  1. I have read a lot of AP cases in the past few week on this forum. My impression is that many people had to wait 3-6 months before their AP is done. As to the consulates in India, I am not quite sure exactly the average waiting time. However, I can only speak based on what I read, which is probably very limited information. I hope you get your visa really soon.

    Sarah2013 - I don't knw are you sharing a experience of which country. I am from india and my Fiancee is US citizez. I applied K1 US immigrant visa. I come to know the timeline after reading on VJ and my inquiry emails to embassy where they said most of the cases resolved in 60 days. Now god knows what is reality it seems no one knows anything. Sometime I think I did mistake to apply K1 becoz I had B1B2 visa if I manipulate my statement when I was in US I can easily live there bt I was following the legal way and suffering. Let me discribe my case then pls suggest, I had interview on 11h april 2013 CO was again and again asking abt age gap she is 51yrs and I m 29yrs old. Bt at last he saId just submit PCC to process visa request. He issued me 221G white form. On 23rd April 2013. I submitted my 221G form PCC and my indian passport to them as per them visa will issue within 8 to 10 working days but now I come to knw it take around 2 months pls suggest My chances of getting visa

  2. I may have to go through the appeal process very soon and I was wondering whether you mind telling me how you did your appeal, in details, if you don't mind. I start from scratch and really would like to learn a great deal from your experiences. I hope you visa will be printed for you very soon.     The embassy asked my husband for new medical, DS230 , ppc, passport pictures and new affidavit of support. It depends on how long you spend in AP. It is also up to the visa officer to decide if he wants new affidavit of support or not.

    Our visa was denied and then we won our appeal. Our case was sent back to the embassy. Then we spent another 9 months in AP before they asked for new documents this might be why they asked for new affidavit of support. Still you should be prepared for anything from Islamabad embassy.

  3. Sounds like mandatory AP or necessary AP, which may not take a long time. Did you call DOS and ask what is going on with your case? No 221(g) form issued to your husband right? Any updates on your case?

    Hi all, I am very confused here is my issue...

    My husband had his interview 3/25/13 at cario embassy the CO told him that everything looks good took his fingerprints, paid dhl fee and CO took his passport....CO told him that no addtional docs are needed that they have everything they need and to check online in 3 weeks....

    I checked online and my husband is in AP???? Why??? Shouldnt the CO have advised him that he was going to AP??? Why would they take his passport if they are sending the file to AP?? I am very confused someone please give me some feedback...

  4. Hi zubi2lute, I know your experiences and I hope you will be out of AP soon.

    You are right on the info that ceac.state.gov provides and the DOS 1 202 663 1225.

    Sometimes, ceac status is misleading.

    But I realized sometimes, DOS's info is not updated immediately when ceac status is changing.

    It seems ceac is real-time change, DOS has one day or half day delay.

    Time will tell.

    when you are in AP - you grab onto whatever you can, because it feels like a black hole.

    in response to your post and applying it to our case:

    1. Most applicants don't know why they are put on AP. - they told us at our interview as we were handing a 221g form

    2. AP is loosely linked to the counties where the applicants are born (Many people speculated the MENA countries born applicants may be likely to put on AP). - my husband is CANADIAN born, but his parents are from india and pakiland - so obvi that makes him evil and he gets put in AP

    3. AP can be as short as a few days. Most applicants are under AP for a few months (2-3 months). Some are on AP for 6 months or more. : it has been about 5 months for us now

    4. Montreal U.S. Consulate only communicates through e-mail, it is efficient to my experiences.: they took about 5 weeks to reply to our first email. then 3 weeks for the second email.

    5. You can check your AP status by calling 1 202 663 1225 then press 1, then press 0, then you will be answered very quickly by a specialist, they are professional, accurate, patient and helpful.

    this website is much more helpful and i check it everyday; altho i have seen some posts that it can be misleading and inaccurate in their status.

    already contacted a senator and they were given the same answer as we were.
    spoke to a lawyer who said they have no time constraints, limits to finish this task in and there is nothing she can really do to help us.

    i work for the Federal government, so unfortunately i have seen the inefficiency firsthand. not saying that there aren't hardworking efficienct ppl working in this department, but it's disheartening to wait so long when you know it could be done quicker.

    if i waited this long to take action for my patients/clients, they would die (literally)

    trying to keep a positive outlook and support each other on this forum.

  5. Yes, it is EB-1 or EB-1a. On the interview letter, it shows "Category: E1", it sometimes says it is "E11 category". All the same category. Thanks so very much for finding the information for me. Very much appreciated it! I am looking into those links you provided right now.

    Sorry about the confusion. I realized your links are about "E1 non-immigrant visa". My husband and I are applying for EB-1a immigrant visa (or E11 category, sometimes it is called E1 category).

    Sorry. USC means US Citizen. CRBA (Consular Report of Birth Abroad) doesn't apply to your case.

  6. virgo2012, yes. It is deeply depressing, frustrating, extremely devastating, mind grinding, torturing. However, what we can do is so little except wait. I wish no one had to go through this tough process. But once you get the visa, when you look back, this is only a glimpse of your life and let's all hope it will end soon.

  7. AP is something that can confuse you, frustrate you, shock you, even irritate you.

    Why are we put under AP?

    It seems there are vague assumptions that

    1. Lack of necessary documents(evidence).

    will ask you to send them the additional documents(evidence)

    2. "Red flags"

    It is a very blurry concept and many people have varieties of interpretation of "red flags".

    Typically, travel history, your birth country/region, medical history, etc.

    3. When CO feels necessary

    There are many guidelines/policies as to whether a CO is able to issue immigrant visa or not to the applicant. We may not be able to read the details of these guidelines/policies/laws.

    As to seek help, the White House is actually a great choice because your inquiry would go straight to the top of the administration. However, no authorities are able to directly impact the work of COs since they are working independently from other federal agencies.

    U.S. immigration law is very complicated. However, as I heard from so many people, U.S. immigration system is the most sophisticated and is probably the finest.

    So let's keep fingers crossed and hope for the best. If there are documents required by the consulate, get them sent to the consulate as soon as possible. Be honest, be confident and be optimistic. The green day will come to you, to all of us, eventually, sooner or later, but hopefully sooner.

    now i tried every where for help but got no help at all.wel i know we cant do anything to get out of AP its entirely upto them..but after keeping us in AP for years ,we are not sure that we will be approved or not,i seen alot of cases been in ap upto 3 to 4 years result denial....i mean they have to decide within 6 months,that they are going to issue the visa or denial...for there favour they have no law or rule that for the duration of AP....my conlusion is that we cant do anything to them.no help from white house,DOS,senetor or embassy.....its just stressing process.....the only thing that can help us to is prey nuthing else,for pakistanis no one is there to help...only AP is there for them....

    Yes, the ceac.state.gov site provides misleading information, at least in my case. I think you have to go by what the DOS tells you.



    Do they usually process the principal applicant first, and then they AP the dependent? Or it was done simultaneously so that the visas will be issued to both principal applicant and dependent about the same time? thanks.

    There's no specific time frame for AP. It could take a few days, weeks or months.

    The status check has remained the first one (1) untill this Monday. Has it happened to anyone else or does anyone has a clue as to what is going on? Is there a problem with ceac.state.gov site or something is going on at the embassy?

  10. Today is May 17, 2013.

    Principal applicant and spouse are both put under AP after interview in Montreal, Canada in early April, 2013.

    Today, checked status online, principle applicant's visa is "issued". Called DOS, told me both of principal applicant and spouse are still under AP.

    This morning, ceac.state.gov status looks like this:

    XXX2011000000 02 Administrative Processing

    Fellow VJers,

    1. Does ceac.state.gov provide misleading information?

    2. How long will it take for the spouse's visa to be "issued" if ceac.state.gov's information is true? Thank you.

    There should be a way you can make an appeal. Maybe it is time to talk to an immigration attorney and ask for some specific advice.

    I got the letter of rejection of my visa.

    But when i log in on www.uscis.gov my case number says its still on intial review still no change in status i dont know whats gona be the future.

    US emabassy people visited my home and confirmed about my marriage from neighbours and everyone and then also they rejected the visa its only because they felt that its only just for the citizenship

    I dont know how they will gona believe this as the time passing away life is running and our life is passing away staying away from each other.

    I dont know what will happen and when will happen.

    Any advice what should be the next step need to be taken.

  12. Immigration fraud is a serious crime. You should always be honest and take it very seriously.

    I came to the US in 2003 under student visa but never enrolled in a school. I found a US citizen to marry in 2006. I did get arrested for theft before getting my green card application but I did not put this on the application because the charge was expunged after I served 120 hours of community service. After getting the green card I got four other charges for theft but one of these was dismissed after I attended a class for first time offenders. Now I have divorced my spouse and he is saying I could be deported.

    My question is whether the theft charges could hurt me?. I read the law and it says these are crimes of moral turpitude but I would have to receive a sentence of one year for them to count. It also says that multiple charges are considered. Do each one of these have to have been a one year sentence? I have not gone to jail for any of the charges, only paid large fines, community service, and a class to go to. I have gone out of the country on vacation three times since then and never had a problem getting in. The last time I went I was pulled into another office but the guy there said I just have to carry the court documents with me when I travel. So I know I won't be inadmissible but can they deport me for anything? Will immigration do anything if they find out about the first arrest which I didn't report on my green card application?

  13. It most certainly varies from case to case as to the time required for AP.

    It could be a few days in some cases, a few fews, a few months, up to a few years.

    It is based on the complexity of the AP, volume of cases in the consulate, nature of your case, and maybe some other factors. It seems it is the necessary procedure that many people have to go through.

    you can talk to a representative about your case.

    If no further documents will be required, that may speed up your case in some way.

    Hello All.This is Khan with PD 03 Jan 2011 in F2A category. I had interview on 5th May 2013 in dhaka. My case is in "Administrative Processing". Is there anyone like me here?? How much time does it take any one know?? They did not return my original documents. The CO said it would take 2 months to 4 month to get my passport back with issued visa. As I have to travel to UK in June, 2013 for official purpose and I discussed the matter with CO. The lady was very polite and return me the passport. She also told me to return it to US embassy ASAP my return to BD from UK. Will that delay my processing ? or How much time is required to approve "Administrative Processing" in F2A category? Waiting for answers.... ....
  14. Now it makes sense. Not to blame anyone, now if your sister looks back, she would have rather chosen to leave voluntarily. Now it is a ten-year ban and it is extremely difficult to overturn this ruling. You may be able to find a lawyer to take your case. However, you need to cautious and informed that it may or may not help with anything in term of overturning the ruling from the immigration judge.

    To summarize, it is always a wise choice to obey the immigration law.

    By the way, when they fight at the court, did they have an attorney? How did the attorney do during the case, Did the attorney do a good job?

    Are they allowed to stay in the U.S. legally while their case is on "removal proceedings". Is there a deadline on the paper that your sister and her family had to follow?

    You can make an appeal from abroad. But you may have to find an attorney to represent you.

  16. You need an immigrant attorney to help with appeal. He/she will help you look after the case and communicate at the immigrant court.

    The immigration law has to be taken very seriously.

    What family reason caused their delay to come to America? Maybe the kids are little? Maybe the jobs that they didn't want to give up. The reason will be questioned every time they cross the border.

    Two things everyone always has to keep in mind,

    1. Respect the law and follow the law

    2. Be honest and truthful when answer questions to Immigration officers and custom officers and all other law enforcements.

    What does "removal proceedings" mean? Did they actually get a "must-leave-in-certain-days" order?

    What document did they receive at the airport? Why did they reside in the US for two years? What did they do in these two year?

    Hi everyone,

    My sister won green card through lottery 4 years ago. She and her husband her children received green card and since then they were not able to move to the US due to family reasons. For 4 years they kept coming back to the US for short periods of time to maintain their status until they move. Finally they decided to move in 2011. However, at the airport they were stopped and after the scrutiny officers found out that they haven't been living in the US most of the time. So, officers put all family members in removal proceedings. Since then my sister and her family have been residing in the US. After 2 years the court hearing was finalized and they lost the case. Judge put them in removal order and said that they have 30 days to appeal if they want.

    My question is:

    As far as I know they get 10 year ban because of this removal (deportation) order. I would like to know if they will lose all of their chances to come back to the US in the next ten years or if there will be any way at all to come back. And when I say come back, I mean in general - as a tourist, kids as students, or as permanent resident. I am a US citizen and live in the USA. It is not pleasant to know that your sister can never visit your home. Would there be any way at all to overcome this ban if needed?

    Also, I petitioned her last year (as soon as they were put in removal proceedings) to become resident as sibling. However it takes about 10-12 years to get green card through sibling. What is going to happen when the time arrives and she is eligible for green card through me? Is she going to be denied for the the current deportation order?

    Finally, please note that, they didnt hurt anybody, they didnt get deported for criminal issues, they are not even being deported by officers. They are just leaving the country with their own will upon judge's order. Is it going to help at all in the future when they need to come back?

    Today i check my case status and it says Expiring soon and my ds230 and pcc and medical also gona expire in the of this month ... whats mean of this papers are going to expire or petition?

  18. immigrant visa or non-immigrant visa?

    hi all VJ member i had my interview on the 6th may and all the questioned was unswered and at the end the CO offecier told me that she approved my visa but its going to be under administrative review and she gave me back my passport then she said they will call me within few weeks to bring my passport to pick up the visa, so i asked her how long it may takes then she said it would take few weeks. but when i come to read people experience over here some say a months and years so i hope some one have been through this can tell me what to do my wife called DOs and they told her that most of the case is solved within 60days from the interview.

  19. Would you have to go to the consulate for a non-immigrant visa interview? just curious.

    I've been in AP for a little longer than 2 months, my father in law has lung cancer and doing chemotherapy, but has spent 2 days at the hospital now with very high fever and not getting any better, my wife needs me.

    Should I email the consulate to let them know about this to see if they can issue me a temporary visa to visit my wife?

    Last day i got this email from embassy..

    Dear Sir/Madam,

    Our record indicates that your submitted documents were received, reviewed and found good to support your visa application. However, the administrative processing on your visa application is still pending. Once it is done we our office will contact you. We remind at this time that we still cannot predict the time this processing still may take

    I am trying to sponsor my wife to Canada Ontario from Bangladesh since last year july 2012. Her application was sent to the Canada immigration office here in Canada in July 2012. She has got the permanent residency approval to Canada in October 2012 and since then it is been sitting their in Singapore. Its been about 7 months and the canadian Immigration office in Singapore is still working on her file. The last time I heard from them they said that her application is in the review process and that was about 5 months ago. They had also mentioned that the her application approval my take from 12 to 24 months. Is there anyone out there who is or has faced this problem? Is there an way I can expedite her application? Please help.
