  1. Got married Oct 12, 2013. Filed AOS Oct 22, 2013. Had biometrics Nov 26, 2013. Then nothing. Congressman's office told us our case at Memphis field office, but nothing else they could do. Sent several request for action , but always got letter saying just wait. Then Today 6/23/14 get letter saying AOS was approved and will be getting Green card in 30 days. No interview even though our file is at field office. Now hope they don't lose our cards.

  2. Is it?

I've read threads here that say replacement cards require a new application which in turn require a fee, as they are no longer in conjunction with the AOS app. Albeit, our case is different as it is clearly lost in the USPS. I am interested in hearing from anyone who has actually had this experience as it would not surprise me in the slightest for our government to not care who's at fault for the lost card & require a fee with any new application. Just trying to get a handle on what to expect.

Actually yes! USPS lost my wife's EAD. 1. You have to fill out a new application 2. Write a letter explaining what happened and why you should NOT have to pay for it's replacement, because USPS lost it .In letter give all information such as A#,DOB, copy on NOA,etc. 3. Call USCIS and let them know that card was lost. Speak to a teir 2. Send new application to same lock box. Will take another 3 months to receive new EAD.

It is a pain in the butt, but we got a replacement card without having to pay the " lost or replacement fee"

  3. You can try, but things are bad there now. My wife is from ukraine. I tried to get get a tourist visa( Dec 2011) before we married. She owned a flatt, had good jod as a doctor, had bank accounts , had a 11 year old daughter, parents in Ukraine, etc. Still got denied! Even had letter from my congressman, didn't help. I offered to get assurance bond, but no dice.

  4. Hey all!

So I am getting ready to go for my interview and I want to make sure I Have everything as it needs to be.

Do I need the certified copy of my birth certificate (with the seal) or can I take a photocopy?

Also, as my mother is my cosponsor for the I-134, do I need her birth certificate too?? We are just nervous about bringing originals to Peru as robberies aren't uncommon.

Also, is there anywhere I can find a solid checklist of documents that I need because I have been piecing it all together from different forums and sites and it would be great if there was a master list put together somewhere.

Thanks all!! 7 more days!! smile.png

Look at the embassy web site. there you will find a check list of all documents required for that country.

    • guides6ly.gif (accessible at the top of the forum page). In particular, the K-2 AOS Tips:

      http://www.visajourney.com/content/k2-visa-adjustment-of-status-tips

Additionally, there is more great information available at the pinned thread at the top of the forum page, "Calling all K-2 AOSers….":

      http://www.visajourney.com/forums/topic/287035-calling-all-k-2-aosers-past-and-present/

It can get expensive, we had to fork over $2140 for my wife and then-19 y.o. stepson for their AOS processing. Yours may be less, be sure to check the age breaks.

Good luck on your immigration journey.

Sure. I did it for two children in addition to my wife.

Each person files separately (you can put all the applications in one envelope) but there are separate applications, I-864s and FEES for each. A child under age 14 wo file at the same time as the parent gets a reduced rate. At the time we did it the fee for a child under 14 was $600 as opposed to $1080. Children under 14 do not pay a biometrics fee. Children are derivitive of their benefits which means they WILL be granted (or denied) the same benefot as the parents but cannot do it before the parent does. They CAN do it simultaeneously.

So you will complete TWO I-485s, TWO I-864s, and all the necessary attacments and mail then with the appropriate fees. You CAN write one check for everything if you send it together. An 11 year olde probably does not need an EAD, but you can file for an AP. Why not? Its free.

For the Removal of Condtitions you can file ONE I-751 petition and TWO biometrics fees and save a little money there. Also since her daughter will be under age 19 when the parent becomes a citizen, she will automatically be granted citizenship when the parent is. That is a BIG savings.

They need their own separate AOS forms. When they get their EAD, you can get them their SSN with that, See the fees here > http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=3faf2c1a6855d010VgnVCM10000048f3d6a1RCRD&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD

You do not need a separate I-864. The K-2 is a derivative of the K-1 and therefore the child can be listed in Part 3 #2 of the form. On Part 3 #7 you would put 2 and so in Part 5 #1 for household size, you would also enter 2.. Only those that had an entirely separate petition filed for them would nee a separate I-864. See Page 3, Part 3 #2 Family Members in the I-864 instructions > http://www.uscis.gov/files/form/i-864instr.pdf

Thank you so much. I appreciate the info!!! If I may ask 2 more questions please?
    • 1. Do we use her last name ( Ukrainian) on forms or do we use her new last name ( my last name) ?
    • 2 AT POE they gave her vaccination records for her daughter, but did NOT give my fiancé any medical records of herself. Is this a problem?
  5. Hello everyone,

does anybody know what can be the reasons of K1 denial? what are the common reasons?

i would appreciate if any one who got denied can write the input

    thanks

in last 2 weeks, Ukraine embassy has started denying Visa if fiancé does not speak English. They are paying attention to Skype logs, wanting to make sure you can communicate together.

  6. Seems like majority of K1 cases that were transferred from vsc to tsc in july and got no2 in july are having problem getting shipped to nvc even after getting mails from uscis that the case had been shipped to nvc....Just an observation, hope some one can prove me wrong because;

We got approved on 07/22 and got an email from uscis that our case has been shipped to NVC on 08/08....but as at now (08/19) they still keep telling us to wait for 8weeks each time we call NVC (we've been calling almost everyday)....Frustrated!!

When Files were transferred from VSC to TSC, a stamp of some sort was left off. So when files get approved at TSC, the File is sent back to VSC for stamp, then shipped back to TSC for final processing and then sent to NVC. After all transferred cases get completed, the process should run better.

  7. I recieved my NOA2 on July 26, today I called NVC to get the case number, they asked me the beneficiary date of birth and I answered, they told me that that date didnt match what they had, I know I gave them the correct date because I had the birth certificate in front of me, also my NOA1 shows the corect date, the person at NVC told me to send them a copy of her passport to make a correction, my question, will they still forward the paperwork to the embassy or will thay wait until they recieve the copy of the passport? Is it necessary to have the case number at all? how can I find out when they forward the case to the embassy? they didnt tell me anything since THEY SAID, the date didnt match

I would send copy of birth certificate and passport showing DOB.

  8. Can we schedule Medical now that we have case number. Even before it reaches the embassy. Reason is because Vika and her son are visiting her either in Kiev and would be simple to get this taken care of now while he is with her so he will not have to come back Ina couple weeks. Thanks for any insights.

After case number, my fiancé had to pay fees first before she could schedule medical and interview on line.. After paying, things went fast. Had medical and approved at interview with in one week. . Had interview on Friday, then today CEAC web site shows visa issued ( 2 business days) Passports should be in Poltava tomorrow.

We had medical scheduled before case was ready at embassy. . Case was sent to embassy 3 days after case number. Case was ready at 5 days after arrival at embassy.

  9. Thanks, these interview questions are helpful.

Did you print your entire Skype log? Like I said ours is very long. Do you have any more information about that?

We also have some letters/cards/tickets and other proof.

    Ryan H, I saw that batallion9 is working on a K1. Thanks :-D

maybe do 50 pages of Skype from different times. Letters, copies of emails, wedding pictures, family pictures. etc.. Fiance did say that a girl was denied because they wanted prof that they could communicate. They told her to come back with Skype logs! Our Skype log was 4 pages long with about 100 conversations. We did get approved!

Questions they ask come from forms you have turned in. Anything other than that, and they are shooting in the dark. The questions they asked about if I owned my home and where did I work, and my daughters name came from I-134.
