines respond to it? Thank you!

  8. Good news guys, as of September 23rd, 2015 I have been scheduled for my interview in the Denver office for October 27, 2015. I originally presented my paperwork November 17, 2014 and was ready for the interview to be scheduled by january 15, 2015.

    What I don't understand is that they are asking a lot of paperwork that I have already submitted with my original presentation. Is this normal? Do they need more copies? Or is it standard letters that they send out that contain everything that they might need if not presented yet?

    Congrats, glad to hear that! My NOA1 date is December 9, so 3 weeks after yours, so hopefully I'll hear something in the middle of October then. Was there any issue with your medical exam? Since it's been over a year sine the medical, I've been afraid they'll make me take a new one. Not that I wouldn't pass it, but they can be quite expensive.

  9. I think you can sign it. You're not "excluded" from benefits.

    I hope that helps. I think you're confusing eligibility with exclusion. You can't collect medicaid until you've worked 40 quarters anyway, which I'm pretty sure is the same amount that it takes for your sponsor to be no longer financially obligated for sponsorship. Either way, this isn't really an issue of the i-864. They're asking if you're on a specific list of banned people, which is a common question if you want to work in the healthcare industry.

    I recently received a notice that my EAD has been approved (still waiting on the actual card). I decided to start looking for jobs, and on one online application (for healthcare sector), I have to sign an affidavit which includes the following statement:

    "I certify and agree that:

    1. I am not currently excluded by the Federal Government from participating in federally funded programs, including Medicare, Medicaid and Champus.

    I am confused how this relates to the 'public charge' issue. I arrived on a K-1 visa and understand that my wife (who signed the I-864 as sponsor) is liable for "repaying the cost of any means tested benefits". That technically means I am "excluded by the FG" right? So I can't sign the affidavit? Or am I interpreting the affedavit/I-864 responsibilities wrong here?

    Any help would appreciated. Thanks :)

  11. I am just nervous about the interview at this point. I don't mind the fees at all. I just him to be here already. Longest week ever. Next thursday its his interview. I have travelled back and forth for the past three years. I have lived with him in Albania for a year. We fulfill all the requirements so we'll just have to wait and see :(

  12. Yes, that's true. I believe the guide was written when the I-94 was a paper-based system. I waited because I was reliant on my husband to be free to drive me to the SS office.

    I know of a few others who managed to get their SSN the very next morning after their POE. If you are too busy preparing for the wedding, then it will have to wait. Otherwise, if you have the time and the SS office is nearby, might as well pop down there. Then that's one more thing checked off. If by any chance they say that a manual verification is required, just say that you'd rather come back the following week - manual verification can take weeks.

    As an aside, the SS5 form doesn't ask for your marital status. So you don't even have to say that you are married, which means that you shouldn't need to have the conversation about K-1s (magically) becoming K-3s.

    I'll go give it a shot right away then. Like you said, if they can't do it, I can always pull my application and come back a week later. Thank you!

    1. Declare as a visitor and list your items as "household goods."
    2. Yes, that's fine. Though you may get an SS employee who thinks you magically become a K-3 on marriage (they'd don't) and don't qualify for an SSN. That's why SSN then marriage is still normally advised for guys or either gender when a name change is not involved because it minimises any issues at the SS office. Just make sure you bring all the information listed in the VJ guide, including the web page print out saying that K-1s are allowed to work (with authorisation). Why do you have to wait 7-10 days to apply for the SSN? If your online I-94 is available and includes your latest arrival, just print it off and head to the SS office first thing in the morning.
    3. I've seen some people get RFEs asking for information about assets and/or a joint sponsor because the initial review officer uses the 2013 tax return as the basis for their decision (when the sponsor didn't make enough), even though the pay stubs and employer letter shows that the sponsor makes enough for 2014. You can send the AOS package as you've described and risk the RFE. You might or might not get one depending on who reviews your case. Or you can wait until you've filed her 2014 taxes. Downside to waiting is that you become out of status when your I-94 expires - while the possibility of deportation is slim, it still exists. Once you get the NOA1 for AOS, you enter a period of authorised stay while your application is pending. Plus, if you file your EAD and AP at the same time, the fees are waived for those two applications and you could then work and travel internationally when your EAD/AP combo card arrives, without jeopardising your AOS and while waiting for your green card.

    Thank you very much, that's very helpful. The only reason I wanted to wait 7-10 days was because the SSN guide says: "You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the USCIS." I read in your POE review you waited 10 days for this as well?
