Different circumstances. AOS from K-1 with a marriage within the 90 days does not need an I-130.

    Not your decision to make.

I-765 and I-131 for the child should be done as well. No fee and no reason not to request it.

    Thanks for the information.

Could you please also help me in understanding, that if I need to put 1 or 2 in the form I-864 Page 3 Part 3, when child is also involved.

Child's name has not been mentioned in part 2 of the Form I-864 and that is why I am getting confused.

    REF: https://www.uscis.gov/i-485 , Filing fee

You need to review the USCIS I-185 link given above, there is a lot of useful information. In addition, you should also review:

    https://www.visajourney.com/content/k1k3aos/ (check the required forms)

    https://www.visajourney.com/content/k1aos/

    https://www.visajourney.com/content/k2-visa-adjustment-of-status-tips/

    https://www.uscis.gov/forms-filing-tips

For both K1 and K2, when you file AOS (I-485), you should also concurrently file for EAD (I-765) and AP (I-131), see Special Instructions in USCIS I-485 link above, for details and rationale.

Good luck on your immigration journey.

    Thanks for your response.

I am kind of still confused and apologies for the same.

Why some websites mention that I have to use I 130 also......Like below link

My fiance entered US with her child on August 14, 2019. We got married in August 28, 2019.

I do not want her to work here.

So, please let me know if I am doing this right or wrong.

I have filled below forms and hoping nothing else is required.

I 864 (one form for both mother & child)

    I 485 (separate for mother & child)

G 1450 (separate for mother & child to make payment by credit card)

I 131 (for mother only, child is not required to travel outside until Green Card comes)

    G 1145 (separate for mother & child)

Please let me know if I am missing anything.

  3. Hello All,

I have received a lot of help from this forum and it has helped me so far.

    Need some more help here.

    I have i 485 completed so far.

    1. After getting married in US on K1, do we need to file I 130 form & I 485 Supplement A form?

    2. Also, do I need to fill i 485 for the minor child also.

    3. I am also confused about the fees. The child is not 13 years and 2 months. What fees do I need to pay, as its confusing in the instructions. It says child under 13 pays different fees and child over 14 pays different fees. What about between 13 and 14 years of age ???

  4. I checked the status of my wife's passport today morning i got an email "The current status of your passport is Picked Up.", called help desk they said its being shipped to my pickup location.

after few minutes in checked again now i got email as "The current status of your passport is Origination Scan.", that made me happy

just out of curiosity i checked again this time i got "The current status of your passport is Ready For Pickup."

again this time "The current status of your passport is Picked Up."

finally now "The current status of your passport is Delivered To Post.", i called and she said your passport is still with consulate, i asked her why so many statuses in few minutes she had no clue.

did any body else faced similar things, my wife will go pickup location tomorrow and see , but these people are useless. :bonk:

i am in the same boat. do you mind telling me how long it took after 30th November for your wife to get the passport with visa

  5. Dear Friends,

I applied for my wife back in Aug 2013 for K3 Visa. During that time, she was staying in Bangalore, India. She received her new passport also there in November 2013.

Now she has moved to Delhi, India.

I recently got an update from USCIS that our case has been transferred to TX Service Center for faster processing.

Please guide me what should be my next step to change her address and what address proof is required for this purpose.

    Thanks in advance.

  6. Thanks again.

The second link that you posted is a deadlink. Do you have a current link?

No you wouldn't send the I-864 (AOS - Affidavit of Support) at the I-130 stage.

Once your I-130 has been approved, your case will be sent to the NVC (National Visa Center).

The NVC will contact you to pay the AOS fee and you can then submit the I-864 at that time.

The NVC will also ask you to pay the IV packet fee and submit the DS-230 form

Read up on what happens at the NVC stage and also look up your wife's embassy in India that you will designate for consular processing and read up on their info.

  7. Terry,

Thanks a lot for your response.

I have seen some posts where members have mentioned to send I-864 also along with this packet. Is that advisable as I have not seen in any of the guide.

Welcome to VJ and congratulations on you becoming a United States citizen!

To answer your question - yes the last name should have read Smith instead of Doally at the bottom of the first page.

You (petitioner) and your wife (beneficiary) must each complete a G-325A and both should be included when sending the I-130.

Your G-325A is based on information relative to you and your wife's G-325A would indicate the proper information pertinent to her.

Ensure you sign/date your G-325 and your wife will need to sign/date hers and have it sent back to you.

When my husband submitted the I-130 and our G-325A forms we checked the box OTHER(Specify) and put I-130 instead of what the sample VJ form has checked off.

I would highly suggest sending in all the required supporting documents together with I-130, at the same time, to minimize the need for an RFE (request for evidence). Take your time when filling out the forms, review all the supporting evidence you need, and have a trusted friend or relative review everything before you mail the package.

There are guides on VJ on how to complete the I-130 for a spouse so take a look at those and feel free to ask specific questions if you cannot find the answer on VJ. Here is one that may be helpful for you:

  8. Hello all, its my first post and I am new to this website, joined today only.

I just got my citizenship 2 days ago and struggling to get the proper documentation in order to file for the Spouse Visa.

Hello, It seems to me like the form available as a guide on this link http://www.visajourney.com/examples/INS-Form-G-325A-aos.pdf is not filled in the right way. Please let me know if I am wrong.

The last block on the 1st page - Applicant: Print your name and Alien Registration Number in the box outlined by heavy border below

The last name should be Smith instead of Doally. Am I correct?

Also, i am confused, is this form is supposed to be filled by both of us. I meant, my wife is in India and one form is required to be filled by her with her information and she needs to sign it and then again, I need to fill the same form with her information and sign it and then send along with the I-130 packet.

Please also let me know if I can send any other documents beforehand to speed up the process.
