MangAntipolo, I just called the USCIS 2nd tier person and told me that my case was sent already to NVC but they sent it by Batch so the estimate for NVC to incode my Case in the system will be last week of October or if im Lucky early October... so lets cross our finger for Good News this October...happy.png

    Good for you. I also spoke with a tier 2 agent earlier. She made a service request for CSC cause she can't locate my husband's files (huhuhu!) but I got an email reply from CSC few hours after. It says, "On August 29, 2013, your I-130 petition was approved and will send to the National Visa Center soon.". Wish you all the best! Please please please keep me posted in your journey.   2. That is a different issue. If you think your case is talking time to process you need to contact your congressman/woman/Senator. They can help you if your case is at USCIS/NVC. For F2A even if I-130 gets approved, it can sit there at NVC and no politician can help or do anything because NVC won't even touch the case if visa bulletin is not current which is not the problem in your case. LPR's are scrutinized even more because spouse of a LPR is not an immediate relative where as spouse of US citizen is one.

    I would love to see statistical data that basically shows that US citizens had to wait really for a long time to get their K-1's, IR1/CR1, K-3 than a F2A holder. I don't think that is the case since spouse is an IR and that is the whole purpose of it.

    Second, US citizen can bring their fiance on a Visa, spouse on a visa. Nothing like that exists for spouse of LPR. Until their interview at the consulate gets approved, they cannot visit U.S on either a visitor visa or even come and study here on a student Visa. They just have to wait.

    I hear and understand your frustration about processing times but the best you or anyone who is waiting can do (if they have waited for a long time) is to contact your congressman and Senator and trust me it works.

    When i got my LPR through the employment based category USCIS screwed up my PD and some one made a data entry error. I had to file FOIA, contact my cognresswoman to fix the problem and fortunately i got my green card in 10 days after contacting my congresswoman. So please do talk to your congressman/Senator.

  3. The USCIS website will not give you any updates regarding transfer to NVC. It will just say Post Decision Activity.

    Before you can access CEAC, you'll need your Case# and IIN. https://ceac.state.gov/ceac/

    Call NVC to get real time updates whether they have already received your case file or not.

    Use MagicJack app for iOS and Android phones/devices so you can call for free over WIFI.

    Oh! Thanks for the clarification apple21. It helped a lot. And no need for MagicJack etc cause I'm here in the US (I'm the petitioner). Been calling NVC every once a week but sadly they don't have my husband's case yet. Not shocking though since almost everyone who got their NOA2 recently took more than a month 'til NVC receives their case.

    though, I think u r being well ahead of the game...its only 2 weeks since your NOA2. relax. My opinion - I wouldnt contact anyone if its just two weeks. The i130 is probably in NVC in a big pile in a box waiting for someone to pick it up and process. Good luck.

    Thank you for the link. Yes I know it's still too early to ask for help. I just wanna prepare in advance just incase a month had pass and still no info from NVC.

  5. Hello dear, I live in CA too particularly in San Diego. For general instructions: find your region congress man/woman they should have websites where you can find a release form to fill out. Then you'll need to fax this form along with your story (a brief story telling why you think they should help you speed up the process). One of their staff officer will review it and contact you within probably two to three weeks.

    From my personal experience, I would say its not worth it. A senator's voice can be very helpful in the USCIS level but not in NVC. I contacted Barbara Boxer, I called her office two weeks later the secretary advised me to send my inquiry to my regional senator, Susan Davis, since they have sooooooooo many cases to be reviewed at Boxer's office in Oakland. I did contact senator Susan Davis and based on the extreme emergency my husband is in crying.gif they accepted my request for help. I received a call from the senator's office, the guy was so nice told me exactly when my case arrived at the NVC and said its going to take two weeks to be in the system then he would call them again to make sure they process the case expeditiously. I was extremely happy and thought everything would be great!!!!! The guy called NVC again asked for expedite the request was sent to US embassy, and they refused it cray5ol.gif by the way I provided many proofs and threat letters + Santor's request (But the truth is WHO CARES) nobody cares especially embassies! The NVC representative was so sorry for me though cray5ol.gif

    Aww that's just too bad. :( Well atleast you are a step closer. I mean atleast NVC already has your case. I live near San Francisco though. Will try to contact a congressman or senator office in 2 weeks more if NVC still doesn't have my husband's case. Best wishes to your hubby's visa application.
  6. Having recently gone through this (and living in CA) I might be able to help. I called Diane Feinstein's office and was told (this was about 6 weeks ago) they are not taking any more requests for assistance - overloaded. So, you can try Barbara Boxer's office. You are more likely to get quicker action from your congressional representative, however.

    Suggest you call USCIS and speak to a tier 2 IO. The CR that takes your call will tell you to wait 8 weeks. Ask to speak to a tier 2 IO. You need to find out where your file is located; you may have to be persistent but they can access this information.

    Once you've figured out where your file is located and if it is in the LA office you can schedule an Infopass Appointment. No sense going to the office without an appointment, they will turn you away. Once there explain the circumstances and all the calls you've made to track down your file.

    You should have copies of your NOA2 when you call USCIS and when you go for your appointment. Take good notes during each encounter.

    Different visas seem to take differing amounts of time to travel to NVC. Our visa (CR-1) took from May 29 to August 6 but that was only after I made a dozen calls, visited the LA office (I tracked down our file to that office), and sent an email to USCIS. It was the latter that did the trick - after being in a black hole for two months our file was sent to NVC within 24 hours of that email - sent to NVC on a Friday and received on a Tuesday. Funny how that works...

    Agree you need to wait a little longer but be prepared to work the phones, etc. in another couple of weeks if it hasn't shown up at NVC.

    Thank you so much for your reply. But I live 8 hrs drive away from LA. I'm here in North Cali near San Francisco. Will take your advise after 2 more weeks. Hope NVC receives our case by then.

  7. Hi guys! I'm the petitioner and I live in Daly City, CA. Just wanna ask who or where can I find a congressman and/or senator (though I much prefer a senator) that could help me with my husband's F2A visa application. I received the NOA2 approval last Aug. 29 and still up to now NVC doesn't have our case. I know it's still early to ask help but just incase 8 weeks had pass and still no reply from NVC atleast I have the documents etc. to be sent out to that congressman and/or senator. Thanks! Your reply is very much appreciated.

  8. I have same question as some have written-- got your NOA1 on 8/12 and seventeen days later got your NOA2?

    That certainly would be AMAZING and would make many many many readers HOPEFUL for something faster than the normal 3 to 4 month wait-

    is that the facts? if so could anyone venture to guess WHY such a large disparity in time lines--

    If this is correct I congratulate you on your lightning fast approval and would like to know for future references what you included in your package for it to fly through.

    I was very surprised too when I checked USCIS website (still dont have the hard copy of NOA2 though but website says it's approved and mailed the NOA2 last 8/29). As to why they approved my application for my husband so fast that I also dont know but a lot of other Aug 2013 fillers has been approved as well. And to your last question, i only sent the ones listed at the USCIs website for F2A for spouse.

    Hi. You can only send the i-130 either in Phoenix or Chicago Lockbox (depends which State the petitioner lives at). Once sent to the correct Lockbox they are the one who will send your I-130 to either California or Vermont Service Center for review. You CANNOT send it directly to any of those Service Center.

  10. I am a Permanent Resident married to my spouse who lives in the Philippines. My problem is that my spouse father's name is RICHARD RALPH (2 given name) which is shown on my spouse's birth certificate. However, our marriage certificate shows RICHARD only as my husband's father's name. Will this affect my application for him under F2A? Will they possibly deny my application for him because of this? Your response would mean a lot to me. Thank you.
