  1. Wife's EAD will expire the beginning of September so we will likely need a new card before the lumbering, bumbling, bungling government bureaucracy known as USCIS issues her green card.

The instructions for filing form I-765 are here.

And the form is located here.

Hilariously long list of addresses where to send completed I-765 is here (K1 visa applicants should use Chicago lockbox).

In addition to the completed I-765 I have included the following:

-Copy of the receipt notice that I-485 is pending, which I assume is the I-797 Notice of Action they sent to us, which documents application/biometric fees were paid.

-Photocopy of the current EAD card.

    -2 passport sized pictures.

Renewal applicants are not required to pay any fees.

Is this it? Am I missing anything else here?

Do they make you come in for another round of pictures/fingerprints?

    THANKS

  2. You will be able to find out your interview time/date 1 or two weeks after you submit form 160.

For us the actual interview was almost 3 months after we submitted the DS160.

We submitted everything in January, and the interview took place on March 31.

  3. The moral of the story is don't bother petitioning for a K1 visa or CR-1 if you are under ESTA or have a tourist visa. Just travel to the US with no intention of getting married, change your mind (or have the petitioner be oblivious to the law) and then AOS.

(Of course I am not advocating this, just stating the unfairness and the typical abuse of this loophole).

    +1

My feelings exactly! To believe they had no intention of getting married before she entered th US is a complete joke.

Why they allow this loophole to exist makes no sense.

Might as well have the law state ESTA eligible countries are exempt from K1 requirements.

  4. Good luck with your interview!! How much did you have to pay for your police certificate? Thank you and keep us posted.

I think the embassy wants these documents to be less than 90 days old at the time of the interview.

It's best to know your interview date before obtaining these documents. They should only take a week or so to be produced for you.

If i remember correctly the criminal record cost $100-120? and the certificate of single status was like $15.

  5. You can call the NVC at 603-334-0700 or call Dept. of State at 202-663-1225 and ask them about the status of your 129.

To do this you need your 129 receipt number (ex. TSC1234567890).

If they have processed it they will give you another receipt number that starts with PHP (ex PHP1234567890).

Then you can use this number to email the phnom penh embassy to inquire if they have received your application yet.

You can also use this number to complete the DS160 online . Don't forget to print out copies of the confirmation page when you finish.

  6. This is why the embassy puts the packet 3 checklist on their website to download, they never mail "packet 3" to the applicant in Cambodia.

I think my wife did get some approval notice that stated the embassy had her application from the post office (they called her and met her somewhere to give it to her), but that was like a month after we had already scheduled the interview.

    For K 1 applicants.

As far as the address for the 325a form, we just listed the nearest intersection of major roads/streets.

I wouldn't worry about what you write, just make sure it's consistent with all the forms you fill out.

  7. My Khmer wife has a different last name than both her mother and father (they gave her the same last name as one of her grandmother) and we had no issues. Are both your mother and father's names listed on your birth certificate?

You last name being different than your father's is not problem, as long as your birth certificate/passport/ID card are all the same name and all the paperwork you've submitted have the same info and spellings.

  8. I think a lot of the denials in Phnom Penh come down to how much time is spent together, physically present in Cambodia or wherever. If you're only in Cambodia one or two times for a week or two at a time, then proving a real relationship is difficult here. Unfortunately these engagements are judged from a Western/American perspective and not a Khmer perspective.

  9. yes i found out that emailing the Embassy is the best way to contact them since it is tough to get through when calling. Does anyone know how often the interview schedule get update on their website. i received an email stating they sent packet 4 to me with interview date.

What is the website address you use to find your interview date?
