  1. Come down, ok? Definition of marriage is not "I've never seen a dime of his money", so don't kill a messenger, ok? Who cares if you live apart, don't share money or agree on open marriage? Government? This is not knowing "everything" about taxes, it's basic, common and necessary knowledge like mortgage rates, car loan, simple and compounded interest, health insurance... this is something that you, as a responsible taxpayer, should educate yourself about. And, just for the record, I did try to help you and told you that amended return is your best option. You are married and you should file as married. Filing as single is misrepresentation - if you are not able to understand what was wrong with your return then nobody can help you. If you want to change the laws, go ahead... Again, talk to an accountant, it's going to be fixed in no time and shouldn't cost you a lot. Btw, I am an accountant and I know US tax laws really well, so I'm able to give you an advise about your husband's return, but not yours - what I know for sure is that it's not a huge problem and it can be fixed easily. I can look into Canada-US agreements and post what I find over the weekend. Peace? :)

Last year when I filed, I filed on the advice of Tax people, who I thought knew what they were doing.(they filed me as single, even though I had given them a copy of my marriage certificate) After realizing they had done wrong, I amended the 2012 tax return and filed married for this years(2013) return and that is why they say I owe. When I e-filed this years return from the Canada Revenue Agency's website the program did NOT ask me for his income. I did not have to include his income when I filed. But now they are asking for it now. And because it was not included in the return they say I am not eligible for ANY of the benefits I received and have gone to back July 2012 and added up all the benefits that were given to me and say that I now owe the Canadian government. When we filed MFJ in the US, I did NOT have to include MY income on his return. I am not an idiot, and know the mistake that was made and have corrected it already. What I do NOT understand, like I said HOW can the Canadian government be justified on taxing someone for money they did NOT earn, did NOT receive, and that was NOT earned in Canada or received in Canada. So in order to know the answer to that question, I have to educate myself, which is exactly what I am trying to do. But it doesn't make me ignorant.

  2. Unfortunately I don't know much about filing taxes while married (yet...), but did you talk about this situation with HR Block? That's where I'd start looking for answers.

Last year when I filed my taxes I went to H&R Block, gave them a copy of my marriage certificate and they are the ones that filed me as single. This year I filed myself and filed as married (cuz I'm supposed to). CRA reassessed my last years taxes, amended it from single to married, and that's why I owe now. So I don't think H&R Block will be much help as they are the ones that filed wrong in the first place. I will call CRA on Monday or Tuesday and see what they say. Was hoping someone on here was or has been in the same situation as I am in. Thanks for your reply

  3. US or Canada government doesn't care how you and your husband deal with your finances. If you are married, you pay taxes on total income unless you file "married, filing separately" - here I'm talking about US income return. US does not tax foreign income up to the certain amount but there is an exclusion form that needs to be filed in that case. I'm not familiar with tax rules in Canada, but I do know that you can't file as single if you are married. As for your "Why should his income matter, I've never seen a dime of his money?" - I don't even know how to comment on that :) you are either totally ignorant about your responsibility as a taxpayer, or too young to understand anything about taxes :) Talk to your accountant and file amended return, you might end up paying less than 24k they requested. In US you pay less in taxes if you're married (percentage-wise), I hope that's the case in Canada as well.

    Z

How is me stating "Why should his income matter, I've never seen a dime of his money?" make me totally ignorant. We don't live together, never have. I don't see any of his money and he does not see any of mine. He supports his family in the US and I support mine here in Canada. Why should the Canadian government be allowed to tax ME and penalize me on money that I DID NOT receive. If we were living together, then yes by all means tax me on it. And how can the Canadian government tax monies that were NOT earned in or spent in Canada.

Not everyone knows everything about taxes, so for you to say I'm totally ignorant is very uncalled for and very rude. If you don't have anything nice to say don't say anything at all.

  4. So I filed as married this year on my Canadian tax return, HR block filed for me last year as single(was married in 2012). I am Canadian citizen still living in Canada. Hubby is US citizen still living in the US. We have never lived together, nor does he support me in anyway. I just received notification that I owe the Canadian government $24,000.00 for CTB,OTB, and GST because my marital status changed and they reassessed last years return. They want me to send them hubbies worldwide income. Why should his income matter, I've never seen a dime of his money? Will this affect me immigrating to the US. Case complete is only two weeks away, Interview should be early June. I'm a little worried about this. Please someone help me out here. Thanks

  5. This is from the consular information page on your country portal. http://www.visajourney.com/consulates/index.php?ctry=Canada&cty=Montreal

Cost of Medical Exam? Varies by Doctor.

It is advised to schedule exam at least a week before interview if going to Medisys in Montreal. Medisys requires 3 days after the exam to get the results back (medical day + 3 more days, weekends not included)

Medisys charges $50 plus taxes anywhere in Canada for shipping the medical by Purolator.

Medical Exam costs for Surrey Office are:

    Adults - $275.00, Pregnant Adult - $225.00, Child - $150.00

results can be picked up the following afternoon.

So the answer is YES! I HAVE to pick up my medical 3 days after the exam. Thank you

  6. My evidence is inconclusive :( I thought I saw a pattern going on but everyone submitted their ENROLL emails at different times (before and after AOS, with and without autoreply).. With the huge backlog of emails and the problems they are having with autoreply it doesn't really matter when we send the ENROLL email. As long as it gets accepted at some point :)

They just accepted my AOS today, and when I emailed it to them, I did NOT receive an auto reply. AOS was also sent before ENROLL acceptance. AOS was sent March 26, and I just got accepted for EP today and received notice today that they received my AOS. There's no rhyme or reason for anything NVC does. It's all just a guessing game.

  7. Woohoo. Finally some action. Enroll Acceptance this morning and now this when I got home from work.

    Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: MTL2014xxxxxx filed by OMER on behalf of KIMBERLEY.

We received electronic documentation for this case. Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed.

Quick question. When they state "Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed." Do they mean from the day I emailed them the AOS? If so they responded to the one I sent on March 26 (which I did NOT receive an Auto reply for), so they only have 3 more days left to review it. Today would be 17 business days. Which would also mean they only have 10 business days left to review my IV. That can't be right. It must be from when they sent me the email which was today.

  8. In my case, they replied to the original ENROLL email I sent, and that one I didn't receive an auto response. What I was told by the operator I spoke to a couple of days ago is that their email system is so bogged down from receiving so many emails, that the auto responder hasn't been working each and every time. Thus, if you sent an email one day, and then sent them an email a few days later, you should only receive one auto response for the system recognizes your email.

Granted, I don't know how much truth that holds considering I got an auto response for the second email I sent several days after the first (being the ENROLL email, and then my AOS package), but I do believe that the auto responder is not always working the way it should be.

I'm glad to hear you received an acceptance email, though! Full steam ahead now. :)

Thanks. And I will be watching you closely as u are only a few days ahead of me

  9. I see you guys have been stressed out about the auto reply. I ll also share my info to add to the confusion. :P

So, we have not received auto reply to our ENROLL email which was sent on March 18, but our ENROLL was accepted.

AOS package : no auto reply either, was sent on Mar 19, but was received just after ENROLL was accepted. And on April 11th, we received a checklist about a small typo level mistake on the I864 and we responded to it the same day still with no auto reply.

All these are what NVC has responded to. Per a call early on (I think it was after we sent our ENROLL email) we were told NVC is not sending auto response any more because they are receiving 30,000-40,000 emails a day. Then we DIDNOT stress about the auto reply.

So, if you ask me, according to my experience, they still received what we sent despite the auto replies.

Well the only thing I can CONFIRM that they received from me is the ENROLL sent on March 26(auto reply received) because that's the one they responded too. As for anything else I've sent they have NOTHING in there system for ANY of my emails as of 930 this morning.

I've been told , that you should receive auto reply, their auto reply isn't working properly and that you will not receive auto reply anymore. Who knows. They've got 3 copies of my AOS now, and 3 for IV. They'd better receive at least one of them.

I've also been told that I couldn't email AOS or IV before receiving ENROLL acceptance, and that I could send them before receiving confirmation.

I'll just wait and see I guess. Who knows how they work. Every operator has a different answer

  10. Don't have case complete yet, but I was just wondering if maybe someone had some insight on this

For Medical in Montreal: After I go for medical. Do I have to pick up a packet from medical office 3-4 days later to bring with me to the interview or do they send it to the consulate? If so, I know my employer will not give me a week off work so that I can just stay in Montreal(can't afford it either). Was actually thinking of getting medical done in Toronto coming home, waiting a couple days, drive back to Toronto pick up my medical packet stay the night in Montreal and go to interview next day. Toronto's a 5 hour drive and montreal 8 hours from home.

  12. I have been watching closely people that are doing EP and I have noticed that anyone sending their ENROLL email before AOS has been paid, that they needed to re-send it.

We should send ENROLL emails AFTER AOS fee has been PAID.

That is when you will get an auto-reply and it will be recognized by the system.

Just a heads up for everyone doing EP.

Maybe Saylin can fix her Wiki for Montreal EP: http://www.visajourney.com/wiki/index.php/NVC_for_Montreal_Beneficiaries_%E2%80%93_Electronic_Processing_and_New_Online_Forms

If anything, I would think it has to do with the DS-261 more so than the AOS, it may have to do with receiving or not receiving auto-reply as well. Myself and Lukiduki both sent ENROLL before filling out DS-261 and did not receive auto-reply, after DS-261 we both received auto-replies. Spoke to several people at NVC, and the majority has said that in order to know if NVC received emails one should receive an auto reply.

  13. This is a question for ENROLL and Electronic processing cases. Finally received ENROLL acceptance, they replied to my March 26 one(that I received an auto reply for) I sent ENROLL on March 19(did not receive auto reply) So it would seem you have to receive auto reply in order for them to actually receive it. After you received ENROLL acceptance, when you emailed in your packets, did you receive an out of office auto reply from NVC? And how long did it take to receive and review those packets? I emailed my AOS on March 26, April 1 and April 15(this is the only one I got an auto reply for). And IV was emailed April 4 and April 15 (did not receive auto reply for either one). Just curious as to how much longer I'm going to have to wait.

  14. lol ok :). Well, do they e-mail you the interview date or should I call ocassionally? also I know I need to register for LOOMIS, when do I do that?

Yes, they will email you, but you'd find out quicker if you call them every now and then. As for LOOMIS i'm not 100% sure. All I know is you have to register before interview.

This may help you out http://travel.state.gov/content/dam/visas/Supplemental/MTL%20-%20Montreal.pdf

Also I believe this is where you would go to register https://usvisa-info.com/en-ca/selfservice/us_immigrant_visas

  16. I still haven't received my enrolment confirmation email for EP, either, but also sent in the packages before doing so in the off chance it doesn't make a difference. It's incredibly frustrating that I've been sitting here twiddling my thumbs not knowing if they've even received my email. /o\

(Granted, I've not received a false check list after completing the DS-260, either, so I don't know what to make of it.)

Our timelines are close, I'll be watching you.

And I know this wait is killing me. At least before we could keep busy gathering the required info and preparing forms. I even have my packet for the interview ready, immunizations taken and updated and medical records ready for pick up from doctor. Everything is done now, nothing to occupy my time. Going crazy waiting.

  17. Hi, I just got the case # and after reading your post I wonder if I should up to EP or snail mail? I have a lawyer and he recommends to do EP, but I really want this process to end as soon as possible. I will appreciate any comments. Thanks and good luck to you in this process!

In my opinion I would do snail mail if I were you. AOS was paid 3 weeks ago, IV was paid 2 weeks ago and ds 260 was submitted 10 days ago. And now I'm on hold waiting for EP acceptance before I am supposed to email anything to them. Although I've already emailed the AOS and IV, I have no clue wether they will receive them or not because I haven't been accepted for EP yet. Some people have had luck with the EP. So far for me I wouldn't advise anyone to do it. I'm just sitting here waiting, as every NVC operator has told me it can take up to 30 business days to receive Emails.

  18. ummmmmm... here comes a stupid question...

What is the ENROLL thing you are referring to?

Some people have to send there stuff in via snail mail some have to do it by email(electronic processing), Canadians can choose which to do. If we want to do electronic processing we have to send NVC an Email with ENROLL in the subject line to request to do electronic processing and then we have to wait to receive an email from NVC saying we have been enrolled for electronic processing before we can send anything to them by email. I assumed this would be quicker, but I was wrong.
