  1. So. Just an update on my progress.

     

    I received a NOA over the weekend. My husband and I signed the wrong spots.  He signed as the petitioner, which was my fault. I guess I confused myself because of when he petitioned for me to come over to the US. (Dummy me).

     

    Anyway, mailed it back, it was received, today. Two days after my green card expired.  I hope all goes through well. I feel sick to my stomach. 

     

    I do want to add that, when I mailed it off the first time, they literally started processing it like, a few days after.  I don't remeber the date that was stamped on my papers but, it was pretty close to the received date of the package.

    It has been delivered. It was in their po box the next day. I sent a money order.  I'll see if I can check if they cashed it. Thank you! :) that kinda makes me a little less worried. I would've put in that slip where they send you a text, to let you know they received it but, I forgot where I pulled that up.

    You mean the 16th of this month? You should be fine (so long as it is accepted / there's not a filing issue). USCIS goes by the date of filing, and grants a 1 year extension on the green card once filed. You may not get the letter as proof of this before the 16th, but it shouldn't impact your actual status.

    Thanks. That's what I was thinking. It says within the 90 day window, which, technically, I am. 

     

    I realize we should've planned better. But, that's really personal as to why we were late on getting this done.

  4. Just a quick question... I sent my application in, over night shippment, last week. I was cutting the deadline short.  My expiration date is the 16th of this month. Will I still be processed as deported on the 16th.

     

    I'm really nervous.  We have a son. And we really can't afford me getting deported.

     

    We fell in hard times and, it was extremely hard getting that extra 680$. That's why it took so long for us to do the application.  

     

    If I call the uscis center, would they be able to give me a update? 

  5. Yes, I wrote about it in this thread just a few posts above your former post. I had to get an Emergency AP when my dad got pancreatic cancer and had a few days left to live. Please don't spread misleading information.

    My information wasn't misleading. If you read, I wrote if they were filing for aos the AP card would come 90 days. If she decides to leave then (after she receives the card), she won't get a 3 year ban or ten.

  6. I came in on a k1. Im writing this for the misleading information. I didn't file aos until this April 2015 and we got married in June 2014. I eventually got my AP card. I crossed the border. I came back into USA, no issue. I know what it says on the noa but, I called and asked uscis and he said, if I have my AP card I can travel. I think there is an exception to some cases/visas..

    Anyways, when you file for aos, if you do, it'll take 90 days, if she is approved, to get her AP card.

  7. Okay so, I submitted April 17 2015. Notice date July 13th. The date I have on the letter I received with the card combo was July 17th 2015. And it's sent priority mail, so I probably got it 3 days after that date. Hopefully that helps and gives you an idea. I also received an interview waiver so, I don't know if that changes the speed of things or what.

  8. So. I read this thread. Scared I'd get a 3year ban because I was unlawfully here in the USA for 1.5 years.

    It even says on your noa about this ban. I called uscis and they gave me the green light to cross borders.

    I went into Canada and I was alright. I was scared coming back into the USA because I was unlawfully here.

    I got pulled in and thought that, I was getting banned. I wasn't and didn't. I think the k1 process allows you to be here while you wait for the process. The customs officer told me I will continue to get pulled in until I am done the process and he told me to give extra time if I have a flight to catch because you never know how long it will take.

    My poe was rainbow bridge. The room was full but, I don't think we waited long, 30 mins tops. Passport stamped and, I was on my way. No ban!

  9. Hey everyone! Been a while since I posted! Hope everyone is good!

    It's been 1.5 years since I been home and, I'm heading up to Ontario today! I'm excited but so nervous for the customs part.

    My mum will finally be able to meet her grandson and my oma will be able to meet her great grandson! We are staying until Monday and I'm praying I have no issues getting back into the US. (That's the part that's scary!!)

  10. I was denied and they don't notify uscis. Your husband can't put you on his health plan?

    I also would like to add. I was pregnant with our son and thank god he was a week late because we got married 4 days before my due date and I was able to get on my husband's health care just in time. I did see Obgyn here in the US and not back home where it's free.

    Something the doctor explained to me was since your pregrency is on going, your health care maybe be retroactive and cover what wasn't covered when you didn't have coverage (this obviously didn't happen in my case).

    When I got Medicaid for my son, they retroed his November check up when we lost coverage.

    On the side note, look into state coverage ad long as you're into the process of change of status you should get coverage and that you have a social.

    Good luck and congrats, health care in the USA is a disaster! It really needs help!

  11. I'm going back to Canada with the family this weekend. Haven't been home in almost two years and we have a 15mos old My mother hasn't met yet.

    Anyway, I've filed for aos- permanent res. When I cross into Canada they're going to ask for my USA status, what do I tell them?

    All I have is my AP. And a letter saying I might be eligible for a interview waiver and I'll hear from them in 6mos. I'll be bringing that letter with me. Just show Canadian customs that?

  12. Until you become a full fledged citizen there is never any guarantee that you'll be let in. It is indeed up to the officer. However, bring all copies of immigration notices that you have just in case.

    Thank you. I know I'm not guaranteed entry but, it would be stupid for them to deny me and then let my toddler go back home. What kind of officer would do that unless they're cold hearted.

    I plan on bringing my entire folder. Everything from visa process (k1) up to everything I got back from uscis. The last letter I got was the interview waiver and that, I won't hear from them for another 6 mos. And I'll bring my marriage certificate, since my last name changed. And my husband and child will be with me as well.

  13. She should not leave the country, for one, because doing so will abandon her AOS and she would have to do Consular Processing which means spending a long time abroad.

    But the saying that she will get a ban are wrong. Arrabally perhaps wasn't that widely known back in 2013.

    I'm about to travel and I'm a little concerned because I didn't file for aos right away. Like over a year and a half later. I have my AP card now. Should I call uscis to make sure I will be let back into the USA?

    I just don't understand how one can abandon their status, with AP card in hand. And isn't it up to the customs officer to let you back in?
