Ok well...my long story short.....I was born in Serbia (but im Bosnian) we came here as refugees when the war happened.......lost everything even doccuments.....spent over a year trying to get my birth certificate (when my mom was going for her citizenship--and i would get mines automatically) and they said that I dont exist....#######....well they i guess let my get my citizenship anyways (i was like 10) well....I thought this might be a problem too this time when doing AOS for my husband....so I just sent in my citizenship certificate and that was it......and there was no problem....maybe your cnadian citizenship could be enough....ask for sure!

Once you've been denied, unless it was in error (which this wasn't) then you're pretty much SOL and have to refile (I believe).
Here's why - the other poster that appealed, filed to re-open based on new evidence, that being the new sponsor. What is your "new evidence"? Can you post your denial letter or at least the reasons it lists for appealing? Usually it's something like "If you think this denial is in error you need to..." And they were correct to deny you, you missed the appointment and abandoned the process.
By all means speak with an immigration attorney and ask for their opinion on the denial/appeal and whether it's worth it. I would try and negotiate "If I don't get the appeal I don't pay" fees because they're less likely to just be trying to cheat you out of money.
I would also look at filing the I-130 and I-485 and what documentation you need for that. I'm not sure you need the I-130 honestly, the K1 is still valid and you married in the 90 days so you should just need to file the I-485 (but will most likely need another medical).
the denial notice usually gives 30 days, that's how long until she's out of status again and thus here illegally, unless you get her status extended by appeal/re-opening etc.
It might just be quicker (but not cheaper) to re-file the AOS... Lets see what others think.
Our lawyer suggested us to refile too because with the experience she had with appeals were not good or quick...she said she has had clients wait up to 2 years...but we took our chance anyways...we figured if it took more then 6mo then we would just refile...but we got lucky and approved fast and she said we were the first and she has done over 100 appeals....which most ended up in court or refiling.....but to the OP..go talk to the USCIS office staff as soon as possible and see what your options are!

WOW!!! Im so sorry you are going through this!! I am not sure how to direct you but I did want to tell you that my husband and I had to file an appeal as well after a denial (due to not having a sponsor) and we hired a lawyer and she filed our i-290b and we waited from end of July to Mid October for our case to be re-opened....
I would urge you to get an info pass...if they cant help you with the innocent mistake then I think you will have no choice but to appeal.
GOOD LUCK!!

I support Obama 100%. The principle of immigration reform makes sense to United States; however, they need to create more processing centers to deal with applications too. Otherwise, it will cause more backlogs. My 2 cents.
you took the words right out of my fingers lol

you are approved!!! congrats!!!!!

I think the blame should be on people. I am wondering if each one of us filed a complain against these unprofessional officers, would they exist anymore!! I doubt it, trust me some of them they think that they control the peoples' life, and that is why you see some of them they do everything in the interview but being professional. To all of you who are saying they have the right to question everything, I agree but in professional way, please go over this quote from USCIS in regards of the how the IO should be.
So for me if I faced such a situation, I am not gonna think twice about filing a complain to the field office director, nobody should be scared to do so thinking that the officer might deny your application, which he can't cos your file will be reviewed twice.
and it says dont bully-------um they bully......big...time!!!!

thats exiting!!!!!!!!! congrats you guys!

lol....well we did sign up for the text alert but we never got any at all the whole process so we checked online once or twice a day...but when we got denied and we were waiting to see if our Motion to Appeal was approved...wow we checked like 10-15 times a day and when it didnt change for almost 3 months.....we were to the point we would be pulling our hair out in worry.....but we made it!!
Also after our interview...since we didnt get the approval or denial at the interview we were checking the page over 15 times a day till we were approved...then like 2-3 times to see if our card was sent....this green card thing was the MOST STRESS I have ever endured in my life lmao....and I was smack dab in the middle of a war as a kid in Bosnia lol -
I've crossed the border thousands of times (literally) as I am a dual citizen and one thing I learned is that different CBP agents have different tactics to see how you react. Some of them act like the officer you talked about and other times they try to act buddy-buddy and then turn answers against me. Some play dumb, some act like they don't care. In the end it always turns out okay even if it seems like they have been out to get me. They just have these weird tactics to try to work on people. I suspect everything will turn out okay and the officer was trying to make you uncomfortable on purpose to see how you would react. Some people under pressure like that will just give up or confess to something they have been hiding. Although it may see ridiculous to you, if the officer has seen it happen before then they know it works and that becomes their method. Anyway, just a though.
Good Luck!
Very very true!!! They do that as like a test...some intimidate, some are sweet and bubbly (like ours-thank god) and some are rude....some are just plain mean...I have heard so many horror stories of IO......our friend had one who was so mean and sarcastic.......he made our friend the wife (immigrant) cry...he told her to even 'hold it together or this interview will be over'....they are sick!! Too bad we cant report/omplain about them....they get paid to be asses....i still count my blessings that we had a sweet one!!!

I understand that some posters on public forums (I am not naming names or making a personal statement, this is not about anyone in particular, it's just a general note of impression left after reading some posts on public forums) , so I understand some posters come from despotic third world countries , where there is indeed "The Man" who can do as he pleases with little to no regard to existing laws, abuse and demean and humiliate the citizens for pleasure as infamous Emperor of Rome Caligula would do.
Thus, even after coming to USA, these individuals project their own tyrannical government system upon the US , hence they are trembling, with fear and apprehension that "The Man" can just do to them as he pleases.
These individuals would do favor to themselves, as well as to United States, by according to our system of government greater Honor and understanding that we have no Chavez, Assad or Ghaddafi style "The Man" ruled form of government here where anyone vested of public trust can do to us as he/she pleases. Instead, WE THE PEOPLE electorally decide WHO our man will be and we put men there (Be it in ICE, USCIS, or any other Government Agency) to be IN OUR SERVICE, NOT to fear and tremble that some dumbduck will arbitrarily and without any legitimate grounds abuse his powers and do us harm for no existing reason.
This is a s far as "The Man" part of the reply concerned.
As to my reply to the OP, notice that I have made no mention of need or absence of a need for the professional help, I didn't even delve into the OP other than questioning how could what OP describes really take place? I am still very skeptical of OP account , though I refrained from calling him a troll or deliberately making the story up.
I wish OP lots of luck and best of what life has in store for him.
To the rest: HONOR your newly adopted Country, The United States of America!

You heard wrong.
Getting knocked up only demonstrates that you don't use birth control, and does not demonstrate that you qualify for an expedite. An expedite is essentially taking someone else's spot ahead of you for yourself.
http://www.uscis.gov...00045f3d6a1RCRD are USCIS' expedite criteria.
A high-risk pregnancy, where either the mother or child's life was at risk, would qualify for an expedite. A normal pregnancy (i.e. most women's) would not.
thanks for the clear up!
