Any way we can file for a K-1 now with a I-130 pending? Or would that be problematic? I'm living in India with my husband, but I'm eager to get back so I can start earning again. Its all so frustrating...if you aren't living together, later they will ask all sorts of questions about how your marriage actually works if you're not together, but then if you're living together in a different country they ask you to prove domicile and how you expect to support your spouse if you're not earning! UGH! I really wish I could just ask one of these "OFFICIALS" "please, explain to me the PERFECT solution to meet all your stupid requirements." Its just ridiculous. I'm so frustrated. I'm 30yrs old, we want to start a family, but we want to do that when we know we will all be able to be together as a family with secure jobs.
Do you think I can get expedite status on my case with the reason of "my biological clock is ticking"? hehehe
Sorry for venting. Just hoping for good news for all of us here.
+1 ... could not have said it better. Very similar situation to yours.
In the end we will prevail !!

K-1 Approved in a month....seriously?!
Oh and here's another at 19 days.
http://www.visajourney.com/forums/topic/450907-noa-2-got-approved-in-19-days/
I hear you. This does not make any sense.
Our lifes are in "stand-by", and not being able to plan things because of the uncertain delays really makes it worse.

Just read a K1 thread... published today
NOA2 in 21 days!!!!
3 weeks from NOA1 to NOA2!!!
#######!!!!!
Does not make any sense

Lucky you!!
CONGRATS !!!!

Well thats good news for al may june fillers because wen that offive in oveland pak kansas go's fully operational now in September thy will process us first and get us out 9f the way
Well I have a June 10 Priority date (I-130 for child of USC). I just received feedback from the USCIS and my file is STILL at NBC/MSC "being worked by and officer" (quote).
I do not believe files will be sent to Overland Park/KSC before it is fully operational.
-
Hi guys. Are there anyone waiting for NOA2? We've been waiting for it for more than 5 months already, but still no response from USCIS. How about yours?
Hi Goose!
At least (at least) 6-8 months from NOA1 seems a good estimate.
-
They sent us a letter both times when we applied for expedite and it came back denied. USC has to have surgery for cancer. Provided proof, still denied.
Sorry to hear that. Sounds pretty extreme.
Will keep you guys up to date concerning my expedite request.
Thank you all for your feedback
-
The fee is for the green card production. Maybe Call the USCIS and ask then:
Probably the best option...
Will let you guys know whenever I find out.
-
Finally I got APPROVED today... APRIL filler's
Congratulations!!!
You filed for your parents right?
-
Good day,
Who among here waiting also for the approval of i130 for cr2 or ir2 under missouri or national beniffits center
.. we requested an expedite but no response yet... im about to have my case be completed but my daughter is on initial review ..tnx
Hello Honey08
I am in the exact same situation.
I am USC.
My wife has her Visa (Green Card) since July 25, 2013. Interview was at US Embassy in Paris, France.
My daughter was born in May 2013, and has a Priority date (NOA1) of June 10, 2013. She is IR2.
Our file is at the NBC/MSC.
We requested expedite procedure almost a month ago. Am still waiting for an answer.
The reason is that my wife has to go to the US before January 23, 2014 (or her VISA expires...).
What about you? On what grounds did you request an expedite procedure?
Thank you for the info! Will let you know if I hear anything from the USCIS...
-
However, this does not seem to be the case with the OP -- his baby was born before the issuance of the visa.
That is correct. My baby was born 2 months before my wife got her Green Card.
I feel kind of confused as to wether I did the right thing. I always thought I-130 was the way to go.
Plus I did not know delays had gotten this long (my wife got her NOA2 in 10 days in April 2012).
Anyways... I might still get my case expedited. Will let you know.
Have a nice week everybody

I'll say what Darnell would say.
Use the advanced search tool on a PC, top right hand corner.
search for: green card new immigrant fee us citizenship
username Darnell
Display as posts.
NLR
Did exactly what you said. Found Darnell's post.
It does not indicate any source regarding the info he is providing.
My wife already has her passport with her immigrant visa on it, but has not yet entered the US.
Along with her passport, she received a letter from the embassy stating that she must pay the 165 usd fee BEFORE entering the US.
So I do not think you can avoid paying the fee, even if for a child of USC who is immigrating. If someone could find a link to an official source that would be great.
My 2 cents
-
yup. once passport in hand, can start refund process.
Hello Darnell!
Would you mind to elaborate on how to avoid paying the 165 usd for a Green Card?
My baby girl will be entering the US as an LPR but will automatically acquire US Citizenship. Do we need to pay the 165 usd?
THANK YOU!
Rudy

Hey guys!! Got some news regarding my expedite request through an email received earlier today:
U.S. Citizenship and Immigration Services electronic records show your call to the National Customer Service Center (NCSC) on July 30, 2013. The Referral ID for that Service Request was XXX.XXX.XX.XXXXX.MSC.
Your referral and issue reported during your call are currently being worked by an officer at the Missouri Service Center. You will be receiving a response to this referral via mail or email.
Please wait for the response to that referral, and follow any directions provided.
Anyways, I know that an Expedite Procedure is an exception and not the norm for filers/petitionners in this thread... HOWEVER, it might be interesting for some to know how lenghty this procedure is EVEN under Expedite Procedure.
Still have not been approved; but if we are, still best to wait 3 months instead of 6-9 months...
Will keep you guys updated!!
Cross fingers!!

Got some news today from the USCIS Vermont Service Center:

SUPER CONGRATS!!! YOUR WAIT IS FINALLY OVER!!!
YAAAAAHOOOOOOOOOOOO!!!!!!!!!!!!

Hey Rudyzn,
Isn't possible to report your baby's birth abroad and make him or her a US citizen after birth?
That way he/she does not have to apply for a visa.
Our son was born in the Netherlands, but because his father is a US citizen, we could 'report his birth abroad', which meant we had to fill in some papers and go by the US embassy/consulate.
Maybe that is possible for your child also.
Good luck!
Hello Nona,
Unfortunately, as I have not lived more than 5 years in the US throughout my life, I have to sponsor my child in order for him to become a LPR and immediately afterwards a USC.... Bummer.
-
Hey, rudyzn, I don't know if anyone answered to your post.
I am sorry you are in this situation. Did you tell the Embassy about your wife's pregnancy and child? Could she not be somehow automatically included in your wife's file after birth? :/ This seems very stupid if there is no way to add a newborn baby somehow faster...
I do not know what you should do, but I would definitely talk to a Tier 2 officer if you call USCIS. I would also contact the local Embassy and let them know of the situation. Worst case scenario, maybe they could issue a new visa for your wife (after a new medical I would assume) so that your wife can enter the US later than Jan 2014?
Hey Ivy!!
Told USCIS, NVC and Embassy about pregnancy. Doesn't change anything. Baby cannot be included in petition. Each immigrant files one I-130.
Already talked to the Tier 2. Waiting for news..
Hope this new facility opening in September really speeds things up
Good luck everyone!

You will need a copy of the NOA2 Approval for the adjustment of status. Call USCIS and find out.
For the OP, if you do not have an NOA2 by now, your expedite was not approved. Expedited petitions are usually approved within a week. If it is not approved you hear nothing.
What was the basis for your request?
How do you know an expedite usually is approved within a week?
I have heard nothing for 21 days now. I need to worry?
I am USC, Petitioned for our 3 month old daughter. My wife got her Green Card on July 25. Basis of my request was urgency to enter US with baby before wife's GC expires (Jan 23 2014).

Agreed, mayb!
I checked the goal processing time page today, and that was finally updated with June data as well. The "national average" was 13.3 months as of end of May; as of end of June, it is 9.5 months. It's probably meaningless, but I feel better seeing it drop all the same
Goal time remains at 5 months, despite every report I've seen on VJ stating Tier 2 is giving 6 months as a best case scenario.
This is insane!! Please God, may the NBC have better stats... (stil unavailable!!)
some of us are going bananas with all this....
-
Hi all - I've been following the June filers forum for a while. I'm a fellow filer with a PD of 7th June. Just wondering if you are all in the US already without your partners or are any of you overseas filers? I'm assuming most of you are in the US as you already have you local office assignment whereas we are still at NBC as we filed from Australia (although I'm a Brit and the husband is the USC). This is a very frustrating process to say the least but I guess we must all just wait in line. I was trying to explain this to the US in laws and they can't belielve that we have to wait so long! It's sounds stupid explaining it to people who think that because you've been married for 8 years you should just be able to pitch up at the airport and get automatic entry! Wouldn't that be nice!
Anyway I read somewhere that they are trying to get all overseas filers done (from NOA1 to NOA2) in 60 days (Q4, Point C http://www.uscis.gov/USCIS/Outreach/Notes%20from%20Previous%20Engagements/2013/May%202013/NBC-AILA-QA-2013-05-01.pdf), we're currently at 75 days so that's not working too well for us! Anyway, just wanted to say hi to everyone seeing that we're all in the same boat! And would be great to hear from people who are also overseas filers and what experiences they have had.
Hello Donkey!!
We are filling from abroad as well (France).
I agree with all of what you are saying. Frustrating to say the least!!!
One thing I do not understand is that, for my wife who filed in April 2012, delay from NOA1 to NOA2 was a whopping.... 10 days!!!!
Yes..10 days between NOA1 and NOA2!!!!
My daughter, for whom I have a PD of June 10 2013, has been waiting for 2 and a half months and still no NOA2 !!!
And 22 days and counting since I requested an Expedite Procedure for her....(sigh!!!) Unfreakinbelievable....!!!
By the way, we lived in Melbourne in 2010, had a great time down there!
Best of luck for your journey..
Rudy

As another member mentionned earlier, no derivative benefits from immigrant visa (each person has to apply for one)
This means i had to start another petition all over again for my baby.
I did mention to the US EMbassy (as well as the NVC when we were sending files/documents) what our situation was.
They have been unhelpful to say the least. CO told us, when doing my wife's interview, to request Expedite procedure for my daughter.
Still waiting for any kind of news regarding this expedite request...
Wish us luck people.
I read this somewhere before, too. Definately can't hurt to try this with the embassy.

I know how you feel, I have some of that in my personal case as well.
Definitely if you can apply directly at US embassy in London that would be the way to go.
I saw a timeline somewhere in here that stated a 4 month process from A to Z.
But I am not sure if you can cancel a petition.
Keep us updated!
