  1. The IRS tax fraud implications you bring up have nothing to do with the immigration process and deserve a response.

    If you are married, it is fraudulent to use the "single" status to file your federal tax return. This type of fraud is subject to various penalties and possible legal proceedings by the IRS.

    If you are married to a NRA who doesn't have a SSN or ITIN, you may file "married filing separately" (aka "MFS"). You must put "NRA" on your return in the space reserved for your spouse's SSN. You cannot e-file and must mail in your return. Since "MFS" is typically not as beneficial as the "married filing jointly" (aka "MFJ") status, some people will chose to amend "MFS" returns to "MFJ" in the future, once the spouse has obtained a SSN or ITIN.

    Now, about the immigration process: Your point that the complexities of filing "MFJ" with an NRA spouse isn't worth the hassle if the NRA is about to immigrate to the USA is valid. I personally wouldn't have bothered to file "MFJ" over "MFS" if it was simply a matter of showing additional evidence of my bona fide marriage. There were financial reasons behind the decisions we made. Keep in mind that not everyone's circumstance are similar to yours or mine. Presumably, people would chose their filing status based on their own circumstances.

    Completely agree, to not do fraud i went to irs and personally had a meeting with them to make sure inwasnt doing anytype of fraud. They said is best to file single and amend later intead of double amending. Not fraud only if u amend.

  2. It's always good to hear the opposite view and I'm glad that some of you found the ITIN application process to have been straightforward. The IRS sent my wife's ITIN notification to the wrong address and it was lost, so I'm glad we did not chance sending in her passport.

    I think most of us would agree there should be a reasonable process for the NRA spouse of a USC to be granted an ITIN. This is needed not only for tax purposes, but also to open retirement bank accounts, and to list spouses as beneficiaries on US financial assets.

    Personally, I feel the new IRS processes are unreasonable in at least some situations, but I accept that not everyone shares that view.

    Most applicants get itins to file taxes together for uscis filling, the truth is that its not needed bc is obvious to the consulate when they issue the visa that the spouse is NOT IN THE US therefore they know if you file single. By definition you have to amend once and only once your wife steps foot in the us and has a ssn to file jointly. Itins are only hell to go trough and at the end you would have to amend once more to MFJ. I went to the interview with my wife, i filled SINGLE and nothing was mentioned. I filled single bc i did not had an itin nor a ssn for my wife. I had copies of my intention to amend and a notarized letter i wrote of my will to amend once my wife could file taxes. Taxes are for support and support only not for prove of marriage, this is why you go to uscis, nvc, and consulate to prove bonafide.

    But hey you guys want to get itins, have a mess, up to you.

    Again i speak for my case only and a few more that had filled single and everything was fine.

    Yes, thts exactly what ours said, and then on day 4 it got updated with the courier tracking #

  4. Visa on hand guys!!

    Thank you everybody, we couldnt be any happier. She flyes in on thursday, it took the embassy 4 business days to have the package ready to be picked up by my wife. Very efficient. Good think bc i was worried about having to change her flight dates. I saw some posting that there are no updates on the passport once the interview is don and visa issued; in our case the site is only updated once the package is picked up by the courier service.

    does my wife has to pay the visa fee &165 before she leaves the country?

    we are on the process of paying it and i dont know if its an obligation to pay it now or after she is here. it specifies on the paper she received by the consulate that it has to be before she travels. has any of you guys not paid it and traveled?

    just little tight in money now and if we can pay it after shes here then you know,

  7. Hola a todos,

    Ayer me llegó un correo diciendome que la embajada envió mis documentos al DHl y hoy me llegó otro correo diciendo que estaban listos para recogerlos. como me queda a pocas cuadras fui y busqué mi visa que viene con un sobre amarillo que no se puede abrir por que lo abre migración cuando se ingresa a los Estados Unidos.

    La visa se vence a los 6 meses a partir de los examenes médicos, en mi caso es el 24 de enero de 2015.

    Nos devolvieron los documentos de evidencia d ela relación (fotos, conversacioes, pasabordo, etc) y lo de soporte economico.

    Quedo pendiente de sus dudas.

    Como les contaba, yo viajo el 6 de septiembre y nos casamos el 20 de septiembre.

    mira desde el dia que tubiste la cita hasta que la recojiste la visa, cuantos dias pasaron?

    nosotros tuvimos la cita el 14 de agosto, y mi esposa vive en cali, masomenos para saber un estimado de cuantos dias se demora para que le llegue el paquete.

  8. Check Tampa International, those might be cheaper than Orlando (I think Disney & Universal make that airport mkre expensive by default). If there's no construction on I-4, it's an easy drive back to Orlando :-)

    We're leaving for Prague on the 21st for our anniversary trip. We booked that before we even had I-130 approval!

    ok i bought the ticket, 14 days after the interview or 2 weeks. i hope we get the passport before..thanks guys

  9. Are you flying to Tampa International? Do any of the airlines fly into St. Petersburg airport? I remember when I used to live in Tampa, sometimes flights to St. Pete were cheaper.

    My husband and I are leaving 2 weeks after the interview. Check the averages for Columbia and then decide what's best. :-)

    no shes flying to orlando, well ive read that its about 7 days. have you bought the ticket already without going to the interview?
