  1. Adios Janet. I must give credit where credit is due, and say that your sadistic agendas have been instrumental in keeping my fiancee and I apart for 10 months and counting.

    I think the Administration might have wanted to transfer Napolitano to the University of Kansas. But then they reconsidered, realizing Dorothy's house might land on top of her.

    Well at least she's in California. UC, try to give Napolitano a beachfront office. At least then some of us can hold out hope it cracks off and falls into the ocean. Not that I'm not bitter or anything.

  2. Thanks everyone. We got an RFE because the previous photo my fiancee had taken was retouched by the photographer to make her look real nice and professional but the USCIS said it didn't meet their guidelines. Everything else about the photo - background, size, etc. was fine so we can only imagine it was the photo retouching that was the problem.

  3. Finally got my RFE hardcopy today May 22. The date on the website that they said they mailed the RFE was May 14 and this was also the date on the RFE I-797E form as well. The letter was postmarked May 20. I have an axe to grind because of the difference between the alleged mailing date and the postmark date, but will deal with that at another time.

    Here was my RFE -

    REQUEST FOR EVIDENCE:

    INTENT TO MARRY: The petitioner and beneficiary must each provide an original statement (signed and dated) indicated that they plan to marry each other within 90 days of the beneficiary's admission to the the U.S.

    PHOTOS: Submit a passport-style photograph for the beneficiary, [name]. The specifications are as follows:
    - Glossy color
    - Plain white background
    - Unretouched
    - Not mounted
    - Full frontal facial image
    - About 1 inch from bottom of the chin to the top of the hair
    - Taken within the past 30 days

    So I think my "mistakes" were not sending sponsor intent to marry signed notice and/or personal letter (the instructions I had said just to include beneficiary intent to marry notice and personal letter), and I think the passport photo of my fiancee was professionally retouched by looking at it.

    I'm still a little vague on the scrutiny given to passport photos and what sponsor intent to marry letter(s) they are looking for, so any advice or feedback from folks who had similar RFE's would be very welcome.

  4. How about fighting to ensure that the USCIS Service Centers are appropriately resourced to process all legitimate claimants in a timely manner? Ultimately that's what we need. I don't think that I'm more entitled than anyone else. I don't want our application to be delayed because there are too many other applicants whose applications are being prioritised either. But the solution is not to deny other people the same opportunity that we are applying for. The solution is to ensure that the processing organisation (USCIS) is properly resourced to process all applicants without delay.

    This bill is a slap in the face to anyone who has immigrated to the US legally or is going through the process now like us. With DACA we have already seen that the administration and the USCIS under its control has putting illegal aliens ahead of American citizen petitioners. If this bill passes and 11+ million are granted amnesty, whose paperwork gets priority first at an even more constrained USCIS processing centers? You don't have to answer the question, because we know (many of us personally) the track record.

    I would definitely support a bill that improves the efficiency and streamlines the USCIS to cut down processing times. But I'm not aware of any such bill out there that does there.

  5. My RFE deadline was just shy of 90 days from the RFE date.

    You can not fax or email. Only snail mail. I used USPS Express mail as it is an overnight service that delivers to PO Boxes.

    Thanks. I think I will also try to send it to them Return Receipt just in case something were to go wrong on their end (like a few more pipes breaking at the CSC) then I have proof that I sent it back to them to meet my obligation.

  6. According to USCIS, I had a RFE that was mailed to me on May 10 (or possibly May 14 - conflicting information on their website as to which they mailed it out).

    For you RFE veterans, can you tell me roughly how far in the future the deadline for RFE is set for a K-129F petition? Is it based off the NOA1 date (in my case Nov 5 2012) or off the RFE date? I am slightly concerned that due to administrative or mail delays there's a possibility I could get the RFE and be under the gun to get the RFE back to them just in time to meet the deadline.

    Also, when I reply to the RFE and send it back to them, what is the fastest possible delivery method they will accept? Does it have to be mail or can you fax/etc.?

  7. Yep. REST-ful services. Return JSON by default... If it is not too big a deal I will return XML too, but not a high priority.

    GET is the only verb that will be available as this data is read only.

    I am taking requests for API methods that people want, so let me know...

  8. Just an update... I am currently fighting with my hosting service. The two of us don't agree on how my app should be configured smile.png Once I get over the config hurdle, I should be home free on implementation.

    What I do I have done:

    - stubbed out site without data access implemented

    - data from durden massaged and changed to protect the innocent

    - data imported into the appropriate database for my app

    - database configured and populated on server

    This is where I am right now.... Not always as easy as you want it to be....

  9. While I respect their decision (and admins can attest that I am trying to act in accordance with their wishes), I reserve the right to disagree and express that disagreement. I have reviewed the terms of service and personally do not see which of these terms was violated. I assume that the mods and I differ on our interpretation of one or more of these terms. I humbly admit that I am not a lawyer, but a mere web dev smile.png

    I appreciate VisaJourney, its forums and especially Igor's List and the Timeline tools. This site does and will continue to do a great service to all of us.

    That being said, I cannot find anywhere on the site about VisaJourney's origins, its mission/goals or its organizational makeup. Is it a non-profit and if so is there a board of directors or advisors? Does VJ accept donations for its maintenance costs and ongoing efforts? Are there any ground rules in place between VJ and the USCIS that need to be adhered to? I have always wondered these things and would like to see an admin respond. Thank you.

    And I agree with a lot of what Tyler Durden wrote. VisaJourney likely exists because at some point the INS/USCIS wasn't doing their job or serving the public properly. The performance by the USCIS with regard to many sponsor-based petitions has certainly worsened since VJ's origins. If things have become too divisive and VJ wants to stay out of the fray then I will respect their wish. But I do find that stance a little difficult to understand, given the nature of the site and the user base.

  10. One glaring problem with your hypothesis, is DACA didn't start until August 2012, yet the peak in backlog occurred in April of 2012. Many months earlier. If you track was was going on with AOS backlog, you'll see a huge backlog of AOS applications started building up 2ith the growth beginning in the third quarter of 2011.

    To accurately reflect what is going on, you're going to have to dig deeper than just I-129F applications and DACA. USCIS has long been known to jump around human resources making some applications faster while others languish in the back room, constantly playing a catch up game. You'll need to look at the numbers of all applications coming in, and how that has been reflected in all backlogged cases.

    I agree, my video doesn't give the full spectrum of the problem. It is a synopsis of recent events and stats. I am sure there have been other K-1 slowdowns over the years for reasons both known and unknown, especially at VSC.

  11. This slow down is so disheartening. In a few days we mark our 6th month. We sent an email to Congressman Mike Honda and Senator Barbara Boxer and still waiting for their reply or non-reply. (sigh) Also scheduled an infopass for May 14th. I hope all these efforts do not go to waste.

    I agree with Lynkali, we should keep the noise going... they should be aware of what's going on @ CSC.

    We are also early November. If the CSC stoppage continues into middle of next week might consider making another Youtube video.
