    Wait for the DS230 invoice and paid it. While your wait you could start filing your DS230 and get the supporting documents.

    Stage 4: Submit Visa Application & Supporting Documents

    The immigrant visa applicant(s) must apply for an immigrant visa by paying the required application fee(s) and then submitting an Immigrant Visa Application with the required supporting civil documents to the NVC (as examples, birth certificates, marriage certificates, as applicable to the particular type of visa applied for).

  3. At the appropriate time, the NVC will send the Affidavit of Support fee invoice to the petitioner and the Immigrant Visa Processing fee invoice to the applicant or the applicant's designated agent. If an attorney is representing the applicant, the attorney will receive both invoices.

    So call your attorney and find out if he received both invoices, if no them you will have to fill you DS3032 and appoint him(your lawyer) as your agent. Another recommendation is to call NVC and find out if you need to send the DS3032 or your lawyer is already appoint as you agent.

  4. Hi... Everyone I'm new in this forum, my wife's PD is 09/13/2010. We have de case closed and just waiting for a visa number availeble. I hope her PD will be current in VB of november.....

    The best thing to do so they do not re-open your case to change your address is to make sure the NVC has yours and your wife e-mail addresses so you could receive the interview letter. Then she could change your address at the consulate when she has her interview.

    If you try to change her address now they will re-open your case and then you might loose your place on the case completed for interview especially when your PD may become current soon.

    my wife's accountant believed that my wife shall fill in as a single at the first and said i filled in correctly before but after talking to IRS a man explained for her she could file married separately. actually she filled as single before and now we are going to correct that because of sponsorship. finally the accountant agreed to file married separately but she didn't say i need ITIN or something else. i wonder the accountant to file incorrect again. i am confused.is married filing separately ok? doesn't need an ITIN number? is her status really important for sponsorship?

    This is a quote from the IRS page publication 501 and it is the same source I quote before, it is not what I think it was the IRS page said.

    Nonresident alien or dual-status alien. A joint return generally cannot be filed if either spouse is a nonresident alien at any time during the tax year. However, if one spouse was a nonresident alien or dual-status alien who was married to a U.S. citizen or resident alien at the end of the year, the spouses can choose to file a joint return. If you do file a joint return, you and your spouse are both treated as U.S. residents for the entire tax year. See chapter 1 of Publication 519.

    You were not a US resident during 2011. What status she used to file her Income tax does not affect her sponsorship for you.

    our case is f2a , we have some issue with my wife's 2011 tax return.her accountant filled out her status as single. now we informed that she must file married not single. but her accountant says she cant file for my wife as a married because your husband (me) doesn't have any social security number. please tell me how did you fill in your tax return form?

    It could be done either way, because you do not leave with her in the USA during the tax year.

    Married persons living apart. If you live apart from your spouse and meet certain tests, you may be considered unmarried. If this applies to you, you can file as head of household even though you are not divorced or legally separated. If you qualify to file as head of household instead of as married filing separately, your standard deduction will be higher. Also, your tax may be lower, and you may be able to claim the earned income credit. See Head of Household , later.

  7. I am confused.

    I had an attorney first, then i removed him writing a letter to NVC.

    Now, they send everything on my email. I have sent all the paperwork like DS230 and AOS. I recieved email confirmation that my case is on the completed cases list awaiting for visa.

    Please confirm if i need a COA. I told them that I will be representing my husband's case.

    By writing to the NVC and remove your lawyer from you case,this letter did the job of the Choice of Agent. Since your case is completed and you are receiving the e-mail, it is not need for you to fill a COA.

    GOOD NEWS GUYS MY WIFE GOT HER APPOINTMENT LETTER TODAY. HER INTERVIEW WILL BE SEPTEMBER 17TH. I AM HAPPY!!!!!!!!!!!!!!!!.

    I understand now that I would be required to go for fingerprints again. Last time I had it was in Dec-2010 so it might be considered expired now.

    Do you know if they can ask me to undergo the medical test again and re-submit the form with latest results?

    Also, I have moved to a different location after I filed I-485 AOS form. I did fill in ar-11 and updated the address on my pending application online on USCIS website. Still, is there a way I can verify the address they have on file for me? I just want to make sure that I receive all the communications for them.

    I do not know about the medical, but in the other forum I read about a case and they already receive the letter for the new fingerprints and that was 4 months ago and their PD is not current yet. So I think your better call USCIS and make sure they have your right address.
