Luluhilweh got a reaction from haboosh in Can I visit USA on my tourist visit visa and I am on administrative process for my immigrant visa?? Please help
    Hey haboosh,
I know youre well aware of my husband's long AP and details
We have experience when it comes to this-everyone's experience and therefore advice will vary but I can tell you from first hand experience that in our case it was impossible to prove that my husband has no intent to stay. Initially before I had petitioned for him on his first trip back to the US after we were married, he came into POE like he normally had in the past. after few hours, they denied him entry. I spoke with Border control supervisor and she explained that although I had a ticket to return with my husband and we say we have no intent for him to stay on his business visa, she isnt convinced. She said he is now married to a US citizen whereas in the past we were only engaged so now he would have a higher intent to stay. That doesnt make sense to me personally because w would never risk that knowing that I will petition him in the future but he was turned back. So although you say they're 2 different visas and not connected, on the contrary-they're very connected once youre married to US citizen. The consular officer explained it to my husband later on in the process saying that once you married, that shows even higher intent to immigrate obviously. So more than likely at the airport, the officer will not be convinced and turn you right back around on the next plane. However, Im only speaking from our end of the experience; I have read here on VJ stories of couples who did the same and the alien spouse was allowed in with no issues even after their petition was pending. So it all depends on your luck with the officer at POE, the consular said thats all it comes down to most of the time. It isnt illegal to try, but be aware as another poster was informing you: it does affect the case somewhat. If you are denied entry, later on in the immigration process, the consular section will request records of that denial from the Border control responsible for the airports. This may very well take months, even years to extract from them and therefore lengthens your Ap process. Consular section wont issue visa without first seeing this record as to what happened that day and details of why you were turned away. Sorry post is so long but I like to arm people with as much as real knowledge as possible to save people the headache of assuming.

I know the waiting is hard. But with everything I have been reading lately... we should start seeing some movement in october with the service center (NBC) saying september 28 is the day that they will start things moving with i 130. I have not been waiting as long as you, I have been waiting 4 months..soon to be 5 and I have braced myself for a long wait. With our husbands being from where they are, it will be a longer wait, and pray that we do not get put into AP. I have a friend who has been approved, but then put in AP for 6 months and still waiting for visa. If anyone else knows more, please chime in! Best of luck, and I hope it goes faster for all of us when they start up next week!

If only our congressmen and senators really gave a damn. They just perform their standard inquiries and responses, and sometimes attach the word "unfortunate" to it. If I get that kind of canned response, I surely won't forget it during the next election. I suppose we can't expect to be on their list of priorities, but year-long wait just to get permission to apply for a visa to bring a spouse over to our nation of immigrants is a bit outrageous, right? How long are they willing to perform these basic inquiries before they are willing to act on our behalf?

What a joke!! USCIS should be embarrassed of keeping USC away from their families that long. But no one cares enough to come up with a fix. I will be filing in few months and not looking forward to play this waiting game...

We are in the very same circumstance.... they kept his passport as well.. they needed one document from us and that was it... we were also told it was mandatory ap and when we called dos the other day they said it was for standard review. The CO told my husband a minumum of 45 working days.
I wish you the best of luck... AP is a depressing thing to go thru as there is nothing we can do to speed it up and nothing we can do to get real information as they wont say anything but pending....

AP is something with indefinite time period. It varies from Embassy to Embassy and country to country. NO one can predict the time it will take for them to end AP. Unfortunately, I call it the black hole the limbo stage. Keep praying that it would be over soon. In Sha'Allah it will.
