Moreover, they always "review" cases. Also doesn't it sound logical that they either approve or call for the interview if the packages is insufficient? Bottom line: what they say means absolutely nothing.  

    Just sharing what I was told. it's nice to hear an official encourage and attempt to give what info they can instead of telling me they don't know anything like they do at the call centers.  He gave me a glimmer of hope and at this point, i'll take it.

  3. Hey guys! Haven't added my info to the timeline yet, if someone can do it that would be great! We sent our packet on sept 12, 2016 got out NOA on September 24, 2016. We had our bio appointment on October 14, 2016. California service center. Just had our appt for our I-551 stamp. The agent told it it's taking about 15 months to process these BUT that our case is showing in his system as currently up for review and that depending on how much and what proof we sent with our packet they should either be sending the card or send a letter for us to interview at the USCIS office.

You are doing it exactly right.  It's only Visa fraud if you didn't return to Canada and attempted to stay in the US during the entire process.  You are also allowed to travel back and forth during the process, just make sure you bring plenty on proof of ties to Canada (letters from your employer stating that they expect you back on a certain date or rent or lease agreements showing you must return to continue paying your bills) Hope this helps!

  5. So I feel like the question of why the the service centers are suddenly processing so slowly is fairly clear. Remember in 2014 when there was the huge backlog at the NVC that delayed all of our i-130 approvals by months? This was caused by the NVC being inundated with immigrant visa cases from USCIS, as USCIS shifted its workload to focus on the backlog of stand-alone I-130 cases. The NVC used to receive approximately 8,000 cases per week. As USCIS continued to dig out of ITS backlog, the NVC began receiving around 25,000 cases per week.

    You guys remember, we all sat around on Visa Journey pondering (bitching/complaining/crying) about why is was taking 11-15 months to approve us instead of the 6-10 months we were told it should take. Yeah, well 24 months later we all filed or ROC's and they are experiencing that same sudden backlog with the same people all filing the same papers at the same time. It makes since when you think about it.

They probably wont need most of the things you're worried about but it is best to have it ALL, at our interview we brought in every scrap of paper we had accumulated and they didn't want to see any of it!! Honestly you've basically been approved already, the interview is just a formality. Take a deep breath and relax, you're almost through!!!!

  7. DIY, There is no reason to pay a lawyer to fill out the same paperwork you can fill out yourselves and hiring a lawyer will not speed the process up in any way. It may actually slow it down as they do not have the vested interest you do to respond quickly to info requests from USCIS. I can almost guarantee your lawyer will not be on the phone daily for case updates like most of us were.

    You will be applying for the CR-1 visa as you are married but have been so for less than two years.

    As for how long the process takes, you are looking at about 1 year, and though I also read that you should stay put during the process, my husband and I visited each other several times without any issues.

    Your wife and children do not need a visitors visa to visit you here, their regular Canadian passports will work as long as you do not exceed the 6 month/year limit. They should, however, as noted by previous VJ'ers, bring proof of strong ties to Canada as not to be rejected at the border and the father of your step-daughter should sign a consent for her to cross the border with her mother.

  8. Yes, he can go with you. I attended with my husband in October. I was not told not to talk to anyone, in fact I did almost ALL the talking at the first two windows as I am the organizer of the two of us and so was the one presenting all the paperwork that was asked for. I was, however, asked to wait in the waiting room during the actual interview (a whole 5 mins). Good luck!!!

  9. I feel like I should know the answer to this but does a CR1 visa give LPR status? I guess I thought as long as he was a canadian citizen then he would have healthcare through canada, at what point does this change? He has been here 6 weeks, do I need to get him US healthcare?

  10. We entered through Trudeau on November 1st. We arrived about 3 hours before our flight and still had loads of time to wait for takeoff. After the ticket counter you will go through security. The customs is a very quick process as most is done on a kiosk. Once you get to the counter you will be directed to the immigration section behind them. We were there on a Saturday afternoon about 3:30 pm. We were the only ones there. They ask for the packet that is given to you by the consulate at approval and go into an office to open it while you wait in the lounge area. They will call you in and speak to you very briefly and then you're on your way through the duty free shop and its all officially over! Fairly quick and stress free unless you are like me and lose your cell phone in the the security area! Good thing we did get there 3 hours early because that took a lot of time to locate!!!
