  2. Here is the guide to AOS http://www.visajourney.com/content/k1k3aos

The applicant ( foreign spouse ) needs to submit passport pages, the petitioner ( USC ) does not.

There is more to submit than a tax return, please study the guide.

Thank you, that is the guide I am using. I am speaking particularly about the evidence required for I-864, which does not require the the foreign spouses passport (though I-485 does).

According to the checklist on the last page of the instructions sheet for I-864, all that is required for me is a copy of my tax returns including W2s.

    http://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

My passport, or any other documentation, is not required as I am not a joint or substitute sponsor.

I wanted to confirm that this is correct, so if anyone has contradictory evidence please let me know. Thank you.

  3. Hello, I am filing my I-485 and for the I-864 I saw some other people submit a copy of their passport... but looking through the instructions, that is only needed if I am a joint or substitute sponsor. It also says I don't need to do this if I submitted evidence of citizenship with my I-129F, which I did (My passport).

So I want to make sure. All I need to submit is my tax return, and I don't need my passport or anything else?

    Thank you

  4. To clarify, are there certain documents that you need multiple copies of (such as copy of passport, copy of marriage certificate, etc) that you put a copy of in each section? Like a copy of the non-citizen passport goes in the pile for the I-485, one copy goes in the pile for the I-765 stuff, and another goes in the pile for the I-131 stuff and then you stack all the sections together? Because I've been following the Step-by-Step Guide (http://www.visajourney.com/content/k1k3aos) especially the assembly instructions and it makes it seem like I only needed one copy of the non-citizen passport (shown as item # 4 on the list) if that makes sense. Basically- should each form have all of it's own separate documents, even if that means that the AOS packet you send in ends up having multiple copies of the same document, or do those forms (I-485, I-765, I-131) "share" all of the same supporting documents?

I was confused about this and asked the same question a few weeks ago. The answer is yes, you need to duplicate the documents for each form that requires them.

  5. Hi - Can you please explain more? Are you saying that they have access to emails/fb chats/google chats/whatsapp for K1 purposes regardless of what I submit? For example, I submit a partial list of whatsapp chat for proof of ongoing relationship and can they pull out my full list of chat and also chat from other social outlets like fb/google etc?

What evidence has already been submitted to them? Are you bringing additional evidence that was not submitted with the application originally?

I don't think USCIS is going to use the NSA to see your internet communications.

Travelling to the USA and making wedding plans is normal for people who are engaged. They are not going to be offended that you are presuming your visa will be granted or something. I wish people would read on here before they made plans like this though - the visa process is very uncertain and no plans should be made until you have the visa in your hand.

Be careful here. They are going to ask you when your wedding date is, where your wedding will be, things like this. You do not want to get caught contradicting yourself. How do you avoid this? Tell the truth 100%. You have wedding plans and flight plans. Don't try to hide stuff... you don't want to appear sneaky. That is my advice...

edit: Sorry I forgot to address the husband/wife part. Probably a good idea to remove that and call him your fiance. I have heard interviewers ask "is your husband blah blah blah" and if you don't say "fiance, not husband" they get weird. Don't worry too much - just relax and be honest.

  6. My fiancee just noticed this language in the requirements - The certificate must also indicate that the public office extracted the information from official records.

Should the Gong Zheng Shu include a specific statement to that effect? Has anyone had any issue with this specifically, or is there only one kind of Gong Zheng Shu.

You do not need the certificate from the hospital. Just get the one from the gong zheng chu, the notorial certificate translated into English and made into a white booklet made from official records. This is what they are looking for, this is what we used, and there was no problem at all.

  7. My wife did submit the documents to CITIC on 5/24 with a printed out e-mail and coversheet. So, far.... nothing... not even an e-mail. Is the visa a sure thing? Should I ask her to start the process of quitting her job now? It's going to take 3 weeks.

    Hello,

I just want to say the visa is not a sure thing until your wife has her passport in her hand with the visa in it. I would strongly suggest you don't do ANYTHING until you have this.

Your post is 2 weeks old, has anything changed yet? I know there was some trouble with issuing visas globally as Darnell said.

  8. My fiance from the Philippines can't understand English, and I'm getting really worried about her Port of Entry "interview" at Washington DC. She could probably understand a really basic question if spoken slowly but I think it will be difficult for her to answer back. Being a Filipino myself I communicate with her entirely in her language, but that kind of worked against us in this situation since she didn't get to practice English at all.

Her K1 interview at the embassy went extremely well. I was there at her interview and surprisingly the consular officer asked all of his questions to me and none to her. As far as paperwork, we were complete and had tons of evidence to prove our relationship. A major point of evidence for us was our 5 yr old son's Consular Report of Birth Abroad paperwork showing that he's a US citizen. He will be with her at the POE.

The POE reviews in this forum show that most of the time the CBP officers are nice, but then there are still some that are very serious and ask a lot of questions. I'm afraid she might answer wrong and get denied...

    Any advice?

I think she would have to say something pretty crazy to be denied entry after a K1 visa has already been granted... Are you going with her? If so, you can walk up to the counter with her. That is what I did. You already did the hard part, the visa was issued and the CBP guy is just supposed to make sure the packet isn't fake and that the person in front of him is the person in the packet. Everything will be fine my friend.

  9. Hello,

I am assembling my AOS packet and also including I-131 and I-765. The guide here says to file those forms along with their supporting documentation. A lot of the supporting documentation is the same among the three forms, should I still include it three separate times and also list it on the cover sheet?

I think the answer is "yes" I just want to make sure.

    Thank you

  10. Hello all,

This is kind of a nitpicky question, but the Apartment number box on I-846 cannot accept a number over 4 characters long. On other forms I manually edited the PDF to enter a 5 digit apartment number, but this form uses the bar code at the bottom to scan the information in... so if I manually type the apartment number, it will not alter the bar code and it might get scanned in incorrectly.

If I print it out and hand write in the apartment number, will it be overlooked since the rest of the form is typed?

Should I just attach a continuation sheet for this one extra digit?

    Thank you

  11. I am filling out the G-325A for our K1 AOS and I am wondering how perfect everything needs to be. For the K1 I was extremely careful, making sure everything was exactly perfect. Now I am wondering if I must take the same care with the AOS paperwork.

My main concern is if I can highly abbreviate the addresses in the "Applicant's residence last five years" section or if I should write "See Attachment" and attach a suplemental sheet with the full addresses as I did for the G-325A when I filed the K1 application.

Any thoughts? Are the requirements just as stringent for this?

    Thank you

  12. Hello everyone,

When we go to the civil surgeon here in USA will they use an interview to determine which shots my wife needs? She did not have all of the required vaccinations at her medical exam and did not get them at that time. We have no record showing which ones we need, how do we know which ones we need?

    Thank you

One more thing, in the instructions for AOS it says K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F ** but I am not sure exactly which paper is the approval...

  13. I have not read up on this, but if my memory serves correct... your suppose to claim anything you bought or gifts received abroad upon returning to US.

Its cool you want to give the expensive jewelry to your fiancee.. I would just be sure to keep it very close, that should be your only worries.

Now what I would do... bring all the jewelry, bring all the sales receipts with you, when you come back..I believe your coming back to U.S. with your fiancee...carry the items on you so there you have no need to declare the jewelry because you brought it with you, and bringing it back.

As the other responce before me said... they don't promote cheating.. well I believe in dont Tell. That's me though. I've bought and brought a lot of items back for myself, for gifts, and to sell.. Always declared 200 to 300 USD on the card we fill out upon returning to US.. that of course is not even close,.. but anyways, I have never been searched or items confiscated. Only once leaving Shanghai was I stopped and taken to the security room to search and confiscate an item from my check in luggage. It wasn't jewelry that's for sure..haha!

I honestly think your stressing over nothing. Relax, enjoy the moment. good luck to you!

I just bought our plane tickets! woooooooooooooo!

  14. If she can get the shots done in china, have them entered in international shot record book.. [its yellow in colour].

regardless of your insurance plan, a civil surgeon will not accept your insurance.

I wonder what my insurance company will do if I send them the bill

I can pay with my HSA if nothing else, so at least it will be tax free.

  15. Simplest --> Keep the US purchased jewelry until she get here.

Desire to show off to other's is a fluffy way to live a life...and all that is going to do is create jealousy.

Simpler --> Declare to Chinese customs all jewelry that you take to China.

That said, everyday, travelers are going in and out of China wearing their normal jewelry

and I'm pretty sure majority of them are not declaring them...but this is VJ site and we

don't promote cheating...so do the right thing...especially if she has a bulk that

she will be carrying with her. That's both in China and in US customs.

Thank you for the advice. It is not really to show off, but if her family sees her leave China with me and I don't even give her a wedding ring they will think I am a poor idiot and they will be very worried about her well-being. They would really be worried about her haha.

  16. Health insurance might cover the shots, but any shots she gets in US needs to be

transcribed to I-693 by a civil surgeon, and most would require another full medical exam

    which can cost $500+.

You need to update the timeline.

But if she already had the medical exam and refused the shot,

and already had the interview, then it might be too late to get it in China.

Oh yes I can update my timeline now. I did not want to update it because our case was in AP until a few days ago. I did not want to post details of our case on here during that time.

It is too late for her to get the shots in China, we will just have to do it in USA.

    Thank you for the information!

  17. Can share the url?

    http://www.travelchinaguide.com/essential/customs.htm

Here are the parts that relate to me specifically:

Can you give specific information about the things need to be declared?

Entering China: 1. Any item that will be left in China whose value exceeds 2,000 CNY

Exiting China: 2. Gold, silver and other valuable items

I will not be leaving anything in China, so I have no problem entering. But see exiting China, they say declare gold and other valuable items. It does not say anything about where I got the items etc.

  18. I am reading over the customs declarations for China and it says for outbound travelers (leaving China) all jewelry must be declared. It does not specify jewelry that you brought in to China or bought in China. I would assume they only mean items purchased in China, but I do not like to make assumptions when the consequences could be severe. If I bring jewelry to China to give to my fiance and she leaves China with it, do we need to declare this? I cannot find a clear answer.

For the entry, since I am not leaving anything in China, it seems I do not need to declare it. But for exiting, it says jewelry must be declared, without mentioning if the jewelry was purchased in China or not.
