  2. My joint sponsor is gathering together his information to give me to send in with our package. I have a question about paperwork - another one!

    He has his tax returns for the last year, plus a letter from his company stating his length of employment (34 years) and his salary. He doesn't have or keep pay stubs, not entirely sure the situation with that one, but can have his company detail his last 3 or 6 months earning in an affidavit. Are we missing anything?

    We have completed the FIL's I-864 as Joint Sponsor. I have finished my wife's as Main Sponsor. She has no income so I've included the following in an attachment:

    Q.25 Federal income tax return information.

    I did not file Federal income tax returns with the IRS in 2009, 2010 and 2011 because of zero income due to being a stay-at-home mother.

  4. I am in the process of getting my paperwork together to file I-130/I-485 concurrently whilst in the US. I have been divorced in my past, but my UK Decree Absolute is just a single page from Llanelli County Court, no signature at all - just a stamp in the top right hand corner indicating the Court.

    I showed it to my American wife and she seems to think I should have something more substantial to send in with my paperwork. Am I missing something? or is this truly all I need to send in?

  6. 1. Send what you have. They understand newlyweds don't have a lot of evidence, and that it is hard to get joint things with no SSN. I would have your FIL write an affidavit that also states, in addition to his attestation of your real relationship, the fact that you live with him.

    2. That's fine, though I hope you have a co-sponsor.

    3. There is a particular doc they are looking for. You might use the search function for UK or English divorce decree, I know that sometimes there is trouble with them because they look unusual (no signature, as I understand it). You might check in the UK subforum about what they are looking for exactly.

    1. I will get right on that. I guess we'll have a few months after I send the package off to gather more evidence.

    2. We do have a co-sponsor.

    3. I had already looked around in the UK forum and it seems that it all depends on the officer that gets your package. Some know that the UK decree isn't anything big, others don't. Our Nisi in the UK is the big part so I'm going to send it in with the decree to cover all our bases.

    Try wells fargo. I was able to open a join account with her as a secondary account holder and me as the primary account holder.

    I think she can even open one on her own. I know this because I saw the Indian people (B1/B2) from work opening free checking account to cash the traveller checks.

    Thanks for the tip about Wells Fargo, but I don't even have a visa as I arrived in the US on the VWP. I just have a stamp. I will try Wells Fargo though as I'm not sure we actually tried them.

  7. Have gathered all the evidence together and have completed the forms using the guides on the site and some advice from a few members. Thanks to all for your help!

    I still have a couple of few questions about our package:

    1. In the way of evidence, we don't have much. We have our marriage certificate and the fact that I've been added to her credit card (We were going to settle in the UK, but we decided to stay here instead so didn't have long to act). I have tried some of the banks in my local area of Georgia and also some credit unions, but they all seem to want a SSN # or some kind of visa they can enter into the system - all I have is my VWP stamp right now. My FIL has added me to their family plan, which my wife also belongs to. Would that serve as evidence? She doesn't work so she doesn't have healthcare she can add me to, nor to do we have any life assurance or anything like that. We live with the FIL so there isn't a lease either, should I get him to write a note saying that we're living there right now? Any suggestions on whether we have enough evidence or should I hold off and gather more before sending off the package?

    2. My wife is obviously my primary sponsor, but she hasn't worked for 4 years. We just wrote a letter that states she hasn't been required to file taxes for the last 4 years due to her not working as per the guidelines taken from the IRS website. I believe that should be sufficient? correct me if I'm wrong, please.

    3. I've been married before so I've included all my divorce paperwork including Nisi and Decree information. Too much?

    I've selected b, that's right, isn't it?

    Part 3.

    Name as it appears on I-94, Nonimmigrant visa number and consulate where visa issued all entered as N/A, correct?

    I was in Navy in UK so I've listed the name of the organisation as Military and the dates I served. On Q.15a, I ticked yes as I have served in the military and I've added an addendum on an additional sheet outlining my military service. I also have my full military records that I'll be sending with my package. Is that right?

    I'm still finding my way around the site. I think that we've nearly got all the paperwork together and we're working through the forms. Just need to see a civil surgeon about the I-693. Hoping it won't be too expensive and that I don't need too many vaccinations!

    I will be popping back over the coming days to ask for clarifications and so on. There are lots of places asking for I-94 numbers that I don't have, do I use my long ESTA number, put N/A or NONE?

  11. Are there any other people in your FIL's household?

    The petitioner counts herself, any dependent children, and the intending immigrant in their household.

    The joint sponsor counts himself, any spouse, dependent children, and the intending immigrant.

    We (me, wife and her daughter/my step-daughter) are living with the FIL at the moment if that makes any difference?

    So it's ok for me to be on both forms and being claimed on both forms?

  12. What is the make up of the household where you live? Specifically is your father in law the head of his household (has a wife, children at home, other dependents)?

    Does your wife have any income?

    If your wife has little to no income then it would be better to have the joint sponsor complete the I-864 regardless of the relationship. This gives the adjudicating officer a clearer picture of the joint sponsor's household. Also, it prevents a delay that an RFE for an I-864 would cause if the 864A was submitted.

    My father-in-law isn't married and doesn't claim anyone on his taxes so his household is 1 and my wife has her daughter so she has a household of 2. Which household do I put myself in? My wife's as the main sponsor or my father-in-law's as the joint sponsor. Can I be on both forms?

    I'm wondering if I could get some guidance on the I-864 we're completing so I can file I-130/I485 concurrently.

    We are having my wife's father sponsor me, but I'm not sure if that means that he needs to fill out an I-864A because we're all living in the same household or if he fills out an I-864? I have to be counted on my wife's I-864 as I'm technically part of her household, but aren't I also part of my father-in-law's household as he's sponsoring me?

    I'm sure this will be first of many questions I need answering so thank you all in advance...

  14. I'd like to say a big hello to all the admin and members that have contributed and made this site for people like me to use and hopefully point me in the right direction.

    I'm a British guy that came over to see my girlfriend, but we decided to get married and make a new life in the UK. That was scuppered when the father of my new wife's daughter decided at the 11th hour to not sign any paperwork to allow us to take her out of the country (not criticizing him at all as that's totally his right as a father).

    So after lots of soul searching, I decided to stay here so we can make a go of it. We have 4 weeks before my VWP runs out and I have to go back to the UK. We have taken legal advice and have also been to the USCIS field office - they both say that I am eligible to fill concurrently should I so choose - they say it means that I can remain in the US whilst they decide my case. The USCIS explained that I need to fill out the I-130 and I-485 and send them together as well as apply for work authorization and travel parole if I so desire. I actually found them very useful and awfully friendly.

    The info guide here has been very useful, but I would love some help with some of the questions as I work through it. It would also be fabulous to speak with some people that have also filed concurrently whilst on VWP. I have read lots about J-1 people and other visa codes, but not so many on VWP.

    If anybody has any words of wisdom to share or would just generally like to chat about the process, then come say hello...
