  1. Been following this thread for quite some time. Just wondering, is there an easy way to go through everyone's timelines that filed their AOS in February?

    The problem is that the majority of members have not filled out the VJ AOS timeline but you can find info for the Feb filers for those who did.

    Go to the Immigration Timelines at the top, click on AOS Timelines. Sort by date filed in descending order and it'll start the list with the most recent date filed.

    You can also use the filters to narrow your search parameters.

    Many opt instead to just include their timeline in their signatures but you would have to go through all the pages of this thread to ferret the info out :( .

    Having said this - can everyone :time:

    It really is helpful to others to get a estimate on how long the AOS takes by office, type of Visa etc...

  2. Congratulations to all of you guys that has progress with your case...... Mine today is day 70 no change for the interview, no answer for the i765 wish I expedite last week as per the web site after I call and expedite the process they take 5 days to determinate if I qualified in any of USCIS the criteria but no answer as of yet....

    Feel discourage today

    I believe you're in Miami right? If so, unfortunately they are a pretty busy office so you may have to wait a little longer to get an interview appointment scheduled.

    In the meantime stay positive (even though I know it's frustrating) and I hope you get the I-765 expedited request approved ASAP!

  3. OMG… I'm screaming at my computer! Got e-mail with interview date for May 20th. It's moving so fast. Be patient everyone, It WILL happen when it happens.

    I just got a message from them as well today saying the same, but mine is not going to be of any use :cry:

    Well at least you'll get to hold it for a day or two before you hand it over because you'll get approved for your green card :)

  4. So disappointed as I got transfer notice in mail for the I485 and it says transferred from Nebraska to NBC, Lee Summit. Here I was happy it went to local office and interview should be next step....then why did service request response say adjudicator preparing to transfer to local office for interview and then online says transfer to local office.... going to call on Monday to get confirmation where file really is :( Very disappointed.

    Are you kidding! I agree that you should call on Monday and speak to a Tier 2 agent and find out what the heck is going on.

  5. Do you need to attach a copy of the ID along the affidavit? We sent 2 bona-fide marriage affidavit from our friends and did not add it. Should we bring the copies to our interview, what do you think?

    I don't think it's a requirement but it's not a bad idea to have the copies on hand for the interview just in case. I also sent two bona-fide marriage affidavits in my case and had attached the photocopy of the ID's.

    In the case of the poster with the USC's missing birth certificate I think it's more important that there is valid ID with the affidavits.

  6. After some opinions.. my husband and I have a 2 yr old son, would you recommend we take him along to the interview as well, or keep it child free?

    I think it's dependent on the nature of the child. Is your child one to get really antsy after sitting for a few minutes? Or is your child the more silent type and could sit quietly for 30 minutes and more?

    I see nothing wrong with bringing your child personally but that's my two cents :)

    Just wondering, in terms of affidavits, do we get those from family members like siblings and father? (mother is deceased)

    Definitely get one from his father, and any maternal/paternal aunt/uncle/grandparent that knew him from birth.

    Siblings wouldn't be a valid option unless they are significantly older than your husband and would have remembered his birth.

    Make sure to have whomever include a photocopy of their ID with their affidavit. If the affidavit is done in a foreign language, you'll need to have it translated into English.

  8. I may not know everything but if ICE were breathing down my neck, I would not be trying to handle this on my own.

    At least try to find a non-profit legal/immigration counselling service in your area that can advise you on what you may be facing and what you should do next concerning ICE.

    You already know that you need to file for AOS pronto, but beyond that you need legal counsel to help you out of this potential mess. Best of luck to you.

    I'm so glad to see you moving along. Keep me updated on your interview date. Are you interviewing at LIC location or Federal Plaza one?

    My case is so unique and not a straight line lol like apply, get biometrics done, changes to testing, get interview date, then interview...

    mine is back and forth....I hope and think I won't get biometrics...may get RFE for medicals as I know those require updating but figured before transfer they'd have asked for it....so not sure. Tried to make an infopass to see if I could talk to anyone about my case to at least know what to expect, but no dates seem available.

    The suspense is killing me lol.....

    I believe we will end up at Federal Plaza and I'll keep you posted. Yours is definitely not the typical one :)

  10. I'm just looking for the right forum to post and this may be it.

    The heart of my question is whether or not my Canadian husband can be deported if we go ahead and file the I-130 and I-485 without an I-94#, A# or K-3 Visa. Technically, he is here as a Canadian visitor (which requires no I-94). He has never lived or worked in the US. We do not have a K-3 Visa. Everything we're reading says he's able to file the adjustment package as an immediate relative and he IS here legally. Here's more info.

    After 4 years of dating and MANY US/Canadian border crossings to visit each other, I married my Canadian husband in the US in Sept. 2013. We went to Mexico for a 5-month honeymoon from Nov 2013 - March 2014. When we crossed the Mexcio/US border by land in March, we asked for an I-94 form for proof he entered the country legally. We even told them he was planning to file for his immigration. They told us a Canadian citizen does not need an I-94 to be in the country so they wouldn't issue one for us. Most of the documents we're filling out require an I-94 number and/or Alien registration number. We don't have either. (I've also searched for the i-94 electronically but get "not found" because they didn't issue one for us).

    We've spoken with the USCIS by phone, an immigration lawyer as well as a local non-profit specifically chartered for immigration assistance. None of them seem too worried about the lack of this information. But, everything I'm reading online gives a huge warning about him filing paperwork from the US without a specific kind of visa. Now, I'm worried about deportation if we file the paperwork without it. I feel quite stuck. Help.

    I also believe you should be good to go ahead and file as many Canadians are in the same boat as your husband and they successfully completed AOS.

    Even though we are not required to apply for a visa to enter the US, Canadian visitors are still coded under a visa category, either B2 (pleasure visitor) or B1 (business visitor).

    Canadians don't usually get issued an I-94 but sometimes will get a CBP stamp in our passport. Was his passport stamped by any chance?

    At each crossing our passports are supposed to be read electronically by the CBP officer. If they swiped your husband's passport on his entry into the US from Canada in 2013 or from when you returned from Mexico this year then you really need not worry.

    On your I-485 form in the section referencing the I-94, I would write None Applicable or No I-94 as another previous poster indicated.

    02/28/14 Received 3 Emails and 3 text msgs from USCIS
    03/02/14 Received 3 NOA1 in the mailbox for AOS, EAD & AP
    03/08/14 Received Biometrics Appointment for EAD & AP in the mailbox for April 1st!
    04/01/14 Done biometrics for EAD and AP 9:00am and was advise to wait for a month and a half to receive a new notice.
    My question is how low long normally it takes to receive a notice for the AOS (Testing and Interview)? My status online haven't change yet. Its still the same, last updated on Feb 28, 2014. I am worried that something went wrong, I have read a of you here have a fast moving application.. Please enlighten me! Thank you in advance!

    Don't worry it should change within 2-4 weeks at most. It took 3 weeks for mine to change online to Interview and Testing status. Now waiting for an actual appointment time.

  12. When we submitted the I-130 we also included a copy of my husband's (USC/petitioner) birth certificate because he was not born in the US.

    Refer to Page 4 of the instruction for for the I-130 and read the section What if a Document is not Available?

    Option D Affidavits may be your best bet if there is no way to obtain a replacement birth certificate for your husband. I hope he can find it though!

  13. Yeah!! We've been struggling on one barely above minimum wage income for the past 11 months and we still need to continuing save up to move so finally being able to have 2 incomes coming in will be the best feeling! We're friends with a lot of people here that have offered to help me out job wise once I can work, so getting a job asap will hopefully be pretty easy :)

  14. Well not so far...all I see is they transferred the I485 to local office. I only did medical once and biometrics in beginning. I've had multiple EAD/AP issued and never needed biometrics again. I'm assuming that I will not need biometrics, but maybe updated medical? Not sure what point they will ask. I'd have thought that before transfer, they'd have cleared RFE issues such as medical and then transferred for final interview/approval etc.

    Hoping to hear opinions and other's experience....

    I'm so glad you're seeing movement in your case! Today I was put in the queue for Testing/Interview.

    I find that lately the NYC offices are picking up the pace. Some people are getting their appointment date set for a month or so after they were moved to Testing/Interview or having their filed transferred to the local office. But as we all know there is no real way to determine what will happen in each of our cases.

    Since you'll likely be in the LI City/Queens location, it's not as overloaded as Federal Plaza in Manhattan one so hopefully you'll get news of your interview date sooner.

  15. It's been two weeks since my biometrics and nothing. The last updated date online was the day they sent my biometrics appointment which seems to me like there is zero movement on my account…. Ugh. Time for a drink.

    I can relate to your feeling of impatience :) It's been three weeks since I did my biometrics and still no update.

    On the online case status, mine hasn't been updated since they issued the NOA's even though I've already gotten past biometrics.

    Wishing us all good fortune that things speed up soon!

  16. In the top part of Part 7. The second sentence that starts off: If your total household income (which can be interpreted also as an income of $0.00...) doesn't meet the requirement,...The value of all assets of all of these persons may be combined in order to meet the necessary requirement.

    What I get from reading everything in Part 7 indicates that sufficient assets alone could be used in the place of income. If you still feel unsure then find a joint sponsor.

    Caveat: The USCIS can still require a joint sponsor if that's what they absolutely want after you submit the I-864 with just qualifying assets alone. A joint sponsor with a qualifying income recorded by the IRS is easier to prove in the eyes of USCIS.

  17. If we don't have any income at the present as we are both unemployed, do we still require a joint sponsor if my savings (bank accounts) are quite substantial?

    When you say 60-90 days, that's the approximate time from filing in order to obtain a green card?

    In relation to the savings question, it must be at least 3x the amount of the 125% poverty minimum income requirement based on the number of the sponsor's household.

    Also this amount would need to be proved that it has been in savings for 12 months I think (you'd need to send bank statements to prove this). If you have this then you wouldn't need a joint sponsor. Refer to Part 7 of the instructions for I-864.

    The 60-90 days I spoke of is in context to getting your EAD/AP approved not the green card.

    The average time a green card takes to be issued within 3-6 months from initial filing IF nothing goes wrong and depending on the field office as some are way faster than others.

  18. Oh I'm rocking the boat and I lodged our first service request earlier this evening. My patience has now completely expired. If the USCIS wants to set their processing timetable in a foolish manner and I can capitalize on it, then so be it.

    I know that I'm very, very fortunate that I'm now with my husband in the US but please don't hate on me for that. I know that many are going through serious emotional distress being separated...I lived it...so I know many of you deserve to get answers and approvals fast!

    But it still does not justify them sitting on our I-130 for 6 months since being transferred!

    Our NOA1 issued on July 2, 2013. Our petition has been transferred and sitting at NSC since Sept 2013...and some people who filed before me are still not approved??? Those transferred to NSC after me and with NOA's after me are getting approved???

    Complete, utter, freaking rubbish!!!

    Sorry folks, but I'm mad enough for all of us at this moment.
