    I have just confirmed that my fiance that is an Italian citizen has been banned from a miscommunication as he was entering into the US in 2009. Long story short, he had a student visa but it had expired. He went to the US consulate in Florence to ask if he needed an extension to go back to California to finish his classes, but was told he did not need an extention and to just go and come back every 90 days and he would have no problems. He did this twice without any worry, but on the third time was stopped in Chicago and questioned by an officer. Once the officer discovered he was half Syrian (arabic) the officer sent him off for more questioning. It was decided that he did not have enough legal evidence to show that he was to leave the states after his allowed stay and he was sent back to Italy in handcuffs. This was in 2009. Now, we have had a relationship for over a year and a half and he'd like to return to the states, but I was told by numerous american attorneys and he was just told by the consulate (without him even getting to explain his story that he did nothing wrong - he never overstayed) that he has a permanent lifetime ban to the states and will be unable to go there. I am having a hard time with this as an american citizen because he cannot even visit with me - even if we have children. No one has given me any hope. I was told by a lawyer that applying for a fiance or marriage visa would basically be wasting my time and I'm at my wits end with this and don't know what to do. I want my husband to come home with me. Most of my family hasn't even met him. It's a terrible situation and anyone that has any information as to where to turn would be greatful.

    The other part? I have stayed illegally in Italy three times - the first because I was tricked by a company into staying becuase they were not paying me correctly and told me that overstaying wasnt a problem. The second basically for the same reason and the third, because I am afriad that I will be banned from the EU if they catch me. I am now trying to figure out if I can get married here before I leave so I cannot get banned. I heard this may work if we get married in a church but I haven't heard anyone confirming this - plus my fiance would have to convert to catholicism. My other option would be to go home for 90 days and then attempt to come back but I am afriad they may still catch me for my previous overstays.

    Again, if anyone has any advice as to what to do in this situation, it'd be greatly appreciated!

  2. You may actually be in luck because it seems that Texas seems to send them off to NVC a lot faster than CSC.

    We got our NOA2 on Oct. 1st and I waited till Oct. 15 to call and when I did - they had our case number and a day later it was being sent off to the embassy.

    We didn't receive a letter or anything telling us our case number - I would just wait a few days, and maybe call them sometime middle of next week.

    We called DOS - not NVC, because usually DOS has the same info as NVC and there is a lot less wait time on the phone.

  3. Hi guys!

    Thanks for all the support and help that everyone has provided on this site that has lead to our I129f petition approval. We got our approval email on the 17th of October from VSC to TSC transfer. Do you guys know how long will NVC take to receive the application to assign the case number. We have been calling everyday since last week (Tuesday) and they don't even have our case in the system. They keep saying to call back and that it would take upto eight weeks. Any ideas guys on the timeline. Thanks for any and all help.

  4. Hello everyone! I want to thank you all for the support in helping me get through our wait for the NOA2. Now, as I understand it, have to wait two weeks to call NVC and get the case number to start checking status online. Then, wait for Packet 3. Setup visa interview and provide I-134, medical and Police Report in New Delhi at the US Consulate.

    We will need an outside sponsor. Can a friend do that?

    Also, what are the other forms that will be in the Packet 3 that we should start preparing right now?

    We requested the Police Clearance in India today.

    I want to thank you all for your help and advice in advance.

  5. Well, if we happen to go over the 5 months wait what would you suggest doing? Calling or sending an e-request? It just feels like everyone in California got approved or got an RFE already and we've been left behind.

    Tomorrow's going to be 4 months and a week, feeling a bit down. :/

    Me and you are in the same boat. My NOA1 was also June 3rd and still waiting while everyone else around me is approved or RFE. My case hasn't been touched since the 15th of August.

  6. I am plain envious of all the June, July and August filers who have received their NOA2 s already. I received my NOA1 on June 3rd and am still waiting for the NOA2. My petition was transferred to Texas on August 15th and still hasn't been touched. Everyone else around my number is either approved or RFE. I haven't even received the NOA-T - hardcopy. When we called the USCIS, they said that not everyone receives a mail copy and that we should call back at the end of the month. I hope they start working on my application soon and we could find out what they have decided.

  7. I personally think that the chain of command is to blame. Every time there is any change the chain of command dictates what needs to move first. In Haiti, natural calamity calamity was claiming US derivatives and so has been every other time. Now, in DACA, children who were being brought into the country were in desperate need to be saved from deportation due to no fault of their own. Do you want to blame them? I don't. I think my needs can wait a couple of months more if that means that someone else can be helped who needed it more than me. For me it is a couple of months while it could be a lifetime for the other. Check out mundonarco.com to see what can happen to some people. Be thankful and grateful for what we have and what the couple of months' wait has maybe helped someone else with. Be grateful to GOD and be patient. You cannot change your future but you can always be content that your wait has helped someone else in their time of need. Pray for everyone and be happy in their good also. They may be the lucky ones butt you helped them in their success. i hope this can settle you down a bit. Good luck all and my GOD be with us.

    Maybe our cases are collecting dust one next to another and keeping each other company and we'll get out NOA2 on the same day. Who knows!

    And now back to waiting...

    Here is the latest updates on our case, My fiance went to his interview, the consul told him to submit a waiver

    the section she checked is Section 212(a)(9)(B)(i)(II) Unlawful presence in the U.S. for a period greater than one year, You are therefore inadmissible to the U.S until June 2016

    Then she check , He is eligible for a waiver

    My question and please if someone can help me What waiver should he apply for I-601? or I-212? or both together?

  10. hey .... you could call and just confirm where your case is. sometimes the actual hard copy notice can take 3-4 weeks. I never got my NOA1, so I called and they sent it. Do you ever check your case status here: https://egov.uscis.gov/cris/Dashboard/CaseStatus.do it will show when your case was last touched and it the date is the same as the 3rd email notification then your just in the waiting part. lots of waiting!!!

    The last date is the transfer date. We are going to try to call USCIS tomorrow.
