Does anyone have suggestions for explaining a name variation that is different than whats on a birth certificate?  My husband wants to file for his mother and on his birth certificate her name is spelled as Mustapha but she spells her name as Mustafa.  The instructions say to provide evidence if the name on the birth certificate doesn't match the current name of the beneficiary.  Her Nigerian passport has Mustafa. We cant get any other documentation/official records for the name variation.  

  2. Please call the clinic to make sure they are asking for the 50K naira for treatment. As far as I am aware, the clinics that do the medicals do not provide treatment. When my husband had an abnormal chest xray he had to pay 50K Naira for the Sputum Test, which took about 10 weeks to get the results, and we were told that if the test came back positive he would have to seek treatment elsewhere.

  3. It seems when they realized he was an immigrant from Nigeria they wanted to ask him quite a few questions. He says just about everyone on the flight that was immigrating was asked lots of questions. The officers seemed to be in the interrogating mood/harassing folks.

  4. If you failed to include your son at the time of your original entry your entry would automatically be disqualified and they will not be able to issue you the visa. One of the requirements is to list all children irrespective if they are living with you or will be immigrating with you. The only exceptions are if you were married or had a child after the submission of the original entry.

  5. The W-7 is an application for ITIN. The new rules state you have to file when filing a return unless you meet one of the exceptions. You cant file electronically in the same year you are applying for an ITIN for your spouse if you want to file Married Filing Jointly. If you file Married Filing Separately you may be able to file electronically. You should not file as Single since you are married.

  6. That is crazy. My husband and I got married at the registry in Surulere. I didn't have any issues with my handwritten marriage certificate when I took it to SSA for my name change. I would suggest you try again. Did you mail in the name change or appear in person at the SSA office?

    You can still file your taxes as married. If your husband is not here, you will need to submit an application for a ITIN (Form W-7), include the supporting documents, and file your return by mail.

  7. Another option is to submit an ITIN application along with all the required documents with your 2013 tax return and when you get that back, use it to file an amended 2012 return. In any case it would be best to talk to someone at IRS to find out the best way to proceed. I would definitely ask if you can submit an ITIN application with an amended 2012 return.

  8. Please have your husband get two copies stamped and make sure they notate that the original was seen and returned. My husband and I had an issue with the IRS accepting the notarized copy of his passport and we submitted a second copy with the aforementioned notation. It seems that they had some issue with the first copy that was provided, without the notation, when I submitted the Request for ITIN but later issued the ITIN for my husband after supplying a copy with the notation.

    Also, I was told that there was a $50 USD fee but when my husband arrived and informed them it was for tax purposes, they didn't charge him anything.

  9. I'm not sure she will need that, but if she has an education related certificates, diplomas, or degrees, she may want to bring those. She will definitely want to make sure she has complete contact information from her previous jobs to be able to complete a resume or fill out job applications. Some individuals have had their foreign credentials evaluated by a service to know where they stand with regards to U.S. requirements but other than that I'm not sure what she will need. Hopefully someone else will share their experiences.
