  1. Sorry you are going thru this. E-mail the Embassy and explain your situation and ask for an extension. The only issue I can see is they may make you do another medical. Another thing to consider is if a new medical is not required, then you have less time in the US to file for adjustment of status (AOS) before a new medical is required. Typically the medical is valid for 1 year for the AOS phase. You could wait until the last week before the visa expires and come to the US, get married and file for AOS along with advance parole (AP) and employment authorization (EAD). After getting the AP you can travel back to Japan to see how your Mother is doing, but that will take about 90 days currently.

    I'll mail the embassy and may post how it goes.

    Oh by the way, the Embassy's phone and Email inquiry system has changed here: they no more require fees for answers, saying those are included in the visa application fee now.

  2. If she is worried about you moving to the US, I would just rip off the bandaid and do it. Waiting and getting extensions just seems like prolonging the agony. The quicker you go, the quicker she learns it will all be okay.

    I agree with Harpa. Make sure she's being seen by doctors, that there's a support system for her besides you, and go. File for AOS and AP, and go back to visit when you can, so that you can show her that you're ok. Keep constant contact with her while you're away, like Skype and emails, but don't let her situation - as harsh as this may sound - dictate your own life. Been there, done that, and stepping out of that rut was important for both me and the other person.

  4. Hello everyone! I did search for info and topic here but would like to ask your knowledge again.

    I (foreign fiancee) was approved at Tokyo Embassy back in October and my visa is valid until March.

    We originally planned my POE in December. Then many things happened unexpectedly, and now the expiration is near.

    One reason is that my mother in Tokyo became mentally sick. She was diagnosed depression by doctors. I want to have more time to talk to her before my marriage. One of the cause of her illness is that she's so worried for me.

    Has anyone successfully extended their K-1 after issuance, or given re-issuance of the visa?

    Thanks for your advice... we are very much at a loss.cray5ol.gif

  5. Ya, wish I knew VJ before hiring a lawyer.

    Most of them will not care about you at all. Just want to make easy money.

    They will slow you down.

    For example, they will tell you to prepare photos for a form.

    They didn't tell me that the background should be white, so I wasted time and money re-taking and re-sending photos to the US.

    (Found out about the white background myself).

    If you want a peace of mind, it won't come from lawyers but from you yourself making sure everything is right.

    And it's faster.

    First of all, congrats to your coming baby!!!

    This might not be exactly the information you are looking for, but anyway...

    We asked an administrative lawyer (行政書士) about marriage procedure in Japan before choosing K-1.

    According to him, your fiancee can handle all the procedure by herself. Your presence is not a requisite.

    The steps he explained are as follows:

    1. Get a marriage paper(Konin-Todoke, 婚姻届)from a local city hall and fill in. She needs to snail-mail it to you to let you sign the husband's signature space. All other items are OK in Japanese. Your seal (はんこ)isn't required. City hall staff are ready to answer your questions.

    2. You need to send it back to her together with these documents:

    a. document to prove you can marry (婚姻具備証明), notarized-- this should be what you wrote "Sworn Affidavit of Competency to Marry"

    b. document to prove your birth (国籍証明)-- birth certificate in the US, right?

    If a document includes the requirements above, one will do.

    3. Your fiancee needs to get a Koseki-Tohon from the registered office to submit it with the marriage paper.

    The location she's submitting them will be the local office of her present residence.

    You seem familiar with steps after Kon-in todoke.

  7. So I know most people on this thread have celebrated the simple NOA2 already, but we FINALLY got ours! It feels like it has been forever. We got an RFE a couple weeks ago and then got our NOA2 today, so that part was at least fast. I'm just thankful they didn't forget about us! smile.png

    Hope now that the NVC has sped up for you.

    I see many NOA2s in about a month or so from NOA1, but especially happy to watch older cases approved on Igor's list. Is government dysfunction affecting service centers? I see only a few approvals from CSC these two days.

  8. I called CSC on last wednesday and they were not very helpful. I just spoke to the agent who answered the phone. Who do you suggest talking to to find out when was shipped. The one I spoke to said basically they cant do anything for 90 days when all I wanted to know was whether or not it shipped. NAO2 8/22

    Hi, I think you need to speak to Tier 2 to get any information.

    Also, if you are calling the DoS-NVC side, definitely go for DoS. They are very nice and waiting time is short.

  9. Yes, definitely better to ask help of your local representatives. We were also February filers that waited 5 months to get congressperson's involvement. When a liaison sent inquiry to California Center, our petition was approved in 2 days.

    Did you read other posts about no RFE hardcopy reaching despite of what the center says?

    I am sorry about your troubles but it seems action is the only way to move the situation.

    no, we always found out our case status by calling CIS or DoS.

    Though fiance registered with E-notification with CIS...

    Maybe his register didn't work properly.

    Someone on VJ wrote he/she could confirm file trasfer on USCIS "Check My Case Status" site but this shouldn't be the case. Ours are still the same Post Decision Activity.

  11. I just called NVC and told that our case under processing in the system!! And we told to call back after 10-20 days to take our case # !!!

    As stevie says you'd probably receive your case # and the file sent out in a few days rolleyes.gif

    Update 9/13/13:

    Called NVC again today and they said our case was just forwarded to the consulate in Japan TODAY, and she gave me our new case number. Woo hoo! I hope this will be helpful to everyone else who received NOA-2's around the time we did. Soon I hope you will get good news!

    Grats !!!!!

    Ours is 13th too.

    Just an update .

    I just got off the phone with the NVC and the got our package on Sept. 11th YEAHHHHHHHHHHHHHHHHH dancin5hr.gif

    it took them since the Aug. 9th so almost 5 weeks. The said it was in AP and i asked if that was normal and she said yes. she verified some information and then tols me they would contact me when it was sent out. She also gave our number so we can call the consulet next week to see what is next.

    I hope this helps any of you still waiting.

    On to the next stage of the process and i pray it goes as smooth. I am starting to see the light at the end of the tunnel idea9dv.gif

    Our NOA2 from CSC was7th AUG. File sent out to NVC on 4gh SEP, logged in NVC system on 12th SEP and got local case #, and finally sent out to consulate on today 13th SEP.

    Fiance registered with E-mail notification but never received anything from CSC or NVC.

    Once we got local case # (Tokyo number) by calling DoS, we were able to check the status with CEAC site.

    It shows "Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center." but the interview date part is negligible.

    Thanks. It should be the case with most countries. In Tokyo extension of NOA2 needs to be requested via written letter.

    CSC sent out file: SEP 4

    assigned NVC case#: SEP 12

    Relief, as we read somewhere it took more than 20 days for NVC to log cases in their system!
