Hey everybody!!
So I'm here getting ready for my moving date to the USA in a couple days and I was going though the whole AOS procedure and forms that we need to send...
Everything went fine until I got to the I864 Affadavit of support.
My fiancee meets the imcome requirements as far as bringing home more than the 125% of the poverty guideness so that is not a problem...the problem is: the taxes...
I'm writting you guys to see if anybody found themselves in the same situation or anybody can give us a hand on what to do...
Me and my fiancee (as I want to think most of you guys) met each other in Spain (my country) because he was working here. This past tax year (2012) he filled for the tax return as we thought that that was the only year that USCIS was going to require in the form...
To my sourprise, when I've read it I see that there's need to introduce information about most recent year (2012) (we got it) and the following 2nd and 3rd most recent years (wich my fiancee didn't file for those for the following reasons)
So now we gotta file for back taxes of those years...For what I've read that is not a big issue especially because he didn't make enough money overseas to owe nothing to IRS because he could excempt himself as a Foreign Earned Exclusion, so I think is just going to be filling it and waiting to receive a IRS-generate tax return transcript documenting the late filling before submiting I-864...
idk, if I made myself clear since i'm not very familiar with USA tax law and my english is not great...but I really hope somebody can tell us what they think about it...
Would solve the situation if my future mother in law joint-sponsor us? Or we still need to send info from my fiancee...
Anybody is in the same situation?

My wife just called the automated number to get her IRS tax transcripts for the past three years. It processed 2012 the most recent, and 2011, but it said 2010 was not available. Obviously, the 2012 is the only tax transcript that we need to send, but she does not know how much she earned in 2010 so cannot fill the 1864 in completely. Any advice on how to get this information?
Is she sure she filled? Doesn't she have any file at home from when she filled? Did she do it though any accountable? If she did, maybe they have the file in their system...Idk...just giving you ideas...
If not, I guess you guys will have to file again... I'm in the same situation...
Btw, maybe calling another IRS number and talking with somebody..

I just got worried because I don't know anything...and tomorrow I wont be there with the accountable to ask him whatever...I've been doing reaserch all day going crazy and I feel like i need to be there tomorrow so the accoutable do things right....

Nah...but seriously... when i called my fiancee he was like...omg...what else...like we are both over this whole process and now more problems...I really thought we had everything under control until this morning...and now im freaking out...

oh, I didn't understand that he didn't file the taxes at all in those years... I think this is probably what you need to do then, it makes sence... You shouldn't be worried.
Right, just get the previous tax transcripts and you should be fine.

Just wondering how much would that take...hope it doesn't slow the process down that much... that add to the goverment shutdown can really end with my nerves...
My main thing is that since im Spain and procedures are soooo much different I don't control timmings or how would it work...My fiancee has an appointment tomorrow with his accountable, and I hope that can give us more info...
Can't wait till tomorrow though!! any accountable on visa journey that can tell me what is going to happen and how much will it take????LOL

He just needs to put how much he made in those years...No need to submit the tax information. Read the number 14...it's optional.

I just don't think is legal doing it that way (although if it is it would be way easier for us)...
Question number 13 of the form it makes you check:
I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.
(I feel like If I check this, I would be lying because my fiancee didn't file for the two previous years)
And then when it gets to 13a, 13b and 13c, we would be stating that he made that much money but If they check if he filled taxes they will see that he didn't...
idk!!!

The instructions say exactly what you've posted, but when you actually go to the form, to Part 6 (question 13-a, 13-b and 13c) it makes you put something...

Here i am about to move to the sttes and getting my vaccination record ready...
Ive been reading about the requirements but honestly they are pretty confusing... So im going a lil bit crazy!!!
Thinking it was going to be required, one month ago ive started to take the two first shots of the hepatits b (is conposed by 3 shots and the next one would have to be in like 6 months)...
At the same time, after checking CDC flowchart I saw that Hepatits B is not required (if u havent taking it before) if you are 18 years or older...
So what do i do???? What do i believe??? Anybody from Florida or somewhere else can give me info about their past experience?? Or is it anybody goig through the same??
I think the only ones required for my age: 27 are:
Tetanus
MMR
And maybe Influenza

Still in Spain about to move to the states after my interview (k1) that is probably going to be sometime in September, so I'm looking to be able to come around mid October.
I'm in Spain and already worry about the job situation!! Going to Florida and obviously I speak Spanish, so I'm keeping myself a lil positive about it.
I have an Economics degree and a masters in International Trade...
Hoping to get a job soon just to keep myself busy...
I would recomend everybody to get a transcript of your studies. Is good to have it just in case they ask for it, or you can probably attach it to some applications...
At the same time, networks like Linkedin will help also... (I'm going to have to translate mine to english now that I think about it...
I will keep you guys updated with my experience!
Anybody in central Florida already there looking or already with job??

Hey, so you put in your case number and make sure that above says "immigrant visa" link: https://ceac.state.gov/CEACStatTracker/Status.aspx?
It works from the beginning. When they haven't sent it yet it says "at NVC" and when they sent it it says "in transit". I got my case number friday and it was "at NVC" till monday and monday it changed to "in transit". Since they use DHL express it doesn't take long to get to the embassy BUT maybe it's different from embassy to embassy.

Well it says in transit so idk why she said they were going to send it in aprox 2 weeks... But oh well... At this point im tired of conplaining! Lol

Once they got my case I had number in 10 days .... It's when they transfer to embassy I get hairy ... Dis says it ready for interview but th consulate says they not have it

Just got my case number on monday when randomly an without having any expectation i called NVC.
they said that same day my case got there (or something like that) And that my case number is.... Blablabla.
Then they told me that in aprox 2 weeks (i hope is less) they will send itto the embassy.
Do u guys know how much it takes from getting number to arrive to embassy?
And also that link where you can check ur case status it doesnt recognize my case number... When is the tracking consulate link starrs to be worthy? Onces they send it to embassy? Cause if its that i might need to wait since they told me they havent sent it yet...

Hey everybody. Here a noa2 27 of june, got notificated 17 july that our case was on his way to nvc and today ive called DOS. And they had gave me our case number!!!!
Cant believe it!!
They told me that it just got there today or that it has bein assigned today.
They told me to call NVC cause they r processing it and they can give me further information but im trying to call and it hangs up on me like the number is busy or something...
Is anybody else having trouble contacting them?

Got the notice on my email:
On July 17, 2013, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

I think the notices are a good sign..I didn't get one either but my NOA2 wasn't until 6/25 so I hopefully will hear something in a few days.
I feel the same way... Im Noa 2 06/27
Even tho im not gonna rest in peace until people thats getting those notifications (19 and 20s of june noa2 approvals) get their number...

You r fortunate.. My approval was the day before you and i did not receive that my case was forwarded
On a separate note i did receive a response via email from the Nvc on the whereabouts of my petition
So please use this so they can research your case

So i just called nvc and they told me that right now what they are being told to say is tha due to some transfers from service centera is a delay that can take up to 8 weeks...
It was crazy cause she said, r u sure u got approved cause i dont see ur case here.... And i was like yeah... And then ahe told me to read her the firstwords ofthe hard copy ad then she was like oh ok...
So basicly bs! I asked her if it is up to 8 weeks or if it is going to take 8 weeks... I said: it can get sent to you guys with less time than that right???? And Told me she cant guarantee that... That that wss what they rold her to say.
But she did say UP TO 8 weeks...
Anyway idk... I didnt ontact no senator of congressman for the noa2 but i guess if it takes more than next week ill have to say something...

What is this other forum? I woukd check it also... Im a texas transfer also approved 27 of june so i wanst rushing to get the number but this information isnscaring the f*** out of me...

Today ive emailed my embassy toncheck if they have heard anything about my case and i have explained them a lil bit whats going on uscis and the delay with the texas transfered petitions...
I should be getting an answer either tomorrow or wednesday so ill keep u guys updated...
To ve honest with u i dont think it would take that long ... Honding cases for 8 weeks? OMG! they have lost their minds if it ends up being true... Not that i dont believe you Angelina :-)

Hello!
I think today (and I say I think because he is not up yet) (is just 9:40 spanish time) my fiancee has a meeting with his accountable to fill up his backtaxes... I will inform you guys in how it went...
It just so happen that yesyerday when i read the form for the first time i realized that they require not only the last year to be filled but also information about the two years before that... Hope it gets fixed today or in the next couple of days cause i want to send AOS as son as we get married and that will be at the end of october...
As far as the translation, ive translated all my documents in Spain. I went on the american embassy website and over there theres. List of official translators designed and certified by the goverment to do translations...
Im sure if you go on your contries embassy website it may have information about it..
Now that i think about it, better than going to the us embassy in france, you would be better going to the french embassy in the us... Im sure they can help you finding a certified translator...
