  1. Not sure. I think they might mean to contact them after 30 days of it saying they sent you the interview notice.

    But from what I've been reading on here, most ppl get their interview date within 30 days from it saying "testing & interview". A lot of times it's about 2 weeks from it saying testing and interview to getting the date.

    Then about a month till interview.

    How long has it been since yours updated?

    Ohh okay.

    Over 2 weeks.. Have you gotten any updates to your EAD case status?

    Our case is being processed at the NBC. What about you?

  2. He won't be deported if he has a pending I-485, they wait until that has been decided unless he has committed a crime, so I wouldn't sweat that too much.

    I know one of the I-485's will be rejected due to him having another one pending, but I can't remember which one takes precedence, I would assume the one that was filed first. Needless to say it would be a VERY good idea to send in a notarized letter along with a copy of his divorce papers letting them know to cancel the old case so it doesn't tangle up the new one. Be sure to let them know he has a current pending case and reference the case number. An Infopass appointment might be the fastest way to get that done. :)

  3. Very confused about when was the previous one filed, if he has been here since 2007 and got divorced in 2011. He needs to get a infopass appointment to address previous application before they deny both.

    The first one was filed October of 2007. I forgot to add that his I-94 expire in September of 2009, i don't know if that effects anything.

    My husband and I consulted a lawyer before we filed for I-130 and I-485 and since it sounded like a fairly simple process and would save us some money we opted for doing it solo.

    As you can see my time line below so far so good. To add, the case status for his I-485 (the one we applied for on 03/04/13) says its in line for interview scheduling.

    But,

    On march 29, 2013 my husband was contacted through email about his previous and still pending I-485 application which stated that it was moved to another office. The notice came in for this application and stated it was sent to the national benefits center (where our I-485 is currently located also.)

    So to press rewind,

    He came to the u.s. as a dependent on his ex wife's employment based visa in April of 2007. They broke up late 2009 and we started dating February of 2010. We moved in together shortly after, his divorce was final in march 2011, we had our baby in November of 2011. Up until march 29, 2013 there has been no update on his previous application.

    The lawyer we went to said there is no need to cancel his previous I-485 and we should just apply for a new one. I have a feeling I must cancel this previous application. Something just doesn't feel right if I don't.

    Should we? If so, how do we go about it? And what will happen when it's cancelled? Deportation notice or is he ok because of his new application?

  5. People are not being dramatic. The title of this post is very misleading and the other people posting out there want to ensure that the correct information is available. For you to say that people are dramatic is a bit insensitive. If I was waiting for a petition that was taking over 8 months or longer to be approved, while being seperated from my loved one then I would be, in your a opinion, a bit "dramatic" in correcting the OP.

    You might want to think about that before you post a comment about being dramatic.

    Again, you can correct the op without being so dramatic. You are entitled to your own opinion but you don't even know who I was referring to when I said that general statement. She came on here with good intentions an whether you did what she said or not it is everyone's responsibility to research and double, triple, quadruple check the way they apply for these things.

    The way most people responded was so defensive as if she meant to mislead anyone. And if you see someone already responded to her post saying EXACTLY what u were going to say, maybe refrain from posting it. No body needs to see the same thing a million times, I'm sure she has no problem reading it the first time.

  6. Just an update for those following on this thread:

    I just checked my case status to see if it was finally working and only the I-485 works and its at testing and interview!!

    It says if I don't get an interview date 30 days from when the notice was sent out to call them! Woohoo.. Interview in the near future, maybe ? I hope so.. :yes: keeping checking your statuses guys!

  7. 1. For showing proof of valid marriage, How many months’ bank statements are required? None but highly recommended. the more you have the better. Is one month fine? Yes. Is it a problem if one of

    the old statements shows a different address? No.

    2. Can I show my income in support of affidavit. My wife used to work till last year, but now she is a full time student. Yes. Message me if you need help.

    3. Do we need to submit documents from my employer stating my salary or is it enough to provide W2 forms and a letter from my employer stating that I am an employee of the company? It's enough without the salary. Add 6 paystubs with that.

    4. For proof of valid marriage, is it ok to have just 1 sworn affidavit, 1 bank statements each for 4 different accounts,1 credit card statement and 1 void check leaf for yet another bank account. I also have a common health insurance card, auto insurance. She being listed as my emergency contact at my work place. A summary page from work which shows her as my beneficiary, Cellphone bill with her and my phone number. Also I have a online Air ticket confirmation mail for a vacation we had together with both our names on it. Are these proofs enough. Yes. Perfect. The more the better. Add pictures with descriptions on the back and dates.

    5. I don’t have any proofs for any vaccination as my vaccines were administered in India. I don’t think there is any way to get a proof for this. I might have a proof for the Flu shot I have taken. Will I have to get all the vaccinations again. Yes. You need to download and add the I-864 form and then go to a "civil surgeon" and get all of this done here in the U.S. go to the uscis website to find a civil surgeon.

    6. Is there a premium processing to get things going faster? No.

    7. Do I need separate checks for each fees or just one check. One check for I-130, one check for I-485($1070 this includes biometrics)
