  1. Hi again....hope everybody is doing ok....we just had 11 days of no water preasure and then I had a 5 day really nasty stomach bug......its been incredibly good though for us to carry our toilet water upstairs....it educates you in how much water we actually use...its mind blowing......though i could have done without the stomach bug!

So today is the 9th of September and I thought it was a significant date.....I looked in the passport to find on the K1 itself it said...

    Expiration date

    10OCT2013

which was surprising because I thought it was going to say 9th Sep....but when looking at the stamps that the fellas there did at the airport...they both say 10th Sep 2013....that's obviously the 90 days thing....90 days in which to get married...got married a while back...should be ok....but why put K1 on there and K1 on the other part?....this is confusing.

the 9thSep2013 is when my Texas driving licence expires.

BIOMETRICS was on 28th of August 2013....that went fine....yep that was fairly painless!....poor guy there at the first desk was his very first day!

I know I've been told not to panic...but what sort of questions are they going to ask at the upcoming interview?....is it more of the same?.... like the US Embassy in London?....or a very different thing?

  2. I'm just wondering what questions to ask now...its like we're plunged into darkness again...though not really....but it's certainly that thing where you feel uncomfortable.... you feel you should be working on the next part......I do know that I'm now waiting for a Biometrics appointment?....and then for my EAD to be sent to me.

Should i be working on filling in Lifting Conditions forms now?

  3. Hi again.....

.....so things were looking really good........we had every single form filled in and ready.......and we knew that a check had to be made for $1070.....i have no check book from my UK account......and i dont have a USA account.......but we're trying to do that.......we've been told that when we go to unmerge the USC wifes bank account with the USC's fathers bank account...that I need show a TX Photo ID in the form of a US Texas Driving license.....which I did try to obtain a while back but , well its a long story on that one but i was missing the two proof of address to get a TX Driver licence....it was looking like i was very close to getting it though....they handed us a affidavit for the primary sponer and myself to fill in......we didn't know that it was a reeeeeeeally simple form and the USA primary sponser was actually there too with us (the USC's father)....he was there and we could have done it fast......somehow we didn't look and we left and went home....we got the USC's name changed on her TX Driving license though.....that was good and went well............then the USC's father reckoned that they might do a driving test for me but he is the first one to admit that he doesn't actually know.......today i was out there in driving conditions that are the complete apposite of the rural Scottish life style as part of the USC's Fathers driving school.....lol......

we're getting so upset though about the fact that the AOS package has still not been sent....because we worked so hard on it ......and, we had it all ready quite a while back....well ok maybe a week and a bit ago.......i have the 1070 dollars....but need to transfer it from my account into a USA one......i spose I could transfer it into the USC's account maybe somehow from here using online banking maybe...don't know.

  4. You hold tight and wait on things to process. You will be past your 90 days before you get a greencard, but nobody will come and take you away. You are allowed to wait until a decision is made.

Then instead of a tax return put a typed statement behind the I-864 that says

    TAX RETURN STATEMENT

I am the spouse and sponsor for Kubey, Jr. (your full name).

I have never worked or earned an income, so I have never been required to file a tax return.

[sign her name] [write the date]

    [type her full name]

Thank you.....I really didn't know until I read this what was going on.....but suspected it might be something like that seeing as how it has gone up until to this point.

Many, many thanks with the help on the Tax return statement too.

  5. Many thanks everybody....i'm sorry didn;t see your post Nich-Nick it didn't show up..thank you nich nick........i'm seeing everybodies now though....very odd.

have printed that......i still dont understand what out of status means and how bad a situation that is?.....is it very bad?....or do you just hold on tight while paperwork and interviews are scheduled....i mean if i go back to the time where i was waaaaay over the deadline for Notice of Action......they started to require statements of intent written and notorised....would that be what would happen again?

  6. How did she prove her citizenship for the K1? She would have needed passport pages or birth certificate.

I honestly don't know...she has a driving license...and, the original birth certificate is here in the house I am living in...however her mother wont relinquish it....so we need to get a certified copy made.

I've noticed though....that the Texans seem to hold the Texas driving license very high as a form of ID....but i dont know if that was used or not....the first stage to getting the USCIS approved letter for us was way back in 2011 and memory is a little hazzy on it....plus it was done with a immigration lawyer...(we now do it ourselves though)......I think I maybe I did see a birth certificate at one point way back then but couldn't say for sure.

  7. ...stay calm.

    Hi,

So we have completed filling out all but two forms....a extra form that is part of the AOS Affidavit ....... the Adjustment of Status package is so nearly ready but sadly not ready........travel authorisation.....the travel one wants a date and time that we would be visiting Scotland because my wife has never met my parents and one of them is very ill.

We cant leave however until I've been summoned for biometrics....summoned?...well I don't know if that's the right word or not but you know what I mean......

these forms that all make up the the Adjustment of Status package have to been sent of ASAP i believe?......and time since port of entry is now three weeks....its not been as fast as i'd liked because the SS Office trip to get a card did not happen until five days ago.....they were super fast though....five days was amazing to get one to me.....

however....the new Affidavit that the primary sponsor (AC's Father) is filling in requires him AND the AC to submit birth certificates....now, this is easy and quite quick for the AC's Father (because his is in Dallas)....but AC's is in Oklahoma, which is a bit more difficult to obtain.

We also need to get the AC a Passport......all just a tad stressy.....we thought we had got somewhere with the SS number arriving.

Do i just have to abandon a visit to visit the AC's new in laws because time is marching on?....what would you do in this situation?

Does the Travel form have to be filled in now or can you just not send it later?

    Thanks

  8. Hello,

Ive looked at the instructions and can't seem to figure it out...In Part 1 of the I-485 Application to Register Permanent Residence or Adjust Status...

...I'm a bit confused at the boxes that say...

    C/O (in care of)

    Current USCIS Status................is this K1 or R K1?....my passport says R K1...or...do i put non immigrant?

Expires on (mm/dd/yyyy).............is this the little stamp they do every time you enter USA that says admitted.... and I put the hand written date they put in?

    A # (if any)

You don't have to print it. It is suggested in case your worker says a K1 can't get a SSN. if you print only the page that has K1 on it, not every page, then you have something to show them that says k1 is Legal Alien Allowed to Work by Social Security standards. It means you can get a card as a K1 (but remember that option is only valid for 76 days from entry).

Thank you!.......ok it looks like I'm finally all ready for it......and MIGHT be being driven to the nearest social security office tomorrow.

also am now in a cooler part of the house...computer and desk has been moved to it.

  10. 5. Print out this report from the Social Security Administration just in case the worker is also confused that you are allowed a SSN. If she says "no" then you can pull out the pages and show her the rule. Look at this report now https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530. Scroll down in the second chart where the first column says CLASS. find your class K1. Do you see that on the K1 line it says Legal Alien Allowed to Work?

this link doesn;t seem to work....but i;m sure it did once before when i was in Scotland.....is it straight forward to get another one...how important is it to print this?......ok sorry about this.

  11. I also married in Texas. No witnesses are required. Only the officiant has a place to sign the license giving date and time and his title I believe. Date and time are required because it can't be sooner than 72 hours from the license issue or more than 30 days from issue. A judge can waive the 72 hour requirement.

Adjustment of Status is starting all over. You got your visa in London under the Dept of State. Everything you did so far was just to get a visa. That's done. It is over and the visa became invalid the day you used it to enter the US.

Now you will go back to USCIS to apply for a greencard. New forms, new rules, new people looking it over, some repeat of things already sent but the new people aren't going to dig through your old file to find a birth certificate for example. There is a new Affidavit of Support (I-864) so getting back the London I-134 would be useless.

Now the London specific things are over, so you will use this forum to ask questions http://www.visajourney.com/forums/forum/7-adjustment-of-status-green-card-from-family-based-visas/ because all K1s adjusting status do the same forms.

If you back up in this thread to post 27, I gave you a link to my list of what is sent for AOS. Bookmark it and print it as a guide so you don't leave anything out.

Ask your questions about the forms in the Adjustment of Status forum http://www.visajourney.com/forums/forum/7-adjustment-of-status-green-card-from-family-based-visas/

thank you that is actually incredibly usefull....my brain is just.....well....i'd completely forgotten about that highly useful page even though i had printed it out and put it into a a folder called adjustment of status....its a lifesaver.....right i think i'm a bit more on track now.....many many thanks.

just one....and maybe slightly odd question.......i'm printing out some forms here on a ink jet printer.....and while the text is readable....its not the quality i would like....i'd really like a laser printer like i have in Scotland with toner.........the text is ok-ish on highest setting...but disappointing.....its readable though.....is this something that i should be concerned about?.....my other half says to just do it on the ink jet.....ok well.....pen seems to be acting up too....possibly to do with the heat.

  12. iok hardly any sleep......i know i might have asked this before and i have a memory of you saying something that may or may not be accurate.....but do i need the orriginal ink Affidavit of Support and all of its accompanying documents? for the adjustment of Status?......or can you use copies?......i think you told me to get that orriginal back from them at the Embassy but i'm not sure.

  13. Get your social security number as soon as you can. It is not needed to marry or file for your greencard, but is useful to have. If you wait too long, they won't give you one until you have your work authorization card or greencard.

ok having some upsetting times over here......and wanting to know what wait too long means....in days....how many days past port of entry is a wait that is too long on visiting the SS offices to get a SS card.....I am keen to go and get one ASAP.... but my other half is not....we have no car though...and live in a remote rural location.

  14. thank you VanessaTony, Owen_London and Nich-Nick.....it means a lot and i wish i could thank you in some way other than saying thank you.

wow i'm sorry about the rudeness guys....i think just too much going on.....its 96 fahrenheit everyday and i have to borrow a computer......well i have to borrow the printer mostly...but yes i have to borrow a computer.......and theres no air condioner allowed.......well its a printer, scanner and copier combined and i dont like it....and the keyboard is driving me nuts....and its in a part of the house that seems to get far hotter than the other bits.....sweat literally runs down my temples as if i was sitting on the toilet with a bad case of constipation......... also....i mean its not to whine or complain but i'm from a very cold country....in fact we had the coldest year on record since 1979 this year.

but its not all bad :) :) :)....there are ice blocks and ice cubes into water.....must remember to start doing that.....and i'm now not separated from my other half.....thats a lot of good things.
