I will attend my oath ceremony 5 days before a planned family trip out of the country.  I will therefore apply immediately after for my passport.  My minor child would have derived citizenship at the same time. I want to avoid the extra cost  and timeframe required to get passport consent from her father in the country we are travelling to, and delay applying for a passport for her until we return from vacation.

     

    Question: Can she still travel with her green card and foreign passport?

  3. She could not have legally being married in 2013, because as she later found out she was not officially divorced at the time of the second marriage.  I suggest she just 'get married" and because that first marriage is null and void....is not recognized.  

    GET married, apply, and send an explanation  at some stage in the process , and prepare to address any other question they may have.  If everything is above board then it just delay not the end.   Good luck to your friend.

     

    A lawyer may just make it smoother too.

  5. Does anyone know why is taking so long to receive the 10 gc? 9 months and still waiting. A friend of my husband's and I, has not been married for 2 years, and already received his 10 year green card. He was told since USCIS took longer than usual to mail him out his 2 year green card, they sent him the 10 year one instead. He advised us to call and keep calling, but we know that doesn't make much of a difference. Any suggestions? Should we set up an info pass appointment? It's almost a year and we were planning on going for vacation but since the NOA we received its only good for 1 year, what can we do? Do we apply for another AP and EAD?

    I have the same problem here...its been 10 months and i have heard nothing, except a request for my daughter go biometric for photo only. My NOA date is 07/2/2015, and my biometric notice was for August 4th. At the time they made no request for my 7 year old daughter to go in for biometrics. We only got the notice for her 1 on month ago. I am hoping it means someone is looking on our file, because we do have vacation coming up in July as well.

    My research has shown that they definitely do want it separate. So separate cover letter and checks for all three and they want the separated in the package with clips of rubber bands.

    My only nervousness is that I have enough proof. I may chicken out and add a few pics of the girls with me

    I did not worry about providing the multitude of evidence at the application stage (sending in I-130) as the USCIS at this point only needs to establish whether there is legal relationship satisfies any of the categories for family-based immigration.

    So in my estimation including your a copy of the marriage certificate in each of the 3 applications, will establish the relationship.

    After you have sent in your application, you can use your time to start gathering and organizing your evidence of bonafide relationship. Upon your application approval, your documents move to the NVC that in short order will instruct you to complete and fill out immigrant visa application. At this point it a good idea, the send your evidence package you have prepared along with your completed visa application, and police record.

    Your order of process:

    1. Application sent to USCIS (longest wait time in the process that you cannot control)

    2. If approved, your documents go to NVC (National Visa Center - Department of State)

  8. I received my removal of condition notice today July 11, but the NOA date is July 2. My 7 year old child NOA, dated july 7 (extension) did not make any mention of her getting a biometric notice in the future as mine did. Questions:

    1. Does anyone have an idea of how long before I will receive my biometric notice and what is the time frame between the the notice and the appointment?

    2. Will my daughter be required to go to the appointment? or better yet will she receive notice for biomertic?

    I am very worried, a my daughter is currently out of the country for summer until August 4, and I will july 22 to come back with her on August 4. Is there any chance the appointment date may be after August 4. I am crossing my fingers.

    think eventually its more cost effective to let them do the necessary vaccins at the medical, as the health centers may not have all the vaccins u need to give you at once.

    if you are not given all the vaccins you at once, you have to wait 6 weeks before you can take any other, which might run into the time of your medical, at which time, even if the doctors at the medical has the one you need they may not be able to administer it, resulting in an incomplete medical.

  10. Just wanted to know how long iook before you were able to pick up your passport at the DHL head office in Kingston. And when did your status change on CEAC website?

    you should check the ceac site for the status: it normally is in AP for a day, before it changes to issued, as in my case. I did my interview on Jun 27, 2013 right before to the weekend; they do not work on weekend but by the next Tuesday july 2 mine was issued. It went just as fast for my daughter step daughter and mother in law.

    if no complications it is normally very quick in kingston.

  11. To clarify, that's correct if she is no longer married to the petitioner. Then, it would be five years.

    The keyword is married, not "with". There is no requirement to be "together".

    correction .. the rule does say you have to be" living in union" with the spouse through whom you acquired the Green Card. So its safe to say that 3 year rule requires more than just been "married to".

    If you are married and estranged, with no proof of a bona fide marriage, just a paper marriage, you cannot naturalize at 3 years.

  12. Hi guys, could someone apply for social security card once he arrive in the us, before receiving his green card? When the only document he posseesses is his passport?

    I went to the social security office 7 days after POE and my information from immigration was already in the SAVE database, so I say go if you want. Take your passport and birth certificate with you to make sure everything is smooth sailing.

  13. Nothing to worry about. All visa approval goes through NECESSARYAP stage after an interview. This type of AP is mostly like final administrative paperwork being done, and it includes the process of getting your visa ready and placed in your passport, your immigration envelop package ready for you. If all goes well normally that status should changed to ISSUED in a short time.

    I can understand the shock of seeing those two words, because it had me for a while too until my status, and the rest of my family status change in 24 hours after the administrative phase.

  14. Well my husband & i went for his passport with visa inside and the immigrant package to give DOHS at the airport POE. But when we opened the DHL packet, inside was the passpost and a big packet of papers. But whats so strange is the top left side had been cut out in a triangular shape so i could see all the papers inside...im wondering if this is normal because i know on USCIS.gov that they say specifically dont open the packet or else a fee will be charged at the airport! But in my case its somewhat opened already! What should i do? Also they issued the visa 2 days before our 2 year anniversary. And it ended up being a CR1 visa. But i was reading online and it says i have to file to remove conditional residence 90 days prior to our 2 year anniversary or they can have the green card revoked!!!! How can i do that when he hasnt even reached in the US yet (we are goin next week) and our visa was only issued two days before our 2 year mark???

    That triangular cutout is normal, as they usually are; just dont open anywhere else. It does not matter that your visa says CR1, what matters is the time you make your POE into the US. Obviously its going to be after your 2-year anniversary. Just make sure to point out to the immigration officer there that you are now beyond your 2 year anniversary, and they will make the necessary adjustments to make sure you get your 10-yr GC.

    Remember you will be required to pay the $165 fee to have your green card processed. You are encouraged to pay this fee before you go even though it can be done getting the US. Just remember that the card will not be processed until payments are made.

  15. So happy right now!!! well my husbands ir1/cr1 interview was last week Thursday February 20th 2014. I was so nervous but happy at the outcome of the interview. He was approved! When i checked CEAC website Thursday & Friday it was saying Ready...Now I checked CEAC website and it changed this morning from Ready to Administrative Processing then couple minutes ago i checked again and it changed to Issued!!! That means by Friday DHL will have it ready for us to pick up...or maybe earlier who knows. So happy. Worried about administrative processing for nothing! Everything is moving extremely fast! I have to thank God and u vjers for all your knowledge and advice! Good luck to everyone else on their journeys!

    congrats! I am also pretty certain you will get a waybill number by tomorrow or Wednesday, meaning your passport has been picked up by DHL.

  16. You can never be certain about when you will get issued issued. They will tell you that it can take weeks, but for some of us it can be less then two weeks. In my case I had my interview on June 27th, and my CEAC status changed to issued 4 days after and my airway bill number sent.....My passport was ready for pick up the day after my status changed to issued. My daughter and mother-in-law had their interview on a July 2 and I was able to pick their passport on July 8. But the average time seems to be anywhere around 2 -3 weeks

    Can anybody tell me how long it takes for JA to issue a visa? Our interview was on Jan. 6th and approved. Thanks.

  17. If you didn't send much with the I-130 package, then in your case, I highly suggest you send whatever you have in the IV package. Remember, in a lot of cases, the CO has already made the decision on your case before you get to the interview. So, the more evidence you provide, the better your case will be.

    Totally agree. We sent our secondary evidence to the NVC with our IV application. And it seemed they had already reviewed what we sent and made their decision even before the embassy interview. I was never asked more than 3 or 4 questions before approval .

  18. I know this is a long drive but can you go to Kingston @ St. Andrew Hospital call them to see if they have anything available. Then you can pickup your packet the day before your interview and just stay over somewhere in Kingston the day before. Just a suggestion. You can always go to the interview without the medical but you will get a 221g to bring it back in and then that will put a little delay on your visa issuance.

    I would suggest he goes to kingston....Medical Associates seem to have a more competitive price. My mother in-law had no immunization cards and needed to do four shots and the total cost of her medical was less than J$21,000, in June of this year and they schedule medical twice pee week, and you normally pick up the day before interview, so he could always stay in kingston the for the interview the next day.

    If you need a stay on the economical side, he could always get a night over at the Mayfair hotel (J$7500 - 8000), on West Kings House Road, which is about 5 minutes from the embassy without traffic. It convenient for the purpose for which you intended. f he doesnt drive he can always arrange with the hotel to call him a taxi in the morning \.

    No need to be nervous...Its a lot easier than it sounds in Kingston. As long as your husband is able to answer the questions confidently. I was never asked for any more evidence at the interview, not even phone records, nor text logs, and was only asked 4 or or so questions, in an interview that lasted may 3 minutes...ended before I could nervous.
