  1. Only the U.S. Citizen (the sponsor, petitioner etc) needs to show they meet the financial requirement. The Beneficiary could be Unemployed and never worked a day in their life but they don't care as long as the Sponsor meets the income requirements.

    Btw just a heads up K-1 and AOS have DIFFERENT INCOME REQUIREMENTS.

    Please check the 2014 Poverty Guidelines. For K-1 the sponsor only needs to make 100% of the requirement and as AOS you must make 125%. Most embassies knowing that you will eventually adjust status want to see 125% a lot of the time.

    You need to bring your US. Citizen fiance's/fiancee's proof of income to your interview:

    Signed Affidavit of Support I-134

    2013 Tax Return

    W-2s

    Paystubs

    Letter from Employer. (Optional; but it helps; paystubs and tax return should be good enough but the more evidence you gather the better)

  2. Yeah, sadly if you talk to 10 different people at the SS office it seems you'll probably get 10 different answers.

    I went to the St. Paul office yesterday after coming in on a K-1 a little over a month ago, where the gentlemen helping me told me that my K-1 gives automatically gives me authorization to work immediately. When I told him I was under the impression that a K-1 can't work until getting the EAD, he said that the EAD was only so that I could keep working between the time the visa expired (in December) and getting the GC. Obviously this was wrong, as the K-1 expires the minute you use it, and gives you permission to work. He was adamant that he "processes these kind of applications all the time" and knew what he was doing, but I didn't feel it would help the situation to tell him he was full of *&$@*! and had no idea what he was talking about. I only hope he hasn't done anything to screw up the process.

    I swear you guys must've gotten the same guy we did.

    My husband and I went to the social security office in St. Paul a few weeks ago to change my last name with SSA. We weren't intending to get him a SS number until after he had received his EAD. However after the three hour wait we got this real happy guy. He asked my husband where he was from noticing his accent and said England. And he said "You need social security number?" We explained he was on a K-1 Visa and that we were planning to come back and get him one after getting his EAD in a few months.

    And he said "Oh no he can get social security number now!" and practically threw a app and pen at him in a humorous friendly way. He also gave us the impression he could work after getting that SS card. But we knew better. We knew that he CANNOT work until he gets his EAD. We didn't bother arguing though just thankful he was getting a SS card.

    When he got the SS card on it it read "For Work only with DHS Authorization" meaning you need your EAD to work.

    Also the man who helped us had quite the accent so it was hard to understand a lot of what he said.

  3. Hello everyone. First of all I am the USC.

    I was just recently married to my lovely englishman last month. However I am not sure if I am supposed to change my W-4 or not?

    1. Am I required to change my W-4?

    2. If I am required, when do I need to change it by? And will I get penalties if I don't change it in time?

    3. If I am required, how do I do it?

    Also my last name has not been changed with my employer yet. I contacted HR about my last name change and marriage status they said they would send me a packet in the mail to change my last name and get him on my Health Insurance. Then I have to mail the packet back in with my marriage certificate. Should I wait till this is done before I change my W-4?

  4. So my husband and I are about to file for his AOS on Tuesday. A few questions first. First of all I've been told personal check is the best way to pay however I only have my old checks with my maiden name on. I would have changed my last name with my bank already but they advised me not to until my work changes my last name which the processing time for that takes a while. They said to do this to avoid problems with my direct deposit. Last name on both accounts must be the same.

    So I considered a Cashiers check but read people advising against it?

    My question is can I send a check with my maiden name? By the way my bank says I need to still sign with my maiden name as well.

  5. A blanket waiver is a waiver that is applied uniformly to a group of conditions and does not require a separate waiver application or fee to be filed with USCIS. In many cases, it might not be medically appropriate to administer a dose of a particular vaccine. Five Not Medically Appropriate categories are acceptable when determining an applicants eligibility for a blanket waiver.

  6. You didn't think through the questions I asked you when you said you want to get a new immunization form just in case the brown envelope got mislaid. I was hoping it would help you discover the reason that is not the most logical thing.

    Q: "Just in case" they lose the brown envelope, what else does it contain that he will NO LONGER be cleared on for AOS?

    A: If they lost the medical, not only would the immunizations be lost, but so would his clearance for TB, contagious disease, mental health, and all that was covered before by Knightsbridge. They can not approve AOS without the medical clearance. It is not just an immunization sheet they would not find.

    Q: What will he have to do to fix that?

    A: He will have to go back to the civil surgeon you already wasted $75 on and pay again for a full medical. Do you really want to drag out the suicide stuff again with a new doctor just in case? No you don't.

    So why not just mail in your AOS knowing that almost certainly your medical report including immunization sheet will be put in your AOS file. And if you are so very unlucky that his file got lost, then the $75 immunization sheet won't do a bit of good because the rest is still missing. The only way you know is submit AOS. They order your other file out of storage. If it is lost, they send you a letter saying go get a medical exam and send it in. Spend your money only if USCIS tells you there is a problem. Your chance of having a problem with medical things is very small because you know he had all the required shots plus a few rounds of unnecessary Hep A and Hep B just in case they were needed.

    Wait are you saying if we go in to get his vaccination paper done on the I-693 he will have to explain his mental health history with this guy too?
