  1. They touch our case but it is RFE so sad:(

Any idea what are the usual evidence they need pls. give me some words ;( and How long they will process the rfe? and how long it will takes to receive rfe hardcopy TIA

    Request for Evidence

On September 5, 2013, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

You should get it by the middle of next week!

...whatever they want.. a lot of times they approve you within a few weeks of sending back whatever they want.

It could be something very simple as maybe you forgot to sign one paper. Let me know once you get it, and what they requested.

Did they send you an email, and text message for this notification?

  2. you said TSC is not the best sponsor of LGBT

that does not matter, they do not have right to discriminate, same sex marriage is recognized constitutionally and they do not have right to discriminate

so i dont think and i am sure TSC is going to process same sex cases the same way as the rest of the centers

Oh I know, and I can't wait to see the first approved LGBT from TSC because so far it's been approvals only from straight couples.

I would have felt ten times more comfortable if VSC had still my petition.

  3. Go to the USCIS website, and search for "poverty guidelines 2013"

This will give you a list of how much is required of your income.

Adding a child increases the need for income.

You will be considered to have "3" total dependents. So your income needs to meet the poverty guidelines for 3 people.

&& your co sponsor would have to make the same, poverty guidelines for 3 peoples.

Which I believe is roughly 25,000 yearly.

  4. No, radio silence thus far. As I've said elsewhere, I'll be happy to see movement for ANY same-sex couple from the TSC, because Texas sure ain't Vermont. I'm going to Brazil next month for a visit, so I'm glad to focus on that for the time being!

I know, trying not to judge the TSC, but I would have felt more comfortable with my petition in VSC rather TSC. Texas isn't exactly the best sponsor for LGBT. Enjoy your visit!

  5. Hello, we are in similar situation but the difference is that our K1 packet was not transferred to TSC, TSC started processing our packet from the very start they got it.

so you say that TSC is quicker compared to the other centers?

I just seen this so sorry! Well I have seen that TSC usually approves NOA2 within 4-6 weeks. However lately I have seen most approvals coming from the CSC.! Well I can only hope they will hurry on up. When did you get your NOA1? Has your alien number been changed yet? I am still waiting around for the NOA2 to happen. Keeping my fingers crossed, and hoping to hear something in the next 2 weeks. Here's to wishful thinking at least.

  6. Hi butterflycharmer8,

Welcome to "bi-national same-sex couples immigation world." It's nice finally to be able to stand in line with everyone else when even a few months ago that was impossible. Anyway, I was struck by the fact that our timeline is almost exactly the same. Our NOA-1 date was July 10, and we were transferred to TSC on August 9 as well. Who knows, maybe our petitions are in the same pile sitting on someone's desk? Good luck with your petition, and keep us posted. It will be interesting to compare the process as between Peru and Brazil.

    Buena suerte!

Anyword yet on yours? So far still under "initial review" for us here! It shows our case was last "touched" on August 15th. Just checking. :) If I have not heard anything by Sept 15th I intend to call to check it out a bit more. Chaaaaaaau.

  7. You should have waited. The doctor in Lima will assess and apply the needed vaccinations. My fiancee had no vaccination records, and this is what was done.

Thanks everyone for the responses, and also specifically we won't get anymore done. I know there is a timeframe inbetween doses, and they asked her to come back oct 31st to get her 2nd doses... we just will not get the 2nd doses done that way the doctor in lima can perform them. :)

So we already know we will be safe after oct 31st for anymore vaccines, and we havent yet got our NOA2.

I am glad she got them though, very surprised she hadn't had them.

I guess it is quite common in SA to not have vaccines.

  8. As Ryan mentioned, yes, she needs to prove her individual income, and a tax transcript does not do that with a joint return, A complete copy of the return with all forms, schedules and W-2s work best in that situation, or the transcript with a copy of her W-2 as a backup choice.

If she did not keep copies of her latest W-2, then this would be your best I suppose, rather than paying for them. Did she throw out her recent IRS forms so soon, or misplaced them? It is a good idea to keep tax info/copies of your returns for a few years before shredding them. Anyway, yes. Her W-2 transcript is better than nothing. That along with her letter from employer and recent pay stubs should show well enough her individual income.

Thanks kay jay for your detailed response!

    I agree better than nothing.

She is going to take a look for them, and hopefully she can find them.

However in the mean time I am already placing an order for her w2 transcripts, just to be safe in case she can not find them.

Thanks again guys, and hopefully this conversation will shed some light on the next person who has this issue.

I wasn't able to find any backlogs in regards to this specific question, but now I feel more confident/understand so much more.

After a little research on my own, and clarification from the responses here. :) Muchas Gracias!

  9. I will be using one. OK, this is what I have gathered....the person of the married couple being used will need to provide all the financial info, etc. They will also be the one using their income to qualify, and if their income ALONE is enough only they sign. Now if the married couple combined income is what covers the limit then I have no idea. My other sponsor is my stepfather, who is obviously married but he makes more than enough alone.

I could be wrong though this is what I heard.

    http://www.visajourney.com/forums/topic/199871-i-134-co-sponsor-is-married-filed-taxes-jointly/

Right, so my cousin is going to provider her employment letter, as well as recent paystubs, a birth certificate, and tax transcripts for the last 3 years.

The tax transcripts are going to show a combined income though, because she files jointly with her husband.

The employment letter will be written proof of her income, and salary... so I am hoping that the employment letter is acceptable enough because even the pay stubs will back up the salary written.

I just want as much feedback as possible from anyone who has used a co sponsor, and been approved.

To see exactly what they provided.

I feel like we are safe to use the tax transcripts even with the combined income, because the most important is the AOS however you can never be too safe!

  10. My only concern with that to order w2's they are 57 dollars a piece && we will need 3.

That's why I am trying to see if anyone else who has used a co sponsor that was married.. what they did to provide proof of the income.

I can order the w2's , but if there is an easier way I'd love to do it!

I am hoping we can just use the tax transcripts, even if her husbands income is combined on the total.

She will be providing a letter from her employer which states her salary, and hours, and position so that right there is proof she makes enough...

However checking all my bases, and seeing what others have done with co sponsors whom are married.

  11. I have a co sponsor, ( my cousin ) who is older, and married with a child.

My question is, she makes well enough money to sponsor my fiance, as well as maintain her own household however as most married couples she files her taxes jointly. Therefore the tax transcripts show her husbands income, and husbands name. We are curious, does her husband have to file a I-134 form as well ?

We know that I need to, the petitioner. Submit my I-134, employee letter, and paystubs, tax transcripts.

My co-sponsor, will submit the same as me.

What will we do about her husband? What information will they need from him since they are married, and live together?

  12. No apparently she can't , and they do not have any of her records.

So she has at least started to get some of the vaccines now... so that she has some sort of proof... I feel like their main concern is for any present diseases but she is 100 percent healthy. She doesn't yet have a medical scheduled, we are still awaiting our NOA2. We are just getting well prepared in advance so that it will not be quite as stressing. I know that once in the USA she can get more vaccines before her AOS, but again I just want to cover our butts as much as possible, so to speak! lol

  13. I know it says clearly to not get ANY vaccines before the medical exam, and I am sure this is because some vaccines you have to wait atleast 4-8 weeks in between.

However my fiance didn't have any of her records, so she did go to the hospital today to start 2 of the vaccines ( She needs 3 doses to complete)

They told her to come back in 2 months for the 2nd doses.

Will it be a problem if she has had only 1, or 2 doses && not the full 3 doses required for the medical exam?

Our main concern is failing the medical because she might not have all the vaccines required, and we decided to ensure we have at least a 30 day gap from the most recent vaccine she will get to the medical exam date to avoid them denying to offer her any vaccines.

Anyone please share their medical experience.

    • Specific for these... My fiance is from Chiclayo, and the addresses request these come from Lima. My fiance can easily gather these documents from her hometown city Chiclayo. Can you gather them from Chiclayo, or does it HAVE TO be from Lima? Anyone know who has already surpassed the interview process with Peru?
