  1. Hello everyone!

    I am currently working on my sons AOS. He came to the US a few months ago so I will be applying for his AOS separately from my wife and other son. I haven't done any 'visa' work in a while so I'm being reminded how much a pain all of this is again!!

    First, the filing fee I assume is 1185 because it is not with her mom's (she already has her green card), no bio fee correct? (He is under 14)

    Also, I wanted to make sure I have all the correct forms:

    I-485

    I-131

    I-765

    I-864 (copy of my wife's is ok right?) I read that a copy is ok because he is listed on the original K1)

  2. All K type visas are handled in Guangzhou unfortunately so there is no getting around that. My wife and I completed everything last spring and she lived in Shenyang so I completely understand about it being out of the way!!

    Try not to be too stressed about all of this. The stress will not help you in any way. Good luck!

  3. I always try to be careful when replying to posts like yours.... There is always 2 sides to every story. My heart goes out to you because I can tell you are depressed and down! Usually we all have things we could do differently to make our husbands/wifes respond more to our liking, yes?! Your wife is being a little unreasonable in my opinion. Worrying about having a wreck and insurance going up???? Hello!! That is the real world and we 'all' live with that issue but life has to go on. That is a stupid reply in my opinion. It sounds like you two need to address and deal with these financial issues because they will do nothing but get worse!!! I guarantee it!! Do you share any of these posts with your wife? Maybe you should?

    My fiance just received her approval at the US Embassy in Guangzhou, China yesterday. (-: I just wanted to let anyone who is new or thinking about doing the K1 through China that it took us exactly 6 months from receipt of NOA1 to interview approval. This was very fast to say the least and we even had a RFE back in November!! If you want a more specific timeline check mine out. I would be happy to answer any questions you might have or be of any assistance if needed. I didn't post anything during our process and I should have but I'm here now. BTW, we did use an attorney for most of the paperwork and I would highly recommend this. I couldn't justify NOT spending the extra money for this service considering how important it is but that is just my opinion!

    My fiance arrived 2 weeks ago today. I have been looking into getting her SS card and we have the SS-5 filled out but I'm confused about the I-94 form. My fiance didn't receive anything except her passport when she went through immigration in Dallas. Maybe I'm totally confusing the I-94 with something else? Can someone help me as to what this is? At first I thought it was the NOA2 form letter but after searching it seems like its the form you fill out when entering the country. Note: We do have her original birth cert so don't think we need anything else besides that, the passport and this I-94 thing that I'm confused about. Help!

  6. It took about a month for me to receive our case # but that has been changing some lately. If you call they will tell you to wait up to 8 weeks but it could be any time. I just made a habit of calling every 2-3 days. In the mean time, find out exactly what all you will need for the interview (tax return scripts, file forms, etc, etc) concentrate on getting all of that together so you will be prepared once you do finally get the case #. It starts to move a lot quicker now so be ready for that! A lot of people don't spend this waiting time getting everything in order and then its rush, rush after the case # is received! Good luck!!

  7. Hello everyone! I know the wait for your NVC case # is probably driving you crazy but don't worry, it will come. In the mean time, really start concentrating on your paperwork, docs, etc. Once you do finally get your case # you will be surprised at how fast everything starts happening, I know I was.... With that said, it seemed like things almost starting moving 'too' fast especially with me having to send all the signed papers to the Philippines, etc You have to allow plenty of time for stuff like that. You won't have to wait for any packet from the embassy as everything is online for you. All the petitioners tax docs for the last 3 years, etc, etc.... There is a lot of stuff to be getting ready and I've seem many people just sit around waiting for the case # then once they get it they are like 'What do I do now?' Ugh! Don't be one of those people!! Good luck to all!!

  8. This kind of situation (asking for a exception from the 2-year meeting) seems to come up every few months and while every situation is unique most people don't even come close to qualifying for the exception.

    1.Result in extreme hardship to you, or

    Violate strict and long-established customs of the beneficiary's foreign culture or social practice.
    In addition to establishing that the required meeting would be a violation of custom or practice,
    you must also veriff that all other aspects of the traditional arrangements have been or will be met
    in accordance with the custom or practice. Such evidence may include, but is not limited to:


    Statements from the religious authorities attesting to the practices, beliefs, and customs
    for the engagement and marriage.
    Statements from tribal leaders that establish that the meeting of the petitioner and the
    beneficiary is a violation of the tribe's customs.


    Note: Extreme hardship for YOU, not the person you are taking care of, etc, etc. Just because you are taking care of someone and have many notarized docs, etc doesn't get around the point that this is in no way a 'hardship' for you, let alone a 'extreme' one. I'm only looking at the requirements you are seeking to comply with and then you have all the other red flags that will do nothing but cause a denial of the actual K1 petition.

    You really should rethink your position on this and just find a way to meet in-person in the near future and then start fresh. You are looking at a VERY difficult petition for K1 coming out of Ghana as it is. Couples get denied there all the time with pretty solid petitions and no obvious issues. Not your fault so much fraud and problems have come out of that country but its a fact and you can't get around that. I will also add, 'one' visit is still pretty weak. I would recommend multiple visits over a extended amount of time for a more solid petition. I do wish you good luck!!

  9. After being a VJ member for almost a year I've seen this happen over and over again from time to time. Sometimes it won't show anything and then it will show you some strange update you've never seen before. Don't worry, give it a few hours or just wait till the next day. In our world of 'instant communication' and all of us wanting our loved ones with us as soon as possible we tend to freak out when something changes. Even though we are dealing with computers I always tried to remember that 'most of all' we are dealing with our beloved US Government so unfortunately just be patient and wait!!! ranting33va.gif

  10. Seems like every day someone is worrying about chat logs and its really not necessary to get all worried about it. While they are somewhat important, they are 'secondary' evidence. Personally, I sent in one page for every other month for 2 years (12 pages total) and I thought that was a lot. I would be more concerned with your passport, travel tickets, hotel receipts, phone bill records (all within the 2 year guidelines) and making sure you don't miss anything else on the required list. If you REALLY are worried use one of the K1 visa attorneys. I used one and know of a few others who did and didn't get ripped off and it made it much easier. Of course you can do it all yourself but, as you know, it can be very frustrating, etc. Pro's and con's for each method. Message me if you want the firm I used, it was very reasonable.   11. Just remember that chat logs are 'secondary' evidence. Your evidence of being together (plane tickets, passport stamps, hotel receipts, etc) with the 2 year period is much more important. I think records of your texts and phone calls over the same period of time as your logs are more important because your showing them your phone bill and history and its much more convincing. Of course you want to include them (chat logs) but sending hundreds of pages isn't really necessary in my opinion. I sent one day of chats for every other month for 2 years so I had 12 pages and I thought that was more than plenty. Good luck!!!

  12. Making an appointment will not 'force' them to do anything. Its all a waiting game with a lot of things that make no sense as I'm sure you know by now. In my case, after 5 months I wrote my congressman and that seemed to help as I got my NOA2 not long after that. You should be able to find the email address online.

    If/when you call USCIS, ask for a Tier 2 representative. You won't get much information from the regular reps.

  13. Just showing up at the embassy is a waste of your good time so I wouldn't do that anymore. Like everyone else has said, contact the NVC and don't stop till you get the answers you deserve!! Also, from what I've read and noticed the wait for the actual interview in Ghana could take a while so just be prepared for that.   14. I can understand your stress and anxiety at this point. My fiance went through her interview back in September and when I checked the case status it went from Ready, to Administrative, to Ready, then Issued after about 10 days. Give it at least a week. It can take from 7-10 business days to process, maybe even a little longer. Hopefully everything is fine and its just a matter a waiting a little more which is not what you want to hear but try to stay positive!! Good luck to you and God bless!!

  15. Sorry to hear that you got denied twice. We all know Ghana is a high fraud country and it's very difficult to obtain a visa. Can you give us more 'detailed' information so we can try to help you? Like what was your proof of ongoing relationship, any RFE's, etc? My finance just got approved through the Philippines and my 'stack' of evidence and records of trips, time together, etc was pretty large to say the least. You must have not provided enough believable evidence to satisfy the consulate?? (I'm just assuming) Make us a list so we can see what you provided and tell us what consulate said at 'both' interviews.

Sorry your having so much trouble, etc. I know you keep saying it isn't feasible for your gf to come see you (kids, etc) over but I agree with most of the other posters, she just needs to find a way to come see you or you both visit in a easier to access country. I believe your just going to waste a lot of time, money and energy trying to go the route you are pursuing BUT that's just my opinion also.

    I also don't believe there isn't 'anyone' here in the US who (at first) wanted to bring there significant other over here. (Come on over! I'll buy the ticket, etc, etc) but in the end its almost 99.9% the 'other' way around. With your first denial, its a very steep mountain to climb..... I do wish you the best of luck!!!

  17. Hi everyone, gosh, I hate reading all the issues my fellow Dec filers are having. Without pointing out specific cases, get your congressman-senators involved if you haven't already! That's a must for sure!!! My prayers are with ALL of you waiting!

    My fiance got her visa last week and we are just floating on the clouds. She will be arriving in October and I can barely stand it. It took around 8 months total from NOA1 to visa in hand BUT we have been actually waiting for almost 3 years to be permanetly together so I've always tried to remember that part and its helped through this difficult visa journey for sure!!!!

    Everyones day 'will' come, just try your best to stay strong, do what you have too and always remember 'patience' is the key (and I know no one wants to hear that but its the truth!!)

  18. My fiancé just went through her interview last month. There where many opening at the time but after hearing her experience and everything she saw happen with 'other' people I would stick to what you initially committed too unless you really need to change it. Also, I would attend if at all possible unless you feel 100% on your documents but that's just my opinion.... Good luck to you!!

  19. When you scheduled your interview it should have asked you a specific place 'option' for your visa to be sent too. Yes, if you gave your cell phone number you should receive a text when the courier is going to deliver. Of course, I was dealing with the Philippines but I would think the process is the same pretty much everywhere. Anyone else?

  20. My fiancé took the CFO seminar right after her interview so she is officially done with everything thank God!!! She has to leave back to her hometown tomorrow so we weren't sure if she would be able to get the similar in or not. Worst case, I was going to book a extra day in Manila before she leaves for US to get the class in but now that is not needed. Everyone out there that might be wondering, you MUST take the CFO seminar to leave the country, mandatory, period! Good luck to everyone!

  21. That too long it should be 3 mos to be approved the k1 what happened u reach 8mos?but any way congrats finally u are Approved.

    Hmmmm! You are sure your note confusing the Noa1 to Noa2 time period to our Noa1 to embassy interview approval?? 8 months from getting your Noa1 to Noa2 to NVC to embassy w/interview approval is excellent in what I've seen everyone else go through. I've never seen anyone do all of that in 3 months except for expedite cases.

  22. Not long after 5 months I wrote a letter to my congressman. I did receive a reply but I'm not sure how much it really helped as my case was one of many transfers to TSC. My fiancé just got her approval today and it was 8 months from NOA1 to approval at embassy. It might now seem like it now but it does actually happen for most people just put your trust in God and practice your patience.
