  1. Hey everybody!

    I have a question for all of you...

    Im currently waiting on my Green card from adjustment of status (k1)... i already received my Working authorization card.

    Well, here is my question... I'm starting a job next week and because of my inmigration status i have to fill up a couple forms... well... i know that since I didnt receive my green card yet my current status is: NON RESIDENT ALIEN.

    Well, because of that, they are making me fill up a form for federal withholding tax purposes...well, on this form it askes questions to determinate if I am a resident alien (green card) or non resident alien.

    As I said, I know i am a non resident alien until i get my green card, so that is what im stating on the form...

    My question is: theres one question on the form that got me thinking a lil bit and i wanted to ask you guys if you know the answer...

    Here it is:

    Are you currently in the United States on a F1, J1, M1, K1, Q1 or other visa for five or less years?

    Well, my though was that i'm not on a K1 visa... i was... but i'm no longer on it... right? i came to the states on the k1, we got married on october, applied for AOS in november, got my work authorization card, and Im waiting on the green card...

    I dont know...this thing is confusing... am i still on a k1 visa until i get my green card? If im no longer on a K1 visa, what visa or situation i am in?? AHHH!!!! GOING CRAZY! lol

    My husband and I have the same NOA date as you :).

    Just out of curiosity, who are you calling to find out information on your case? Are they helpful at all? Are they able to tell you what's going on with your case?

    Hey!! What happens is that since they know that i cant get into the online update of our case they make sure u get atleast the same information over the phone. Dont think they give me any further information... They just like, i see everything ok, youve taken ur biometrics, i dont see any negative input right now (i guess meaning rfe), and stuff like that... So really it is not a lot but it is kore than just not knowing anything about my case... Hoping one of these days they will tell me that it has been approved!

  3. Congratulations to everybody moving forward!!! I see that users getting approved have their NOA dated somewhere in between the 10th and the 20th of november... We are noa November 18th so hopefully we will hear something soon! Our case number was never found online (they have some issues with some random case numbers on the "case status" thing on USCIS website and we are one of the "lucky" ones... So i guess well have to wait for the actual mail to find out if we are approved!!! Or i may call tomorrow asking about it! I've been calling everyweek, they might be tired of me but oh well, it us what it is... They been being pretty nice and helpful though...

    Well, ill keep u guys updated!

  4. Hi everybody! Thanks a lot for your updates!! As usual, it fells very good to know that we are not alone in this confusing and loooong path!! ;-)

    We got our appointment for our biometrics day 19 of december as some of you guys. I received the notification a couple weeks ago. I guess it depends where your service center is and how bussy they are, you get your appointment faster... Anyway, what matters right now is that all of us get done with this whole process as soon as possible and without no extra drama!!!

    I had a question to whoever had their biometrics already. What documentation do we need to take??

    Our appointment letter says that i must bring: 1- The appointment notice, and 2- Photo identification (i guess I'll take my passport)

    What other stufff do they need? I've heard that they ask for your marriage certificate. I'll have it with me just in case.

    Anything else?

  5. Hey everybody!

    Here a November AOS, I-765 and I-131 filler! I've sent my package on december 6th, got our NOA I-797C letter on November 21st dated on November 18th.

    Before I received the actual fysical mail, and since we've applied for the e-notification, we got an email around November 19th were they already confirmed reception of our package. On that email, they specifically say that I should wait to receive the letter on my mail before cheking the case on the USCIS website...

    Well, I received the letter on the 21st and as today I still can't see no update in the case...It says the following:

    ""Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283.""

    So Im like: HERE WE GO WITH THE BULL***** (lol). You all know what I mean...is always delays...

    I was just wondering if anybody experienced delays to their case status thing... or I should be worrying... I called USCIS and they told me it is nothing wrong with it and that it can take up to 45 days...so Im like...why would you send an email saying to wait until I receive the letter on the mail if now you are telling me that it can take up to 45 days!!!

    So i'm in here filling these forms up... I'm from Spain, and over there we doesn't have any middle name. I'm wondering what should i put on the middle name...

    I'm filling my forms with my lastname as my married name (even if my marriage cert. doesn't show it yet) (but as discussed on other forum, that should be ok)...

    But what should I do as far as the middle name? Is it ok if i leave it in blank? Or should i put my maddien last name on it? or what?? ahhhhhh

    Nope. You can travel for any reason.

    See the "or"? It means that since you are an AOS applicant, you don't need the explanation stuff.

    As far as I can travel for any reason...idk...the form doesn't say that... did you got your AP? It went throuhg without problem putting unknown?

    As far as the "or" issue...i noticed it...maybe i didn't explain myself correctly...

  8. Hi everybody!!!

    So here I am filling this nighmare paperwork and beeing in front of i131 form I'm a lil bit confused on what's going on...

    Im a K1 visa holder, and I'll be sending this form together with my I485 AOS package (I485, G325A, I864, I765, I131)... (u know...all this crab...)

    So I was told that if later on I want to travel to my country to visit my parents, or if something happens (like something you can't plan in advance) i can just go without having problems with my AOS process before I get my green card...

    Well, what the heck, I put on PART 3???

    Date of intended departure??????? (MMMM...hello USCIS!!!! i don't know ...)

    Expected length of trip????? (hello again!!!! don't know it either)

    And I guess on PART 7, to be sure I would put more than one trip? just in case??

    My thing is:

    Instructions say that I can apply for and Advance Parole if I have a pending application to adjust status (wich I have), and I seek to travel abroad for urgent humanitarian reasons, family emergency...

    How am I supouse to predict an emergency that is going to happen who knows when if it happens? Can anybody explain me this?

    Also it says that as Initial evidence I must submit:

    - I-94 (OK, cool)

    and

    - Explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole (wich I can't send cause as right now I don't have any humanitarian reason or family emergency planned (beeing iroinc)

    or

    - if im an applicant for AOS a copy of USCIS receipt as evidence that I filled (wich I'll do that because my evidence will be that I'm gonna send this form together with AOS package, so what better evidence...)

    It specifictly says later on the instructions that vacations can't be a reason for asking for the AP...so what should I do? Anybody with the same thoughts and that went through the situation without any problem...

    How shoud I fill the form?

  9. That lady was wrong. It is a common misconception that the SSA "owns" your name. It does not. Do not listen to her.

    Listen to the people here who have correctly told you that if you want to use your married name, then put your married name on your immigration forms. USCIS will accept your marriage cert as a valid name change document. Very few marriage licenses show a new married name. They reflect your maiden name, which was your name when you signed the form and helps identify who you are.

    Once you get your GC in your married name, go update your SSN with both your married name and your LPR status.

    I have my doctors appointment in 3 hours so i wanted to have part 1 if the form filled out proppertly...

    I was jst scared to get and rfe since no paper shows my name with my husbands lastname yet...(not even the marriage cert)

    But ill follow your advice and fill it out that way in the forms... Hope doctor doesnt tripp about it...

    We just came back from marrying at the clercks house and i saw that the marriage licence doesnt show my married name. It just shows my madien name and then obviously my husbands name...

    When we asked the lady she said that the change has to be done at the ss office on my ss#. Now, we all know that social security wont let me change my name if i dont take (together with my marriage certificate) an immigration form with my new name on it...(call it EAD, call it GC...)

    So my question is... How can i fill out the forms using my married name if my marriage licence doesnt show that name?

    Do I just fill it that way cause with the marriage certificate they will have enough prove that my name has to be changed?

    I dont know if im explaining myself... I just mean that before we goy married i tought that marriage certificate would come with my name as Eva + my now husbands lastname... And that that was needed to be able to fill out forms with married name, for after be able to receive EAD on my married name to be able to go back to ss office to change name on my ss card...

    Is this normal situation? Do your marriage certificate shows your madien name or your marriage name?

  12. my wife got her ss# about 3 weeks after she arrived...

    we got married 2 weeks after she arrived.

    she applied for the ss# using her maiden name, use the same name that is on her visa.. this is to be sure ss doesn't have a problem because the names do not match.(we did not tell ss we were married)

    no problems getting her ss#... about a week after we got he ss#, we returned to ss office with copy of marriage certificate and they said she can not change her name on ss card until she has her EAD/work permit, or green card.. so ok, no big deal..

    when you complete the AOS forms, be sure to write your name as your married name (if that is what you will be using).. there is a question on the AOS forms asking if you have used any other names... that is where you write your maiden name, visa name...

  13. Well, since you are including a copy of your marriage certificate, you would put whatever name you want to be called on your legal documents. Whether that is your married name or maiden name - that is up to you. It is a personal preference.

And the man at the office told me that to change my ss name after the marriage i need to take them a paper from uscis with my married name, so i guess ill fill the forms with my married name and ten once i get my AOS noa1 ill go with that to the ss office to change name.

    Dies that make sence?

    Do u remember how much the licence cost? Do we need to go though teoric exam as well? Where i need to go?

    I didn't mean for you to acctually go to the embassy. You can go on either website (either the frech embassy website in the USA or the USA embassy in france website) and they should have information about official translators...

    Maybe calling or sending email to them might help you!

If you were not required to file by law, then you also don't need it for the form. So the form has absolutely nothing to do with you filing your taxes.

    No. The petitioner must always be a sponsor.

    There are two things that2d1c9d40663e3d6 are required: a) The tax return or tax return transcript for the past 1 year, and b) the "total income" number from the tax returns of the past 3 years.

    More specifically, he needs to put the exact number from the "total income" line on the tax return. So there is some "tax return information" that he needs.

    Either filed taxes, or been not required to file.

    Past tax returns and theh 125% poverty line have no relation to each other. The thing (and the only thing) that needs to be over 125% poverty line is current income.

    Just want to say that it is obvious that you dint feel taxes just because a form says so...

    Everybodys situation is different and just so i dont get this too technical we are just going to go to our accountable and do what we need to do.

    Thanks for reminding us that we need to follow law... That is something we also knew from the very begginig... Maybe i didnt explain myself propperty so im going to leave my case on our accountable and go from there.
