  1. I submitted only the tax transcripts for 2012 2013 and 2014 with other paperwork required with the N-400. I'm now in-line for interview.

    As evidence you for 3 years filling you only submitted this wow

    I have been think about this because all the evidence was initially submitted during the ROC why resubmit again

  2. I'm submitting the last 3 years joint tax returns (Including 2015), joint bank account statements (one a quarter for 3 years), mortgage and deed details for our house, health insurance cards, joint cc statement and then the other stuff that they asked for....

    Probably overkill, but since its just a matter of printing out stuff we already have scanned, its quick regardless of the quantity etc.

    But we dont need to produce the same load of evidence when we submitted the ROC? I see that your timeline is like 3 weeks apart from my wife

  3. Hi Guys,

    I need some advice. I just received my NVC Welcome Letter with a checklist of things I need to submit for the next step of this process.

    One of my concerns is that I have filed Head of Household for the past 3 years on my tax returns.

    I married my husband in October of 2014, but he obviously still lives in Guatemala and I have been supporting my son and I this whole time.

    My husband does not have an ITIN #, so that is why I filed the same way again.

    Am I going to have problems at the NVC for how I filed? Should I process an adjustment to my tax returns for the last two years before I submit all of my documentation to the NVC?

    I am so concerned.

    Any help would be appreciated.

    I equally filed head of household and i know 2 other friends that did the same thing with no problem my wife is here and my other friends wife is here with not problem.. I think what they look at is the income bracket if it is above poverty line

    • Jan 1, 2000 – Miriam becomes a permanent resident through marriage to a U.S. citizen.
    • Jan 1, 2000 to Jan 1, 2003 – Miriam travels to England 4 times on 1-month trips to see her family. She maintains her residence in the U.S. and continues to stay married to the same U.S. citizen husband. Her combined time outside the U.S. was about 120 days (4 months). She takes no other trips abroad.
    • As a permanent resident married to a U.S. citizen, Miriam may apply for naturalization after just three years. So on October 1, 2002 (90 days before Jan 1, 2003), she can file Form N-400. The 4 different 1-month trips did not disrupt her continuous residence because none of those trips lasted 6 month or more.
  5. Ok I think this is clear look on the instructions sheet of the N-400 under early filing. It says that you can file up to 90 days before meeting the required 3 year continuous residence as an LPR. Although an applicant may file early according to the 90 day early filing provision, the applicant is not eligible for naturalization until he or she has reached the required 3 or 5 year period of continuous residence as a LPR. So to confirm for the final time after rereading, you can file early or should I say your wife can file early but she doesn't become eligible until the full 3 yrs has been met. I also believe that anytime outside the country may delay the 3 yrs as well. So it must be 3 years of living together.

    The 5 years rule is very clear but the 3 years rule with US Citizen living together for the past 3years is not clear

    Where did you read this from ?

    INS is very confusing sometimes

  6. Actually, you can file 90 days prior to having a GC for 3 years, but you can NOT file 90 days prior to being married to a USC for 3 years. There you have to wait the full 3 years. The question is if it's enough to be married OR married and living together for the full 3 years.

    OP I believe to wait out the full 3 years in this case before filing.

    So that throw the 90 days out of the window i wonder if that is what everyone who entered with green card with 2 years did. If they all file 90 days prior to becoming LPR for 3 years that means they only live with their US Citizen Spouse for 2 years 9 months..

  7. I'd personally add a week to it to be on the safe side. Personal example: I had been a LPR for 3 years on 12/21/2014. I filed my N-400 09/30/2014.

    As to your question about co-habitating during the full 3 years, I'm not a 100% sure. I know one has to be married to their USC spouse for the full 3 years before filing (no minus 90 days to file at on that one), but I'm assuming you were married for 3 years & living together for 2 and 3/4 years.... So I'm not sure, actually, if being married for those 3 months is enough or you were supposed to be co-habitating as well.

    We got married on 3/15/2012

    I can send it the last week of April 2016 but i need to confirm the 3 years of living together ,,does someone have an answer to this ?

  8. I am getting ready to apply for citizenship for my wife but i am concern about what https://www.uscis.gov/ says about the 3 years rule husband and wife must have lived together for 3 full years. I want to file for her citizenship based on 3 years rules

    My wife came in to the USA on 07/13/2013 which means we started living together as of 07/13/2013

    So on 07/14/2016 we fulfill the 3 years full term of living together but INS says we can file 3 months before which is we can file on 04/13/2016

    Can someone share some light on this matter

    Can i file for citizenship on 04/13/2016

    Can i file for citizenship on 07/13/2016 which meets 3years of actually living together

  9. Thank you, thank you, a million times thank you. I know you remember me :) It's not like I didn't like your opinion it's just that I believe in a greater power. My faith is bigger than man's opinion. My God sits high and looks low and He will repay anyone that seeks to do evil even if it is my dear husband. No weapons formed against me shall prosper! I praise God that He is working things out not as I would like but as according to His will and I am at peace with whichever way it turns out. So my dear husband is not using my faith to con me. We are from the same church. God will give every man his just reward.

    I'm sorry if you feel I wasn't responding right or that I may get huffy. I'm not trying to be that way. I just wanted answers. I have no problem with other side comments, AFTER I get the answers that I am posting about. Now I have them so all good. One other thing I came here because my friends that I have who's husband's have ROC'd couldn't answer so they pointed me back to VJ. Then I come here and get a lot of other comments so I was back to square one which is, who can give me the right answers? I was tired of going back and forth, and again I do understand USCIS position on the purpose for him being here. Thank you all again!K

    You know I am reading your post and u need to be more serious about it than your husband send me another money for ticket.. so that he does not miss the 5 months 30 days of staying out of the country

  10. eh - timeline matters, don't forget this.

    If RoC was applied for, and not granted yet, [and not denied]

    then

    dig out a calendar, compute 3 years minus 90 days (89 days this year because of a leap year)

    from 'resident since' date on the first green card

    then

    that date ?

    That's the date , that's the date the friend can apply for citizenship. It doesn't matter the RoC casefile status. Some folk here at VJ have done this with positive results, gotten their citizenship granted and gone to the swearing in ceremony.

    It's a boon-doggle, for certain, as

    the A-File that was moved from storage into an adjudicator's queue for the RoC case,

    gets moved to the local office for the Citizenship interview. There's nothing to worry about,

    on this casefile movement, on your side, at all.

    Do you have links to other people that actually did this because my wife filed for roc since april 2015 and no response and she is due to file for N-400 by april 2016
