Thanks! Does anyone here know if my husband still need to re-do his medical? His I-601 just got approved yesterday and we are now waiting for the instruction letter. His last medical was June 2014 before the first interview on his I-130, we are wondering if that medical is good for 6mos or 1yr? I am getting different answer on this question. Any insight will be highly appreciated. Thank you again...

Hello Ana & Cesar. I cannot answer on what is the next step after approval, but I can provide some insight on the medical exam. My wife is experiencing the same thing, her medical exam expired earlier this year. Your husband will need another exam before coming to the states. From my understanding, the medical exam has to be within the 6 months prior to entering the United States. Our attorney cautioned us not to get the medical exam done again until the waiver is approved (just in case we run into issues that cause a delay). We plan on getting the exam done next week in hopes that the waiver will be done soon and then everything will already be ready to go. However, that is a risk on our part because if the waiver is delayed, we could end up paying for a 3rd medical exam.
That's what I thought...darn, another $225 again. I do not mind paying as long as they move a little faster on processing. Thanks again for the infos...

Ana & Cesar, Did you check the LIN numbers around yours? There are 15 numbers around mine are I 601 waiver too. About 5 of them, got approved already. 2 of them were approved on DEC 3rd. My priority date is August 1st. My ceac status is still the same but had a update date change on OCT. Did your update date change?

The first update was 8/5/14 and the last one was sunday 12/7/14. I am really hoping for a Christmas miracle here. I pray that everyone of us get the miracle we all been waiting for.
Do you know how much more is the wait after the approval? And what is the next process? His physical exam will turn 6mos on Dec. 24, I'm wondering if he has to do it again if the approval goes over that?

the USCIS was doing an upgrade yesterday. Tons of people got those text messages. I think they worked out all the glitches. Have you checked the CEAC site with your NVC case number? Mine keeps getting updated but no approval yet from the USCIS. They are two different databases and are not connected so the update to the USCIS website would have nothing to do with the CEAC
ok, thanks for your reply. On CEAC website, ours still showing the same from when we had the interview in July "refuse". So my question is, who will make the decision on this waiver, USCIS or NVC? My understanding is, as far as the NVC is concerned, they already approved the visa but hold off on it pending the approval of our waiver. Right? So once the waiver is approved by uscis, then nvc can finally release the visa. (correct me if I'm wrong).

I have been following this thread for a while now and I have to admit, it is addicting and yet gives me a feeling of calmness knowing that I am not alone in this long and stressful process. Our 601 priority date is July 25, and yesterday morning at 8am (sunday) I received a text then email about status update on our case. There's nothing in it but a "date update" to 12/7/14. Not sure what that means? I can only guess somebody is looking at our case. This is the 2nd changes since they change the address from USA to Manila on 8/5/14. Is that normal? I wish they put whatever they are updating on the case instead of just the dates.

I can't even check the status of our waiver. It still says the number does not exist. I know it does exist because we have called. Its been a month. How long does it take to be able the check the status online?
that is really weird... Ours showed up as soon as I got a text from them that they have accepted our I-601. Did you guys ask them why it's not showing on line? I can only guess that whoever is doing the data entry over there missed your paperworks...

It depends on what you signed up for and they will give you a copy of that when you got turned around. Read it and it will answer most of your questions. My husband got turned around in 2008 and was banned to enter for 5 yrs. He voluntarily departed too. If they didn't hand you any piece of paper, then you may have lucked out and may have no problem with any petition like we do right now. Good luck...

I do a three-way call with the USCIS and my husband in Costa Rica. It works well because my phone plan allows me to call my husband's landline for free. It is frustrating that I can't call. I have seen approvals coming in Around 3.5-4 months. Are you able to track your case on the USCIS website? Our waiver was accepted August 26th but I'm still not able to check the case on their website.
Ok, we will try that. Thank you. Yes, I signed him up on email and text, but not knowing all the update like I used to do before on the petition is just so frustrating . Waiting for any correspondence in the Philippines will take dble the time waiting here, knowing how slow the mailing system over there. Right now on the website, ours is showing "Intial Review". Please update us of any news on this issue, if you hear anything. That'll be highly appreciated. Thanks again...

My husband's I-601 waiver was accepted July 29, 2014 @ Nebraska. Since it was for my husband's waiver, USCIS cannot give me an update over the phone. They said that my husband has to call, but he is in the Philippines. Tis is so frustrating and by reading the thread on waivers, it gives us a little hope. Is there anyone here knows what the current processing date is? I'm not sure who to believe, someone posted an approval on a June acceptance and many are waiting longer than that. Any feedback will be highly appreciated. Thank you all.

Does anyone here know if embassy in Manila allows the petitioner to come with the spouse on his interview? I am planning to travel to Manila on his interview, for support. It'll be nice if I can be beside him on his interview...

I made a mistake my husband was inadmissible under section 212a(6)©(i) and not (ii). His order of removal was under section 235(b)(1). Sorry I was confused by the (x)mark on his paperworks, That makes a lot of difference now. I did a lot of reading the last 2days and it looks like it will not be as serious as (ii) is, we may be not be required to file a waiver since his bar is done in 2012 (as per I-212 instruction 2nd page). I hope I am not mistaken here, but I can see a light at the end of the tunnel. At the same time, it's not over till it's over...

Not sure why you quoted me because I didn't have the question, but it is waiverable, only for non immigrant visas. That being said, it's clear that we didn't get the whole story and I still think the OP has to prepare for the worst.
Thanks for all the input Yes, I did some research just recently on this case. I kind of wonder about that because according to my husband, he did not claim to be a US citizen during that ordeal. They found him overstaying in his first visit for 3 mos and somehow accused him of working during his stay. He told me he just wanted to get out of that situation because they were interrogating him for straight 10 hours. That's why he said yes so he can get out of there. I know that was a stupid move but it's over and done already. And the officer told him because he was very cooperative he will give him only 5yr ban instead of 10. So guys I know this may be a problem on our interview day, but is this really going to be a long shot for us?

Has he gone to the interview yet? The CO at his embassy will issue
a paper to apply for waiver if he needs one, If he does get a lawyer
to handle the waiver, its not just a form it will need briefs & evidences
he may need I 601 for overstay
No, we are still waiting for an interview, we just got approved 3 days ago. This is what I'm afraid of. Waited too long for the approval and now the possibility of more waiting because of that issue that happened so many years ago is just to much to think right now. So even if we waited out that ban, do we still need that waiver? We are hoping that the CO will be very understanding on this for us. Is there any way we can get off that?

He was not admitted at the point of entry in San Francisco. That was his 3rd entry to the US. They found him overstaying on his 1st visit. We wait out the ban before I petition him hoping there wouldn't be any problem on him coming over again. He was on a tourist visa then and now he is an approved immigrant petition (I-130). So what do you guys think? any input here? I'd like to be ready just in case....

My husband's petition (I-130) was just approved recently after over 10mos of waiting. He was on a 5 yr ban from 2008 -2013. We waited until his ban was over before I filed the petition. We are now waiting for his interview date in Manila. I am wondering if we will need a waiver for his previous ban? Any ideas here will be highly appreciated. Thank you friends...

They will not remove your ban just because you married a USC. You can wait out the ban, or your husband can file 2 waivers and try to get the ban removed. The waivers are not something people take on by themselve successfully. You will need a lawyer and the cost will be between 5 and 10 thousand probably.
Hi, me & my husband were married in May 2012. He was on a 5yr ban with the same code as the above here, but was already over in Feb. of 2013. The reason for his ban was unauthorized stay for 2.5mos or overstaying on his previous visit in the US. We waited until the 5yr ban is over before I filed the petition. His petition just got approved recently and we are now waiting for an interview in Manila where he is right now. Do you think they will still require us to file a waiver? Pls. advise.. thanks...

Good luck to us all and should I say God bless us all. Certainly test our faith and beliefs... As I was about to lose it, ( was freaking out yesterday morning) I got an answer by noon and a confirmation late in the afternoon. So don't lose hope guys, your day is coming....

I am asking for my husband. I am a US Citizen but a little worried because we are days from sending our waiver and oir lawyer is telling us that we might get denied because I have no medical record what so ever and we have no kids yet...but come on who wants to risk it, having kids with out their father here? I am really scared we might really get denied. My husband has no criminal record and he has paid his taxes and all that. I have sent pictures of our wedding and several letters from friends and parents. I am not sure what to expect..please if you have been approved on your i601A share your story.=/

I'm wondering who requested your I601 waiver. Looks like your petition for your husband was approved already. Was this requested by the consulate in Mexico? The reason I'm asking is we may have to do a waiver too but no one has asked for it yet. And also, you seem to have all the reasons for a waiver, his living condition in Mexico and yours if you have to live there is not very safe for your family.

Yay!!! Now I really believed that everything happens for a reason! He had to do that medical last year 3x, the first 2x were in May because of his blood pressure going up each time he sat to get it done. so he had to see a doctor and get it stabilized before he did the last one June 19. So thank you for the info, it will save us another $250.00.
