Based on that ruling, the most they can accomplish is an order allowing ICE agents to formally initiate removal proceedings against DREAMers they happen to encounter. DREAMers=DACA Applicants.
Once in detention, they can still file DACA for relief.
There's a million lawyers wanting to facilitate that - just fyi.

We have looked through all options as there was several who were offended at the blatant political push to create more democratic voters. I understand your sentiment.

The problem is that none of this is unconstitutional.
To a judge, the fact that your spouse is facing an extraordinary delay in getting a visa is an imposition at best.
It's not a violation of the law.
His/her rights were not denied and the fact that he/she is supposed to legally be prioritized but isnt proritized is something that does not qualify for a class action lawsuit.
A governor who wants to protect his state from Obamacare can tell Kathleen Sebelius to take a hike (like Rick perry did)
But you can't do that with immigration - because its solely under federal purview.

HI everyone!!! i just want to share my happiness and give hope to those who still waiting for approval, first thing in the morning i keep on checking my case status, and i cant believe that our case is finally approved!!!!!! i read a lot of negative post about how backed up those service center, my husband filed our case november of last year and this 19th of this month vermont service center already approved our case........i know its still a long way to go from the approval but at least a new beginning of the process is about to start. So for those who still waiting for approval just have faith and pray the approval will come soon just have more patience, may God lead and guide us all in our journey and new life with our love ones soon.....good night everyone!!!!

This means I will have mine end of next week. That will be possible only if there are no further snow days. First I 130 then AOS then VAWA and now NVC. God have mercy.

I slept through the texts I got at 10pm last night but mark us as approved also!

The only way to get this moving is to file a class action against the Obama administration. A court case with the petitioners being US citizens who rights are being violated because of Obama's executive order DACA is the best way to go. It's an election year and immigration is a hot topic. The court case will get huge media attention.

We'd have no basis to sue. If we're going to complain to anyone, it has to be to the USCIS and our representatives in government. It's the USCIS that chose to process the DACA filers instead of us.
Do you know your rights under the US immigration law? Do you understand US citizens petitions filing for their immediate relatives legally are supposed to come first over all petitions. Do you understand Obama's DACA executive order is illegal because it is unconstitutional. Do you understand what is happening to our petitions is illegal? What do you mean we do not have a case? Please.

I-130 -- Approved today at 6:45 PM (Pacific time) from TSC (transferred date 2/7, PD 8/12/2013 ). Thanks for all your help/support and more importantly, the information you all provided is awesome. Thanks to waiting____ for guiding me to come to this August forum.

So i called USCIS to speak to a tier 2 and ask if they can tell me the date my case shipped out. Tier 2 says that they will not have that info in the computer and no one will know anything until NVC receives the case!
These people are either seriously DUMB or just liars!!

Guys, I'm sooooo happy. I got approved!!!!!!!!!!! The email came in at 10 PN cst tonight!!!!
Today finally has come!!!! Best of lucks to the remaining transfers. Hope you guys get some good news by the end of Feb.
Off to NVC for me!

Dear Petitioner who expects any sort of expedient resolutions for you uncomplicated case.
Your I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE, OR ORPHAN was finally transfered to Southern California Or Mesquite, TX, and is now (sort of) being processed. You will be notified by mail when a decision is made. or if the office needs something from you. We apologise for your wait, really wish we could do more but who are we kidding. Naaaaaa.
The new office has jurisdiction over your case and we will send you a decision at an odd hour- or if youre super lucky a frivolous RFE to which we will take forever to respond to. As soon as processing is complete or you will be notified if further information or action is needed. Then it will take forever to get to the NVC so don't think to yourself that its all over

I want to congratulate all the new transfers and specially the approvals....way to go August!

Just cause that is how the USCIS rolls........don't let it bother you. It happened to all of us. I got 5 text and 3 emails when I got my transfer. The transfer date changed from 3rd the 5th on one of the emails and then got the "your petition has been transferred to your local office". I means nothing.
Just wait for the hard copy in the mail. It will tell you the Service Center it was transferred to. I got my approval a week after my transfer. So no worries, be happy. The ball is rolling now!

when i called they told me so much WRONG info....first they told me i was transferred to lee summit then they said i was transferred to local cleveland office then they said they couldn't tell me since the transfer info wasn't in the computer system......
finally the paper copy confirmed i was sent to CSC....just ignore their misinformation!
